Detail location in relation to distance to amenities/buildings in the area. Include a detail of the anchoring system. Deposit: A $200.00 deposit for each piano must be attached to the application because the piano must be securely anchored in the right of way. The City will return the deposit when the sidewalk is restored to its prior condition. Insurance: Attach to the application a certificate of insurance showing insurance coverage as required in Paragraph 2 on Page 3 under "Terms of the Piano Permit." Indemnification Agreement: I agree to: pay on behalf of the City of Iowa City ("City") all sums which the City shall be obligated to pay by reason of any liability imposed upon the City for damages of any kind resulting from use of public property and the public right of way, whether sustained by any person or person, caused by accident or otherwise and shall defend at my own expense and on behalf of the City any claim against the City arising out of the use of public property and the public right of way. If the applicant is not an individual, the person signing this application acknowledges that he or she has the authority to act on behalf of the group that is requesting the permit. Signature of Applicant Date APPLICATION FOR PIANO PERMIT 2 FOR CITY USE ONLY: NOTICE OF DECISION GRANTING OR DENYING THE APPLICATION _______ The application is approved and the Piano Permit is issued for the location as shown on the Location Map. The terms of the Piano Permit are on Page 3. _______ The application is approved except for the location as shown on the Location Map. The location shall be as revised on the Location Map. The Piano Permit is issued and the terms of the Piano Permit are on Page 3. _______ The application is denied because City Engineer or Designee Date APPEAL RIGHTS An applicant aggrieved by the City Engineer's or designee's decision to deny a permit may appeal the determination to the City Council if, within five (5) working days after the decision, the applicant files a written notice of appeal with the City Clerk. In such event, a hearing shall be held by the City Council no later than its next regularly scheduled meeting, assuming the appeal is filed in time to allow notice of said appeal in accordance with Chapter 21 of the Iowa Code. Upon such hearing, the City Council may, based upon the standards enumerated in the City Code, reverse, affirm or modify in any regard the City Engineer's or designee's decision. The City Council's decision is the final decision. 3 TERMS OF THE PIANO PERMIT 1. The permit is valid from March 1 of this calendar year to November 30 of this calendar year. 2. Insurance in the following amount and type: Commercial General Liability – $500,000 Each Occurrence/$1,000,000 Aggregate. There is no additional insured requirement. 3. Sale, transfer, or assignment of the piano permit is prohibited without written consent of the City. 4. The location of the piano as described above cannot be changed. 5. No sign or advertisement is allowed on the piano except for a sign identifying the sponsor(s) of the piano. 6. The piano must be securely covered from 10:00 p.m. to 10:00 a.m. Sunday through Wednesday and from midnight to 10:00 a.m. Thursday through Saturday. When uncovered the piano must be available for use by all members of the public. 7. The piano shall be securely anchored to the right of way. The anchoring system must be approved by the City Engineer or designee. Applicant shall notify the City Engineer at least five (5) business days prior to the date of installation or removal, specifying the date of such installation or removal, to permit the City Engineer to inspect the installation and removal of the anchoring system, and to inspection the condition of the right of way. Applicant shall be responsible for all damage to the right of way caused by the anchoring or placement of the piano. When the anchoring system is removed from the right of way, the sidewalk must be restored to its original condition by Application under such standards as promulgated by the City Engineer. Applicant shall be responsible for any damages to the sidewalk caused by the placement of the anchoring system. The $200.00 deposit shall be returned when the sidewalk is restored to its prior condition as determined by the City Engineer. If Applicant fails to restore the sidewalk to its prior condition or to the standards promulgated by the City Engineer, the City may do so and apply the deposit(s) to the cost thereof. 8. The applicant shall be solely responsible for the piano and any and all damage to the piano. Wpdatamgr/specuseppermits//pianoapp-permit.doc
