This is the Report of the Community Police Review Board's (the "Board") review of the investigation of
Complaint CPRB #161602 (the "Complaint").
BOARD'S RESPONSIBILITY
Under the City Code of the City of Iowa City, the Board's responsibilities are as follows:
1. The Board forwards all complaints to the Police Chief, who completes an investigation.
(Iowa City Code Section 8-8-7(A).)
2. When the Board receives the Police Chiefs report, the Board must select one or more of the
following levels of review, in accordance with Iowa City Code Section 8-8-7(B)(1):
a. On the record with no additional investigation.
b. Interview /meet with complainant.
c. Interview /meet with named officer(s) and other officers.
d. Request additional investigation by the police chief, or request police assistance in the
board's own investigation.
e. Perform its own investigation with the authority to subpoena witnesses.
f. Hire independent investigators.
3. In reviewing the Police Chiefs report, the Board must apply a "reasonable basis" standard of review.
This means that the Board must give deference to the Police Chiefs report, because of the Police
Chiefs professional expertise. (Iowa City Code Section 8-8-7(B) (2).)
4. According to Iowa City Code Section 8-8-7(B)(2), the Board can recommend that the Police Chief
reverse or modify the Chiefs findings only if:
a. The findings are not supported by substantial evidence; or
b. The findings are unreasonable, arbitrary or capricious; or
c. The findings are contrary to a police department policy or practice, or any federal, state or
local law.
5. When the Board has completed its review of the Police Chiefs report, the Board issues a public
report to the city council. The public report must include: (1) detailed findings of fact; and (2) a
clearly articulated conclusion explaining why and the extent to which the complaint is either
"sustained" or "not sustained ". (Iowa City Code Section 8-8-7(B)(3).)
6. Even if the Board finds that the complaint is sustained, the Board has no authority to c(sciplihe the
officer involved.
BOARD'S PROCEDURE
The Complaint was initiated by the Complainant on February 8, 2016. As required by Section
8-8-5(B) of the City Code, the Complaint was referred to the Chief of Police for investigation.
The Chief's Report was filed with the City Clerk on April 29, 2016. The Police Chief also provided a copy
of audio or video recordings of the incident.
Prior to the meeting on May 23rd, Board members reviewed audio or video recordings of the incident.
The Board met to consider the Report on May 23, 2016 and June 7, 2016.
The Board voted on 05/23/16 to apply the following Level of Review to the Chiefs Report: On the record
with no additional investigation, pursuant to Iowa City Code Section 8-8-7(13)(1)(A).
FINDINGS OF FACT
On 02/06/16, at about 11:55 p.m., the Complainant was met by officers at her residence and taken in a
squad car to the Police Department, allegedly to look at some pictures pertaining to an armed robbery
that occurred on 02/06/16 where the Complainant worked.
About 10 minutes into the interview at the police station, Officer A made a statement about how they
had information from many sources and it was important that the Complainant be honest. At this point
the interview changed into an interrogation as questions were much more direct. A reasonable person
in the Complainant's position would not have felt free to leave.
Approximately 19 minutes into the interview, the Complainant made the statement to officers "I need a
lawyer. You're interrogating me too much, and I already told you I don't know anything about that."
Officer A responded with "what did you say" and the Complainant repeated that she needed a lawyer.
Officer A disregarded her request for a lawyer and continued to interrogate the Complainant.
Later in the interrogation (after the Complainant had requested a lawyer), Officer B asked Officer A to
tell the Complainant to put her cell phone down. Officer B then took the phone and began looking
through it. Officer B then returned the phone to the Complainant. At the end of the interrogation,
Officer A took the phone from the Complainant and said she could pick the phone up on Monday.
When the Complainant later met with the investigator from Internal Affairs as part of the CPRB
complaint process, Officer A (who was one of the officers named in the complaint) was also present in
the room.
ALLEGATION 1 — Questionable Interview and Interrogation tactics.
At the beginning of the interview, the Complainant was not told she was free to leave at any time.
When the interview became an interrogation, the officers should have advised the Complainant of her
Miranda Warning Rights. The Miranda Warning is necessary when a "custodial interrogation" takes
place. A reasonable person in the Complainant's place would not understand they were free to leave at
any time. During the interrogation the officers left the room and left the Complainant alone in the room.
She was in an office within the Police Department, which is not open to the public. She was also
without transportation because she was taken to the station by the officers.
When the Complainant requested a lawyer, the Interrogation should have immediately ended, but
officers continued to interrogate the Complainant.
Allegation: Sustained
ALLEGATION 2 — Unlawful Seizure of the Complainant's cell phone.
As discussed above, the Complainant requested a lawyer early in the interrogation, but was denied.
Had the officers honored the request, the interrogation would have ended immediately and the officers
would not have asked for her phone.

COMMENTS
If an interpreter was needed when the Complainant met with the investigator from Internal Affairs,
someone other than one of the officers named in the complaint should have been used.

The Use of Force Review Committee met on May 25, 2016. it was composed of Capt.
Campbell, Sgt. Gaarde and Officer Hayes.
For the review of submitted reports in February, 42 Officers were involved in 34 separate
incidents requiring use of force.
All issues or concerns were identified and addressed at previous levels of review. Of the
incidents reviewed: Two Tasers were displayed and two Tasers were deployed; OC was
deployed twice; there were no SRT callouts; officers displayed firearms during six of the
incidents; and one animal was dispatched. During the 34 incidents, four suspects and no officers
were injured.

This letter is to follow up on our phone conversation held on Friday, August 12, 2016. It is
important for people to report incidents when they believe an officer has racially profiled them in
conducting a traffic stop. It is my understanding from talking with you on August 12 that you
consider your written correspondence (dated 08/06 & 07/2016) to serve as an informal
complaint. Should you change your mind I will summarize the three options for filing a
complaint about an Iowa City Police Officer to you.
1) Iowa City Police Department Complaint Form -No statute of limitations.
2) Community Police Review Board Complaint Form -Within 90 days of the alleged
misconduct.
3) Human Rights Commission Complaint Form -Within 300 days after the alleged
discriminatory or unfair practice has occurred.
I have included an Information Sheet that provides more detail on each process in this letter.
Please note that you can do all three processes or you can select two or one. The Human
Rights Commission can certainly mail or email one or all of the forms to you.
In closing, the City of Iowa City takes every complaint whether informal or formal very seriously.
Your written correspondence has been shared with the Chief of Police and the City Manager. A
copy will also be shared with the Community Police Review Board. Should you have any further

Options for
Filing a Complaint About an Iowa City Police Officer
There are three kinds of complaint forms a person may file against an Iowa City Police Officer. A person may
choose one or all three. Please note that each type of complaint has a different statute of limitations. The form
you choose determines how your complaint will be handled.
1) Iowa City Police Department Complaint Form - No Statute of Limitations
If you use the Police Department form, Iowa City Police Department Policy will determine the level of
investigation into your complaint.
You can choose to limit your involvement to a discussion between you and the officer's supervisor, or you can
choose to participate in an internal investigation which means that you, the officer, and witnesses will be
interviewed by Police Department investigators and a written report on the department's findings and
conclusions will be prepared.
Generally, investigations and any officer discipline that may result from them are considered nonpublic,
confidential records. By law, the Police Chief decides if and how an officer will be disciplined.
It usually takes from one week to three months to receive a final response from the department. When you use
the Police Department complaint form, the Community Police Review Board will not review your complaint,
unless you also file a CPRB complaint form. If you have questions, contact the Police Department (356-5275)
2) Community Police Review Board (CPRB) Complaint Form - Within 90 days of the alleged misconduct.
If you use the CPRB form, the Police Department will conduct an internal investigation. A Supervisor or
Investigator from the Police Department will contact you as part of the investigation process. Your
participation is critical to the review process.
You will be notified of the outcome of the CPRB's review. The CPRB has no authority to discipline police
officers. The CPRB handles its work with complaints confidentially and generally does not include information
identifying you or the officer in its reports. However, if a complaint is upheld, the CPRB does have the right
to include the names of complainants and officers in its reports under certain conditions.
For more information about the CPRB, consult the city ordinance that established it (Iowa City Code Chapter 8-
8). The City Code is available on-line at www.icgov.org or for review in the City Clerk's office at the City
Hall, 410 E. Washington Street, or contact the Community Police Review Board (356-5041)
3) Iowa City Human Rights Commission Complaint Form —Within 300 days after the alleged
discriminatory or unfair Dractice has occurred.
An individual who believes that they have been discriminated against due to age, race, marital status, national
origin, sexual orientation, disability, creed, sex, color, religion, gender identity or retaliated against can file a
complaint of discrimination with the Iowa City Human Rights Commission. A complaint of discrimination must
be filed with the Iowa City Human Rights Commission within three hundred (300) days after the alleged
discriminatory or unfair practice occurred. Complaint forms are available upon request or at the Iowa City
Human Rights Commission's Office. For more information about filing a complaint of discrimination with the
Iowa City Human Rights Commission contact 356-5022 or 356-5015.
Please note complaints of discrimination against the City of Iowa City, including the Iowa City Police
Department are referred to an outside agency for investigation to avoid any appearance of impropriety.

Dear Civil Rights and Police Review and to Whom this Concerns,

(Note: I am not and do not consider this a formal complaint, more of a concern)!
1 felt I needed to report a traffic stop I was involved in by a member of the Iowa City
Police Department early Saturday morning.
The main reason I am writing this letter is because I feel I was profiled.
I am a Black man.
First, and just as importantly as the way I feel about the traffic stop 1 want you all to
know I don't believe I was disrespected or mistreated in any way by the officer who
stopped me but, I do question why?
I don't remember the exact time? I was on my way home from doing laundry. It was
somewhere between 1:30 -1:45 am?
The incident: i made a right turn from LINN Street onto Burlington traveling west. I
got in the left lane after I made my turn as I knew that when I reached the
Burlington street bridge at Riverside, I was going to make a left turn to travel south
on Riverside headed home.
(I felt like I needed to be in that lane as I knew what my end game was once I
reached that particular intersection)!
As I traveled west bound on Burlington after making my turn off LINN I got all the
way past Madison and was actually through the intersection when I saw police
lights flashing in my rear view mirror.
I am now being pulled over across from the UI Recreation building and before the
railroad tracks on Burlington.
The officer who stopped me was nice and explained to me that he pulled me over
because I "made an illegal turn" when I turned onto Burlington from LINN.
The officer explained to me I should have gotten in the right hand lane based on the
turn I made and then switched lanes!
I let him know I was glad he explained why he stopped me?!?
(Honestly, seemed a bit extreme but, the traffic laws are what they are)! I wasn't
aware honestly that I needed to do that but I can understand it!
The officer asked me for my license and registration. I told him I didn't have my
registration but told him 1 had my insurance cards and he took those along with my
license saying he could look everything up.
Before then he asked the standard "have I been drinking" questions, don't
remember exactly but, that's how it was. I explained to him "no" and was coming
from the laundry mat and pointed to the back of my vehicle where anyone could
clearly see I had two baskets of laundry.
It was then he explained to me in so many words that his "main concern was people
operating a motor vehicle while under the influence." He also stated to me he "could
tell I wasn't!"
My main concern and why I feel as though I was profiled -since I had broken a traffic
law more than four blocks previous to where I was stopped is why didn't he stop me
immediately?
As I think about it, if I was operating under the influence the officer allowed me to
travel for almost 2 miles where I could have gotten involved in an accident and
caused property damage or bodily harm as I continued driving! If my traffic
violation was cause for him to think I was operating a motor vehicle under the
influence why didn't he pull me over immediately?P
That should have been his number one concern in my opinion! Of course, I don't
study law or know how law enforcement works, so really -"what do I know?"
But no, he waited another 4 (+) blocks to pull me over and check me out!?! (Was he
looking to see if I was going to swerve or drive erratically)?!
In any case, after checking me out from his squad car he gave me back my license
and insurance cards, exchanged pleasantries with me and we went our separate
ways.
(Please note: this isn't the first time I've been stopped by a law enforcement official
in Johnson CO., and probably won't be the last, after all I'm a Black man. I really have
come to kind of expect it!) Statistics prove 1 have reason to feel this way even if the
numbers have improved and decreased along with better community relations,
Black men still are routinely pulled over by law enforcement!
Overall, I have been treated with respect but I DO ALWAYS feel like the officer is
definitely looking for something to be wrong with me so I can be arrested!
(DWB) is real!
It has happened to me enough that I believe it! And generally, I just let these things
go but this particular stop especially after the reason given for stopping me and not
being stopped immediately makes me feel as if I was profiled. I don't like the way
this has made me feel.
Also, this incident makes me feel less respectful of law enforcement!
I had NO IDEA a law enforcement officer was traveling behind me that long until I
saw the lights!
Again though the officer was respectful and nice as 1 believe I was to him too!?
I do think he could have spent his time better doing something else! (An illegal turn
into an improper lane, really)!?! There were no other vehicles or pedestrians
around! Where he saw me from, I have no idea -"good job"!
Looking back on this particular stop (there is only one thing) I would have and
should have done differently, I should have put my hands on the steering wheel,
dash board or placed my hands outside of my vehicle as when I think back as the
officer approached my vehicle his hand was on his hip -holster just in case!?
Please note: I understand that law enforcement has a tough job!
But, I will remember to DEFINITELY make sure my hands are visible the next time I
get pulled over. I would hate to have my name associated with an officer involved
shooting of an unarmed Black man on a traffic stop in eastern Iowa!
Hey, it's not like it hasn't happened anyplace! That's not a paranoid feeling or belief!
Growing up Black in the United States hasn't been easy either!
Yes and I KNOW law enforcement officers get shot and abused too!
I think I'm done? In any case in closing I felt like I was profiled and I wanted to say
something as I'm a reasonable person and don't mean anyone harm!

Dickerson called the meeting to order at 3:02p.m.
DISCUSSION REGARDING RECRUITMENT OF POLICE CHIEF•
Following introductions, Paul Wenbert from Slavin Management Consultants executive
recruiting firm was in attendance to answer questions and receive input from the Civil
Service Commission and representatives of the Community Police Review Board
regarding the upcoming Iowa City Police Chief recruitment. Attendees offered feedback
to the consultant regarding the needs and challenges of the community and Iowa City
Police Department and the qualities desired in the next Chief.
ADJOURNMENT:
Case moved to adjourn, Wyss seconded. all were in favor and the meeting was adjourned
at 3:51p.m.
