The matter will be submitted to the voters for approval in the September election. Our attorney, John Cruise, has completed a preliminary investigation into the status of our title and has recommended that we request a Quit Claim Deed from the City to remove the possibility of title objections from a prospective purchaser. I enclose a copy of John's letter to Dr. Cronin dated June 16, 1982. His letter fully explains the reasons for this request. Also enclosed are copies of three City Ordinances passed in the late 1800's conveying the property to the School District. You will probably want to have this information reviewed by your legal counsel. John has also drafted a Quit Claim Deed for your use. It is enclosed for you. We would ask that you take all the necessary steps and follow all the statutory procedures required for executing the deed and delivering it us. If you have any specific questions about these matters you may wish to contact John Cruise directly since he is more familiar with the problem. This property includes the entire block that was historically designated as "Centre Market" when the original town of Iowa City was platted. It also includes Lots 3 and 4 of Block 25 of the Original Town located at the southeast corner of the intersection of Jeffer- son and Johnson Streets. The courthouse records show that the title to Lot 3 was conveyed by William Tierney by deed dated December 13, 1901 and recorded January 13, 1902 in Book 83, page 637, Deed Records of Johnson County, Iowa. Title to Lot 4 was conveyed by the German Evangelical Lutheran St. John's Church, Iowa City, Iowa by deed dated December 24, 1901 and recorded January 13, 1902 in Book 83, page 538. Both of these properties were conveyed to the Independent School District of Iowa City. The Iowa City Community School District is the successor to the Independent School District and is now the titleholder. Though I have not had an abstract to examine concerning these properties, the information I have discovered at the courthouse gives me every reason to believe that the School District has good and merchant- able title to these two lots. Title to the main block known as Centre Market is derived from three City ordinances summarized below: (1) Ordinance Number 446 dated April 8, 1891 covering the West half of Central Market; i 11ICROEILMED BY JORM MICROLAB- I -J I CEDAR RAPIDS • DES MOI IVES I i I .. _ J r Dr. David Page -2- June 16, L. Cronin 1982 (2) Ordinance Number 501 dated November 18, 1896 covering the Northeast quarter of Central Market; and (3) Ordinance Number 506 dated May 21, 1897 covering the Southeast quarter of Centre Market. After searching through the records in the offices of the County Auditor, County Recorder and City Assessor, I have been unable to find any deeds covering the main block. In my opinion, the three ordinances serve the same purpose as deeds and convey good title to the School District. However, there are two problems that create a cloud on the District's title and would require some additional work before a buyer can reasonably be expected to accept the title. Both problems concern the main block. When the Original Town was laid out, Centre Market was dedicated for public purposes by the State of Iowa. No patent was issued from the State to Iowa City. This was probably an oversight and could now be cured by requesting the issuance of a patent from our State government. This procedure has been followed previously in Iowa City when urban renewal required the vacation of downtown streets and alleys. Though it might take several months, a proper patent could be obtained without any particular problem. The second problem concerns the fact that all three ordinances covering the main block contain language restricting the use of that property for public school purposes and requir- ing the property to revert to Iowa City if it should no longer be used for school purposes. In my opinion, the restrictive and reversionary rights are now void because of Section 614.24, The Code of Iowa. That Section provides that such rights are extinguished unless a verified claim is filed with the County Recorder preserving them. My search indicates that no such verified claim was ever filed within the statutory time period. A title examiner for a potential buyer could disagree with my interpretation and it would not be unreasonable for a buyer to request that the City give us a quit claim deed to clear the record. It would be a standard practice to request a quit claim deed in a situation like this and I expect that the City would be willing to give us the deed to remove the cloud on the title. It is my understanding that the Board will reconsider the sale of the property at its meeting on June 22nd. If the Board decides to sell, we should proceed to have the matter placed on the ballot for the September election. Cron«n Page -3- June 16, 1982 abstracts and contact both the City Council and the State of Iowa requesting their cooperation in removing the clouds from our title. The worst possible thing that could happen would be that we would not be able to clear the title to the satisfac- tion of a buyer and we would be left with the property. In that event, the Board might consider using it for other school related purposes including possible use as.a location for physical plant facilities. However, since the School District has had complete and unhindered use of the property for such a long time and since it would benefit everyone to have the property sold, I expect that both the City and State governments will be very cooperative in helping us accomplish the details of clearing the title. I am writing this letter to each of you personally, so that you will be on notice that the City of Iowa City is trespassing on ,Ay property and that I am demanding a rental fee of $ 1,000.00 per month for'the use of this space by the City of Iowa City, said rental fee to be calculated commencing on January 1, 1982, when I purchased the property. As of July 1, 1982, the total rental fee accrued and owing is $ 6,905.17, which includes interest at an annual rate of 17.00 percent, compounded monthly. Is this situation another example of the incompetence and inept performance of the City Manager and Legal Staff of the City of Iowa City? As you no doubt have realized by now, I have become aware of the fact that there are no valid, legitimate Courts of Law or Courts of Equity in this State because the Judges are not elected, as required by the Constitution of the United States, which guarantees a Republican Form of Government to each State. As a result, not only are the People of the State of Iowa deprived of their Constitutional Right of access to Courts of Law and proper Courts of Equity, but so are the State, County and Municipal agencies of government deprived of such access. The de facto Equity of unelected Judges constitutes a private, dictatorial rule outside of the Constitution, since the only legitimate function of government is to protect the Rights and freedoms of the People, and this situation is not to be tolerated by freeborn, Sovereign individuals. This is the very judicial tyranny that Thomas Jefferson warned us against. This has all been brought about over the years by the connivance of legal mercenaries and politicians on the one hand, and by the ignorance and gullibility of the People on the other hand. Since there are no valid Courts in which to sue for satis- faction of my claim, I rely upon your honor and integrity to see to it that proper action is taken by you. However, if my demands are not met by the duly elected officials of the City of Iowa City, I will be forced to resort to the Common Law for further action. To the Members of the City Councils I am a Senior Citizen of Iowa City having resided at 1617 Wilson street since 1950 and this is the first time I am ma'r_ing an appeal to you. Wilson Street is a narrow street with one side parking and my problem is having people Park directly opposite my driveway. _ A few years ago the City out in a new storm sewer, just inches from abuttinour driveway, and, at that time a curb was added onto the driveway. This makes it very difficult to back the car netting the rear wheel over the curbAhTo the storm sewer cover and from this cover down onto the street. With the cost of tires today, one is a bit reluctant about doing this too frequently. On the other hand, if we back our car from the driveway onto the street, we must angle back and forth two or three times before the car is in position to avoid touching the parked car. However, just yesterday, in attempting to get my sister to a doctor's appointment on time, I didn't do this which resulted in touching the car and making a dent in the front fendsrof the parked car. Where wns I to find the owner' I had to go from house to house to do this! By that time I had lost my patience, because this has happened many times before this, hence this letter. I am asking the City Council to please order the street curb to be painted yellow opposite my driveway. This would solve the problem,mc:cing it much easier for me and make the people visiting in this area much happier for not having to make an "uncalled for" claim to my Insurance Agent.
