WHEREAS, Iowa City Flying Service, Inc. ("ICFS") is currently a fixed based operator at the Iowa City Airport; and WHEREAS, ICFS has a fixed base operator lease with the Iowa City Airport Commission for certain buildings, appurtenances, and areas situated at the Airport which expires on December 31, 2001; and WHEREAS, PSAir, Joseph Spreitzer and Gordon Peterson are currently negotiating to purchase ICFS and its existing lease with the Iowa City Airport Commission; and WHEREAS, PSAir, Joseph Spreitzer, and Gordon Peterson have offered to provide new fuel tanks and other improvements if the Iowa City Airport Commission will amend the current lease to give PSAir and/or Joseph Spreitzer and Gordon Peterson a right of first refusal on a new, minimum six-year lease on terms to be set by the Iowa City Airport Commission after the current lease expires. NOW, THEREFORE, BE IT RESOLVED BY THE AIRPORT COMMISSION OF THE CITY OF IOWA CITY, IOWA that the Chairperson is hereby authorized to sign and the Secretary to attest an amendment to the current fixed base operator lease to provide a right of first refusal for a new minimum six year lease on terms to be set by the Iowa City Airport Commission after the current lease expires on the condition that: 1 . PSAir and/or Joseph Spreitzer and Gordon Peterson purchase Iowa City Flying Service, Inc. and Iowa City Flying Service, Inc.'s fixed base operator lease with the Iowa City Airport Commission; 2. Wendler Engineering $ 681, 000 The Airport Commission has negotiated a construction contract with Wendler Engineering in the amount of $ 681, 000. 00, pending approval of financing from the City Council.
