Narrative of Offense Committed
On or about the above stated date and time, the Defendant did
commit an act against ___, with the intent to cause serious injury and cause serious injury
NARRATIVE
On the above date and time, the defendant drove a co-defendant to Hawks Ridge apartment complex to sell 6 THC Cartridges and 2 ounces of
marijuana for $660 to the victim and the victim's friend. An argument ensued about payment for the drugs between the co-defendant and the victim.
The argument ended when the defendant, from the driver-seat of his vehicle, shot the victim as the victim stood at the passenger side of the car. The
victim was hit through the arm and into the torso, requiring surgery and an approximately 1 1/2 week-long hospitalization. The defendant and co-defendant fled the scene. The defendant never reported the shooting to the police, as required by Iowa Code 704.2B: Use of deadly force - duties -
evidence. Also in violation of 704.2B, the defendant disposed of the shell casing left behind in his vehicle. The above facts were confirmed through
witness interviews, cell tower records, text messages, and images discovered in the download of the defendant, co-defendant, and witnesses cell
phones (obtained through search warrants). The defendant was interviewed where he admitted to shooting the victim and not reporting to law
enforcement, as he knew he should have, but denied being there for a drug deal. He claimed to have shot the defendant in self-defense. The gun
believed to have been used in the shooting was recovered from the defendant's home.
