I CALL TO ORDER Chairperson Melissa Jensen called the meeting to order at 5:34 p.m. MEMBERS PRESENT: Ricky Downing, Jessica Hobart, Melissa Jensen, Jam MacConnell, Saul Mekies, Amanda Remington • STAFF PRESENT: Staff Tammy Neumann, Legal Counsel Patrick Ford OTHERS PRESENT: ICPD Chief Dustin Liston RECOMMENDATIONS TO COUNCIL (1) Accept CPRB 23-12 Public Report CONSENT CALENDAR Motion by Remington, seconded by Downing, to adopt the consent calendar as presented. • Minutes of the meeting on January 11, 2024 Motion carried 6/0. Townsend absent. Community Forum Discussion: Jensen reminded the Board that at the October 10, 2023 meeting, Townsend expressed his desire to hold one, rather than two, Community Forums per year due to low attendance. Jensen noted the board is required to have at least one per year. Remington expressed her desire to continue holding two per year stating the forums offer an opportunity for the public to have a back -and -forth discussion with board members, which is not offered at a regular meeting. Jensen expressed concerns about the cost of advertising the forums as well as the staff time necessary to coordinate a forum. It was determined the Board will schedule one per year with the understanding a second forum can be scheduled should the board agree it is necessary. The next Community Forum will be scheduled in October 2024. ICPD Policy and Iowa Code Section re: Choke Holds — Mekies requested this item be placed on the agenda. Police Chief Liston provided a copy of the City and State choke hold policies to include in the board packet for tonight's meeting. He later provided a revised copy of the City choke hold policy which was emailed to the board members on February 13 as well as passed out at the meeting on this same date. Chief Liston explained there were some formatting adjustments made making the document easier to read. Mekies asked for an explanation of the State and the City choke hold policies. He also asked if a choke hold has ever been used and if so, how many times it has been used by the Iowa City Police Department. Chief Liston explained the City policy is based on the State policy. He pointed out the important part to note is both the State and City policy explain a choke hold as being an intentional and prolonged application of force to the throat or windpipe. He said there has never been a choke hold used by the department since he started in his position as Chief. He noted that anytime an officer puts CPRB February 13, 2024 Page 2 their hands close to a person's neck, the incident is closely reviewed. These incidents, and all use of force incidents, are included in the monthly reports provided to the Board by the Police Department. Chief Liston reported that out of the approximately 65,000 service calls in a year, approximately 240 of those require use of force. Remington asked if the lateral neck restraint is the same as applying carotid pressure. Chief Liston confirmed it is the same. He further noted this includes pressure on both sides of the neck and is very intentional and is considered a choke hold. Recognition of the Iowa City Police Department — This item was requested by Townsend who was absent. Therefore, this item was deferred to the March 2024 meeting agenda. Emergency Vehicle Siren Definitions — MacConnell noted at the January 11, 2024 meeting that she has heard various sirens used by police vehicles and wondered if the siren type used is determined by the type of call they are responding to. Chief Liston said they are not specific to the calls and have more to do with the model of the vehicle. He did point out, however, that there is a slower lower sounding siren that is used as an officer approaches an intersection. He stated it is rare that police officers will respond with both lights and sirens and that more information can be found in the Police Departments Emergency Response Policy. Remington said there is a perception by the public when officers turn on the lights to cross an intersection, they are doing so to avoid sitting at a red light. Chief Liston said he is aware of this perception, but he assured the Board they are responding to something in these instances. He shared that all emergency responses are scrutinized closely. �71fI111ryI0111:& None PUBLIC COMMENT OF ITEMS NOT ON THE AGENDA No public comment. BOARD INFORMATION None STAFF INFORMATION Neumann reminded the board that one of the board members requested to revisit the offering of the meetings via Zoom and livestreaming after a period of six months. She noted it has been more than six months, therefore, asked the Board members how they would like to proceed. Remington expressed that just because there haven't been any participants to date, it doesn't mean there won't be in the future. She further stated this is a public meeting and it is important the public have an opportunity to attend if they want to. Jensen reported there has been no participation of the public via these avenues to date. It was suggested perhaps a statement be added to the website and agendas explaining that while the CPRB meetings will not be offered via Zoom or livestreamed, if there's a member of the public who would like to make a request to participate in a particular meeting and is not able to attend in person, efforts would be made to make a meeting available for remote participation. Neumann will discuss this option with the City Clerk. She will ask for participant statistics from the Communications staff and share at the March meeting. Remington noted she thinks it is most important to at least offer the Zoom option. Meeting adjourned at 6:13 p.m. FILED COMMUNITY POLICE REVIEW BOARD A Board of the City of Iowa City FEB 2024 410 East Washington Street City Clerk Iowa City, IA 52240-1826 Iowa City, Iowa (319)356-5041 February 13, 2024 To: City Council Complainant City Manager Chief of Police Officer(s) involved in complaint From: Community Police Review Board Re: Investigation of CPRB Complaint #23-12 This is the Report of the Community Police Review Board's (the "Board") review of the investigation of Complaint CPRB #23-12 (the "Complaint'). Under the City Code of the City of Iowa City, the Board's responsibilities are as follows: The Board forwards all complaints to the Police Chief, who completes an investigation. (Iowa City Code Section 8-8-7(A).) 2. When the Board receives the Police Chiefs report, the Board must select one or more of the following levels of review, in accordance with Iowa City Code Section 8-8-7(B)(1): a. On the record with no additional investigation. b. Interview /meet with complainant. c. Interview /meet with named officer(s) and other officers. d. Request additional investigation by the police chief, or request police assistance in the board's own investigation. e. Perform its own investigation with the authority to subpoena witnesses. f. Hire independent investigators. 3. In reviewing the Police Chief's report, the Board must apply a "reasonable basis" standard of review. This means that the Board must give deference to the Police Chiefs report, because of the Police Chief's professional expertise. (Iowa City Code Section 8-8-7(B)(2)).) 4. According to Iowa City Code Section 8-8-7(B)(2), the Board can recommend that the Police Chief reverse or modify the Chiefs findings only if: a. The findings are not supported by substantial evidence; or b. The findings are unreasonable, arbitrary, or capricious; or c. The findings are contrary to a police department policy or practice, or any federal, state, or local law. 5. When the Board has completed its review of the Police Chiefs report, the Board issues a public report to the city council. The public report must include: (1) detailed findings of fact; and (2) a clearly articulated conclusion explaining why and the extent to which the complaint is either "sustained" or "not sustained ". (Iowa City Code Section 8-8-7(B)(3)).) 6. Even if the Board finds that the complaint is sustained, the Board has no authority to discipline the officer involved. The Complaint was initiated by the Complainant on August 13, 2023. As required by Section 8-8-5(B) of the City Code, the Complaint was referred to the Chief of Police for investigation. The Chief's Report was filed with the City Clerk on November 6, 2023. As per Section 8-8-6(D) of the City Code, the Complainant was given the opportunity to respond to the Chief's report. The Board voted on December 12, 2023 to apply the following Level of Review to the Chiefs Report: On the record with no additional investigation, pursuant to Iowa City Code Section 8-8-7 (13)(1)(a). The Board met to consider the Report on December 12, 2023 and January 11, 2024. Prior to the December 12, 2023 meeting, the Board had the opportunity to review the complaint, the Police Chief's report, and to watch and listen to body worn camera and/or in -car camera footage showing the interaction between the officers and the complainant. FINDINGS OF FACT: The complainant filed a confidential Community Police Review Board complaint form 65 days after the alleged incident he describes took place. The complainant reported that while as a witness for a trial, an ICPD officer reportedly had prior communication with the complainant in regard to a harassment claim. During the trial, the ICPD officer reported that he alerted the complainant to no longer engage in communication with the individual who filed the original charges against him. The complainant reports that the officer provided false statements during the trial and denies having ever been told to stop communication with the individual who filed the charges. The complainant states that the officer did not provide accurate information to the court and thus he is requesting a jury to review the case. The complaint form then describes an arrest made on April 28, 2023 in which the complainant was arrested as related to the above charges, specifically a warrant on harassment. During this arrest, the complainant remained silent in the back seat of a police vehicle for roughly fifteen minutes until he spoke to the officer to ask that he explain the process of what occurs when he arrives at the jail, the officer then explained this process. During a phone discussion with the officer prior to the above arrest, the complainant described being upset with the mother of his son and expressed his concern regarding a medical -related decision that he felt he was not included in. The complainant directly reported to the officer that he planned to continue to send the mother of his son news articles regarding the medical - related item and the officer provided an explanation regarding how this will be considered continued harassment. The officer later spoke with the mother of the complainant's son who reports threats have been made against herself and her family and reports feelings that the behavior is aggressive in nature. As a result of the above items, the arrest occurred and was followed by a trial later. (b) The falsification of any work -related records, making misleading entries or statements with the intent to deceive or the willful and unauthorized removal, alteration, destruction and/or mutilation of any department record, public record, book, paper, or document. Chief s conclusion: Not sustained Board's conclusion: Not sustained Basis for the Board's conclusion After viewing the video, the Board determined there was no officer misconduct that required follow-up pursuant to ICPD Policy 320.5.8. Within the video, the officer provides a clear explanation of what harassment entails and does directly alert the complainant to stop communication with his son's mother. Additionally, when the complainant alerts the officer that he plans to continue to send the son's mother news articles regarding the medical -related item, the officer alerts the complainant that this would still be considered harassment. The complaint is not sustained. COMPLAINANT'S ALLEGATION #2 — Violation of General Order 99-11, Arrests Arrest With and Without a Warrant: Authorization to arrest is contained in section 804.7 of the Code of Iowa. A Peace Officer is authorized to make an arrest in obedience to a warrant delivered to the peace officer, and without a warrant under the following conditions: A. For a public offense committed or attempted in the peace officer's presence B. Where a public offense has in fact been committed, and the peace officer has reasonable grounds for believing that the person to be arrested has committed it. C. Where the peace officer has reasonable grounds for believing that an indictable public offense has been committed and has reasonable grounds for believing that the person to be arrested has committed it. D. Where the peace officer has received from the department of public safety, or from any other peace officer of this state or any other state or the United States an official communication by bulletin, radio, telegraph, telephone, or otherwise, informing the peace officer that a warrant has been issued and is being held for the arrest of the person to be arrested on a designated charge. E. If the peace officer has reasonable grounds for believing that domestic abuse, as defined in section 236.2, has occurred, and has reasonable grounds for believing that the person to be arrested has committed it. F. As required by section 236.12, subsection 2. (Domestic Abuse Assault Provisions) The peace officer making an arrest must inform the person to be arrested of the intention to arrest the person, the reason for arrest, and require the person being arrested to submit to the officer's custody, except when the person to be arrested is actually engaged in the commission of or attempt to commit an offense, or escapes, so that there is no time or opportunity to do so. (See 804.14(1) of the Iowa Code) Chief's conclusion: Not sustained Board's conclusion: Not sustained Basis for the Board's conclusion: After viewing the video, the Board determined that no violation of General Order 99-11 occurred as the officer did have a warrant to arrest the individual on charges of alleged harassment. The officer did inform the complainant of the intention to arrest him, the reason, and allowed the complainant to submit to the officer's custody - all while being respectful of the complainant. Additionally, the officer responded to any questions asked by the complainant and fully explained the process of what would occur when the complaint arrived at the jail. The complaint is not sustained. Jeffrey Fink RE: October 2023 Use of Force Review DATE: November 30, 2023 The Iowa City Police Department policy requires an employee to complete a written report for any reportable use of force. Reportable use of force is defined in the Department's Lexipol Policy 300, which is titled Use of Force and available for public viewing on the department's website. This policy provides employees with guidelines on the use of deadly and non -deadly force. Upon receipt of the report, the supervisor is responsible for completing an administrative critique of the force. This process includes interviews with involved employees, body worn and in -car camera review, review of any additional available video, and review of written reports. The employee's use of force report and the supervisor's critique is then forwarded to the Captain of Field Operations and the Chief of Police for final review and critique. On a monthly basis, the previous month's use of force reports and supervisor critiques are reviewed by an administrative review committee consisting of a minimum of three sworn personnel. This Use of Force Committee consists of two supervisors as designated by the Chief of Police and one officer, typically a certified use of force instructor. The Use of Force Review Committee met on November 30, 2023. It was composed of Lt. Fink, Sgt. Cash, and Officer M. Young. For the review of submitted reports in October 2023, the Review Committee documented the following: • 25 individual officers were involved in 15 separate incidents requiring use of force. • There were no documented cases of an officer exercising his/her duty to intervene and the review of the incidents did not indicate that an officer failed their duty to intervene. • Out of the 15 incidents involving the use of force, 13 involved force being used against 13 separate individuals. There were 2 animals euthanized by officers. • Out of the 25 officers involved in the 13 use of force incidents against people, 0 injuries were sustained by officers and suspects. • There were no violations of Department policy during this review period. • Out of the 13 use of force incidents against people, arrests were made 9 times (69%). • Mental health was identified by officers as being a factor in 2 of the 13 incidents involving the use of force against persons (15.4%). • Drugs and/or alcohol was identified by officers as being a factor in 9 of the 13 incidents involving the use of force against persons (69.2%). • Out of the 13 times force was used on persons, 0 were identified as white females (8%), 5 were identified as white males (38.50/6), 5 were identified as black males (38.5%), 2 were identified as black females (15.40/6), and 1 (7.7%) was identified as Asian male. • Out of the 13 uses of force incidents against people, the average number of officers involved in the force was 1.67. • In total during this time, the iCPD had 5476 calls for service with 13 calls for service resulting in force being used on persons (.24%). Officers I and 2 pulled into a driveway in an attempt to cut the subject off from running any further northbound. Officer 1 drew their pistol from its holster and Officer 2 deployed a rifle and headed towards the back of the residence. Officer 1 observed a subject with tattoos from the neck down, wearing black shorts and no t-shirt with a maroon shirt in his hand. Officer I was not able to see clearly if the subject still had a firearm in his possession. Officers I and 2 pointed their firearms in the subject's direction and watched as he jumped over the fence to continue north bound. Officer 1 began to yell at the subject to get down onto the ground, still pointing the firearm at him, not knowing where his firearm was. Officer 3 also deployed a rifle and pointed it at the subject as other officers gave him commands. The subject got onto the ground and placed his hands out to his side. Officer 1 a reached the male and secured him into handcuffs behind his back. The officer chased the subject up the stairs until he tried to gain entry into a 4th level apartment but was unsuccessful. The subject then attempted to run down the hallway before the officer was able to wrap both arms around him and take him to the ground. The subject complied with requests once he was taken to the ground and was laced into handcuffs without further incident. Officer I arrived on scene and made contact with the subject, who was extremely intoxicated and high on methamphetamine. The subject did not live at the apartment, so Officer 1 attempted to take her to the hospital and/or Guidelink, which she refused. Officer I told the subject that she needed to leave as she was trespassing. Once the subject was told that she was under arrest, she refused to comply by not standing up and placing her hands behind her back. Officer 1 had to grab her left arm as she was grasping on to a metal pole / TV stand. Officer I was able to get her hand off of the stand by pulling her left arm. She was then taken to the ground With the assistance of other officers. The subject was kicking and making it extremely difficult to be placed into handcuffs. Once she was on the ground, Officer I was able to hold her left arm behind her back, but she had taken her right arm and put it underneath of her. Officers 2 and 3 worked on getting her right arm out from underneath of her, Officer 3 using an asp to pry her arm out from under her. Due to her continued active resistance, Officer 2 administered pepper spray, after which they were able to get her right arm out and into handcuffs. The subject was escorted out of the apartment and into the ambulance that was waitin outside. As officers made contact with the subject, he began to run from officers and eventually hid underneath a vehicle in a parking lot. While officers were pursuing the subject, one of them heard someone say, "watch the gun", or something of similar nature. Based upon the subject's behavior, those statements, and his position underneath a vehicle, Officers I drew their handgun and pointed it at the subject; Officer 2 drew their laser and pointed it at him. The officer could see the subject's head but could not see her hands. The officer was not sure if the subject still had the knife and pointed the handgun at her. The officer deployed their patrol rifle and entered the residence to assist other officers in clearing the residence. While standing in the kitchen and waiting for someone to bring a ballistic shield, the officer made two announcements. In both announcements, the officer called out to the subject by name, identified the officers as the police department, and told the subject that he had a warrant for his arrest. The officer further told the subject that he was under arrest, and that if he was in the residence, he needed to call out to them; there was no answer. Once the shield arrived, the officers entered the first bedroom (from where the sounds had been heard) and visually cleared the room from the doorway. The mattress for the bed had been tampered with and they could see through the bed frame and to the floor. The subject's leg was visible under the bed, so commands were again issued. The subject responded verbally but did not come out from under the bed. The subject lifted the mattress up, and the officer moved into the room but could not get low enough to see beneath the mattress. The officer pointed the rifle at the subject and told him not to move. Another officer lifted the mattress off the subject and had him stand up. He was taken into custody without further incident and transported to jail on his warrant and new charges sternining from the incident. The officer gave multiple verbal commands to the subject to come up from the creek, and he eventually complied. Officers located the subject standing in a comer of his bedroom near a closet wielding a bat. Officer 1 pointed their firearm at the subject and Officer 2 pointed a laser as Officer 3 was able to get the subject in a bear hug and pin the bat to his chest for safety. Officer 1 holstered the firearm as Officer 3 took the subject to the floor, still clutching the bat underneath him. Officers 2 and 3 were on each side of the subject controlling his hands so he could not actively use the baseball bat to cause harm to himself or officers. During this scuffle, Officer 1 assisted on the ground by placing their left leg in between the subject's legs and their right leg outside of the subject's right leg holding them close together so he could not kick or move his legs aggressively to escape. While still in this position, Officer 1 grabbed handcuffs as Officer 3 was able to get the bat out from underneath the subject's stomach, move it out far enough away that he could not reach it again. Officer 3 brought the subject's right arm behind his back and Officer I was able to place a cuff on. Officer 2 brought the left arm safely behind the subject's back so Officer I could place the cuff on. Handcuffs were placed on the subject without further incident. Officer 1 ran out and grabbed the male and tried to place his hands behind his back, but he began to tense up. Officer I repeatedly told the male to stop tensing up or he would go to the ground. Officer 2 arrived and took the male down to the ground. Officer 1 mounted the subject's legs and sat down on them to keep him from moving any further. Officer 1 grabbed the subject's right forearm, but he locked his arm up and would not bend his arm down to his lower back. Officer 1 placed a left hand in the middle of the subject's shoulder blades and grabbed his right wrist to try and guide his hand to his lower back, but the subject continued to tense up and pull his arm back up. Officer 2 assisted by getting a hold of the subject's left arm and attempting to place it in the small of his back. Officer 1 withdrew pepper spray from its holster and sprayed the subject across the face in a back -and -forth motion. With assistance of Officer 2, Officer I was able to get the subject's right hand behind his back. The subject latched his finger around one of the cuffs and would not let go of it, so Officer 1 tried to pry the cuff out of his fingers. Officer 3 placed a cuff on the subject's left wrist, and Officer I placed the right cuff on his wrist. Officer 1 attempted to help the subject up by placing hands under his left armpit, but he would not stand up. Jeffrey Fink RE: November 2023 Use of Force Review DATE: December 29, 2023 The Iowa City Police Department policy requires an employee to complete a written report for any reportable use of force. Reportable use of force is defined in the Department's Lexipol Policy 300, which is titled Use of Force and available for public viewing on the department's website. This policy provides employees with guidelines on the use of deadly and non -deadly force. Upon receipt of the report, the supervisor is responsible for completing an administrative critique of the force. This process includes interviews with involved employees, body worn and in -car camera review, review of any additional available video, and review of written reports. The employee's use of force report and the supervisor's critique is then forwarded to the Captain of Field Operations and the Chief of Police for final review and critique. On a monthly basis, the previous month's use of force reports and supervisor critiques are reviewed by an administrative review committee consisting of a minimum of three sworn personnel. This Use of Force Committee consists of two supervisors as designated by the Chief of Police and one officer, typically a certified use of force instructor. The Use of Force Review Committee met on December 29, 2023. It was composed of Lt. Fink, Sgt. Batcheller, and Officer Arcenas. For the review of submitted reports in November 2023, the Review Committee documented the following: • 53 individual officers were involved in 31 separate incidents requiring use of force. • There were no documented cases of an officer exercising histher duty to intervene and the review of the incidents did not indicate that an officer failed their duty to intervene. • Out of the 31 incidents involving the use of force, 25 involved force being used against 29 separate individuals. After circling around the Emergency Department, the subject saw the open exit door to the lobby, stated that she was leaving, and ran through the door. The officer attempted to pass around people to get in front of the subject and was unsuccessful until the final exit door of the emergency department going to the parking lot. The officer attempted to block the exit so the subject could not leave, but the subject was able to squeeze past. The officer grabbed the subject's right arm as she ran towards traffic in the parking lot. The subject unzipped her hoodie and pulled her arm out just as an officer from another agency arrived. The other officer reached out to grab the subject's shirt just as she tripped over her feet and fell to the ground. The officer grabbed her right arm and hand and instructed her multiple times to stop resisting and to let go of her hands. The subject kept a strong grip of her hands as she attempted to go into the fetal position screaming that she had a heart condition and did not want to go back inside. The officers were able lift the subject up off the ground and asked her to stand up and walk, but she continued to drag her feet. Hospital staff arrived with a wheelchair, but they were unsuccessful in getting the subject to remain seated. The subject continued to keep her arms and legs tense as she arched her back to keep from sitting in the chair. Staff immediately wheeled out a stretcher that officers were able to lift her up into. The subject eased u 3 the tension in her body and assisted officers with getting her onto the stretcher. When Officer I arrived, the subject was non- verbal and came toward Officer I while staring straight ahead. Officer I deflected him with a raised arm twice, then he came toward Officer I with hands outstretched in a "strangling" type gesture, so Officer 1 drew their Taser and pointed it at the ground while continuing to try and engage him in conversation. When Officer 2 arrived, the subject walked toward him with the same blank stare and without responding to any attempts to speak to him. Because of his disassociated state and non -compliant behavior, the officers decided to secure the patient for his safety and theirs. The officers attempted to secure the patient with handcuffs, and he physically resisted, so he was lowered to the ground. He clasped his hands together in front to avoid being restrained, so Officer I pulled the fingers of one hand free and held onto his left arm while Officer 2 took control of the other arm and put it behind his back. The officers were able to get him successfully handcuffed and he immediately stopped resisting, though he still would not engage or respond to verbal input. After he was handcuffed, the subject tried to eat dirt, grass, leaves and acorns from the ground. The officers rolled him to his back to avoid this behavior. When paramedics arrived, the subject was transferred to the cot and they put soft restraints on him as the officers removed the handcuffs. The subject remained cooperative for this and was trans orted to the hos pital for Psych evaluation. Officer 1 identified as a police officer several times to the subject, who replied with, "Get the fuck off of me," and refused to listen to commands. The subject attempted to pull away from Officer 1 while Officer 1 had a hold of his arm, so Officer I wrapped both aims around his body and pulled him to the ground. While on the ground, Officer I continued to identify as a police officer and instruct the subject to place his hands behind his back. Instead, the subject rolled to his back, and Officer 1 controlled both his hands by holding each. The subject continued to ignore commands and swung his left arm across his body at Officer 1, who placed a leg inside of his to pressure his hips into the ground, placing a hand inside of his left arm and against the back of his head to control his head. As Officer I kept the subject on the ground, Officer 2 arrived to assist with the arrest. Officer 1 allowed the subject to roll to his side, and he was given instructions to again place his hands behind his back, which he ignored. Officer 2 then administered his pepper spray to the subject's face, and they rolled him over to his stomach. Officer 1 was able to take control of the subject' left arm and keep it against his back until Officer 2 could place both wrists into handcuffs. Upon being summoned for help, Officer 1 briefly spoke with the subject as did medical staff on scene. The subject was illusive and unable to answer questions. He was asked to go to the hospital and declined to do so. He stated he was going to kill himself and advised by medical staff he would be forced to go to the hospital. The subject began walking away in the parking lot, at which time Officer I took hold of the back of his jacket as did Officer 2. The subject was assisted in the direction of the facility as he was passively resistant, walking with stiff legs and partially pushing away. As Officer 1 attempted to escort him back to medical staff and the ambulance, he began to actively resist, with his hands in his pockets. In an attempt to control his hands and remove them from his jacket, Officer I pulled his right hand multiple times, eventually freeing it from his pocket. The subject grasped a large butterfly knife in his right hand, refusing to let it go. Officer 1 advised officers, paramedics, and facility staff, all of whom were assisting in controlling the subject, of the knife and to take him to the ground. Officer 1 did a leg sweep on the right -side of the subject's leg area. Officer 2 dropped down, wrapped both arms around the subject's knees with a Gable grip, and pulled his legs inward, which brought the subject down to the ground. Officer 1 was able to pull the knife out of his hand. Once on the ground in a prone position, facility staff and paramedics assisted in pulling the subject's hands behind his back. Officer I placed both hands in handcuffs. He was transported to the ETC with no further incidents. One individual was trying to pull away from the other. The subject was holding the other individual's legs and biting his inner thigh on his left leg. When the subject realized Officer 1 was there, she let go. When Officer 2 arrived, Officer I placed the subject in handcuffs. After she was handcuffed, she dropped to the ground and began banging her head against the concrete. Officer 1 placed a hand on the side of the subject's face and held her head against the ground to prevent her from injuring herself. Officer I placed both hands around the subject's right bicep and, with the help of a deputy, carried the subject to the grass on the side of the road so she wouldn't injure herself if she continued to bang her head against the ground. Once in the grass the subject rolled onto her side and began kicking. Officer I instructed the subject to stand up and walk to the squad car. She refused. Officer 1 and the deputy attempted to lift the subject by her arms. She refused to stand and kicked in the direction of Officer 2. Officers 1 and 2 placed the subject face down on the ground. Officer I again lifted the subject by her right bicep. The deputy lifted her by her left arm. Officers 2 and 3 took control of the subject's legs. They carried the subject to the backseat of a squad car and placed her face down in the seat. The subject kicked at officers, and she refused to let them close the doors. After the officers were able to get the doors shut, the subject began hitting her head against the squad car partition. Officer 4 got in the backseat of the squad car to stop her from injuring herself and placed a forearm on the subject's right shoulder, applying a firm pressure to keep her from banging her head. Officer 1 drove emergently to the Johnson County Jail, and by the time they arrived at the jail the subject had calmed down. The subject turned around and told officers not to approach her, and at one point turned around and pointed the knife in the officers' direction, telling them to shoot her. The subject eventually dropped the knife but continued running away from officers, who kept pursuing her until they caught up to her. Officer 1 grabbed onto her right arm as Officer 2 grabbed onto her left, but the subject attempted to pull them forward to stop the officers from placing them behind her back. The subject continued to struggle to free her arms from the officers by pulling her arms away. Officer 1 held onto the subject's left wrist as it was decided to take the subject down to the ground. Officer I maintained a grip on the subject's left arm and pushed her in her back down towards the ground. Once on the ground Officer 1 was able to place handcuffs on the subject's left wrist and then her right wrist that Officer 2 had a hold of The subject pushed against officers as they escorted her to a patrol car, but she was eventually laced in a car and transported to the hospital for evaluation. Synopsis: The officer was dispatched to a fight in progress. Upon arrival, The officer could hear a male and female yelling at each other. The officer located the individuals involved, and the subject immediately began to scream at the officer for coming too close and for having a firearm. The officer made sure to speak soft and slow because it was clear the subject had been using some type of drug and was in another manic state. The subject was sweaty and was screaming about religion and demanding that the other individual be removed from his room. The subject walked to the end of the hallway while the officer spoke with the other individual. The officer returned to the subject and asked if he had taken any drugs in order to know how to help him, and he became irate, hitting himself, and screaming at the officer. Because of the subject's unpredictable and violent behavior, the officer drew their taser, turned it on while pointing it at him, and then ordered him to the ground The subject placed his hands behind his back after commands, and another officer 21aced him in handcuffs. He had no shirt on, and Officer 1 observed blood on him. The subject was in pursuit behind the victim. Officer 1 observed the subject throw an object at the victim, striking him in the back. Officer 1 thought the object looked like a black handgun. The subject then picked up the object and ran back up the stairs. Officer 1 ordered the subject to "drop the gun," and he yelled that it was not a gun. The subject retreated into the home and out of view. Officer 1 then stood by at the doorway behind a post giving commands for the subject to come out with his hands empty. Officer 1 gave several of these commands, and the subject did not comply. Officer 1 could hear him moving about in the residence but could not see him. After several commands, the subject appeared at the top of the stairs. He had a steel baton in his hand, so Officers 1 and 2 pointed their handguns at him and ordered him to drop it. The subject complied, and Officer 1 then kept their gun at a low ready in case he had a concealed weapon. He was ordered to walk toward Officer 1 and 2. The subject took 2-3 steps toward the east door, then turned back and walked out the north door away from the squad cars and in conflict with Officer is instructions. Officer I gently grabbed the subject by the back of his shirt around his shoulder blades and told him to "hang on a sec" in an attempt to get him to comply with verbal instructions Page 8 of 14 Iowa City Police Department and de-escalate the situation. The subject responded by violently turning and throwing his left elbow back into Officer 1's arm in what appeared to be a tactic designed to break free or strike the officer. Officer 1 transitioned both hands to the subject's right arm and used a shoulder to push him against an exterior wall. The subject was given instructions to give officers control of his hands, but he did not comply. The subject actively resisted by rotating toward Officer 1 and trying to pull his hands free. As the subject actively resisted all three officers on scene, he was moved off the concrete sidewalk and to the ground in the grass by Officer 2. Once on the ground, the subject actively tried to regain his feet by pulling his arms into his chest and his legs under his body. The subject resisted Officer I's attempt to pull his left arm out from under him. Officer 1 transitioned an arm under the subject's torso and grabbed his left triceps. Officer 1 grabbed the subject's left ankle and drove the subject's hips toward the ground, forcing him onto his stomach. The subject rolled to face Officer 1, who straddled his torso. The subject continued rolling to his stomach, and Officer 1 used body weight to hold his torso down as Officer 3 held his head. Officer 1 then placed both hands on the subject's left arm and pulled it behind his back where Officer 2 secured it in handcuffs. The subject yelled for the officer to release him and tried to pull his sleeve away. The officer directed the subject to stop pulling away and attempted to verbally de-escalate by telling him to follow the instructions given. The subject refused to comply and then pulled against the officer's grip with his whole body and sank to the ground. The officer directed the subject to put his hands behind his back, but he instead pulled both arms into his chest and tried to prevent the officer from securing his hands. The officer placed their torso on top of the subject's torso to control his body and began prying his left arm behind his back. The officer gave the other individual commands to back up and he complied. The officer pulled the subject's left arm behind his back. The subject began crying out that his shoulder was hurt. The officer released the pressure on the subject's arm, and he let it fall to his side. At around this time another officer arrived on scene and secured the subject's left wrist in handcuffs while the officer held it in place. The officer told the subject to place his hands behind his back, and he responded by reaching his left hand into his pocket. The subject tried to pull his hands to the front of his body despite the officer repeatedly telling him to place his hands behind his back. Due to the subject's furtive movements, the odor of drugs in his car, and the serious nature of his charges, coupled with his attempts to physically resist and obstruct the officer, the officer warned him that he would be lased if he did not comply. The officer drew their laser and pointed it at the subject, but he began to comply, so the officer holstered it without deployment and returned to handcuff him. Another officer attempted to remove the subject's cell phone from his hand, and he began resisting again and refused to relinquish his phone. The officer pushed the subject's cuffed hands upward into the middle of his back to compromise his grip so that the other officer would be able to remove the phone from his hands. After the phone was removed, the subject attempted to turn around on the officer, and the officer directed him back toward his car and told him not to do that again. Upon approaching the vehicle, the subject exited the driver's seat and refused the officer's commands to return to and get back in the vehicle. After multiple commands for him to do so and him refusing, the officer commanded he put his hands behind his back, and for a moment he complied before turning toward the officer and pulling away on multiple occasions. The subject refused to get back in his vehicle on multiple occasions but did so eventually. He then began to force his way out of the vehicle, pushing on the door as the officer held the door shut while waiting for additional officers to effectively make and arrest. The subject eventually exited the vehicle as the two passengers ran from the vehicle. The officer provided multiple commands for the subject to put hands behind his back, but he turned towards the officer and pulled away. The officer provided a verbal warning and proceeded to deploy pepper spray on his face. The first deployment appeared to be ineffective as he still passively resisted to turn and put his hands behind his back. The officer then deployed it a third time, at which point he began to run from the officer, who gave chase and tripped him, causing him to fall to the ground in a prone position. The officer used the airhom on the patrol car to try to get the subject's attention so that he might choose to walk away. The subject continued to argue. The officer briefly activated the siren on the patrol car, and the door staff tried to point out to the subject that the police were there, but he continued. The door staff tried to back into the bar and pull the door closed and the subject started grabbing and pulling hard on the handle. Another person pulled the subject away and he resisted the other person. The officer got out of the car and walked towards the subject and the other man. The officer told the subject that he was under arrest and told the man in the blue coat to step back. The officer took control of the subject's right wrist and told him to put his hands behind his back. The officer placed a handcuff on the subject's right wrist, but he pulled his left arm in front of him and tried to pull and twist away. The officer gave additional verbal commands, but the subject did not comply. While this was occurring, the other man was standing very close, and several people came out from another bar and were very close. The officer grabbed the subject by the shoulder and pulled him to the ground. Once on the ground, the subject pulled his right hand under his body. The subject responded by swatting at and hitting Officer I's right hand. The subject told Officer 1 he did not have to back up, as the arrestee in question was his cousin. Officer I began addressing other bystanders when the subject approached Officer 1 again. Officer I told the subject he was liable to be arrested for Interference With Official Acts and Public Intoxication, Officer I offered the subject several chances to walk away. The subject said he would like to walk away, but that he was going to remain on scene until he knew what was going to happen to his cousin. Officer I told the subject that his cousin was going to jail. Because Officer I had still not determined the subject's role in the altercation, and based on his intoxication and the fact that he assaulted Officer 1, Officer 1 told the subject to produce his identification. The subject said "no, no sir" and widened his stance to make it harder for Officer 1 to move him. Officer 1 pulled the subject inward, and he responded by grabbing onto one of Officer l's wrists and trying to break Officer l's grasp. Officer 1 told the subject he was under arrest and pushed him toward the bar, attempting to drag him to the ground by his coat sleeve, but the shell of the coat tore in the process and Officer 1 ended up on the ground next to him. Officer 2 arrived to assist, and they each ended up grabbing one of the subject's arms to attempt to effect the arrest. The subject responded by locking his arms at the elbows with his palms on the ground. Officer 2 placed a knee on the lower half of the subject's body and pulled his left arm out from underneath his body and held his wrist, pinning it to his lower back so Officer 1 could place him in handcuffs. The other bystanders became increasingly vocal and hostile, so in an attempt to more quickly complete the arrest, Officer 1 sprayed the subject in the face with pepper spray. After this, and with the assistance of a door attendant firm the bar, Officers I and 2 were able to secure the suspect in handcuffs. While walking the subject to the patrol car, he dug his feet in the ground and refused to walk while saying he needed his hat and cell phone. Jeffrey Fink RE: December 2023 Use of Force Review DATE: January 31, 2024 The Iowa City Police Department policy requires an employee to complete a written report for any reportable use of force. Reportable use of force is defined in the Department's Lexipol Policy 300, which is titled Use of Force and available for public viewing on the department's website. This policy provides employees with guidelines on the use of deadly and non -deadly force. Upon receipt of the report, the supervisor is responsible for completing an administrative critique of the force. This process includes interviews with involved employees, body worn and in -car camera review, review of any additional available video, and review of written reports. The employee's use of force report and the supervisor's critique is then forwarded to the Captain of Field Operations and the Chief of Police for final review and critique. On a monthly basis, the previous month's use of force reports and supervisor critiques are reviewed by an administrative review committee consisting of a minimum of three sworn personnel. This Use of Force Committee consists of two supervisors as designated by the Chief of Police and one officer, typically a certified use of force instructor. The Use of Force Review Committee met on January 31, 2024. It was composed of Lt. Fink, Sgt. Cash, and Officer Arcenas. For the review of submitted reports in December 2023, the Review Committee documented the following: • 44 individual officers were involved in 22 separate incidents requiring use of force. • There were no documented cases of an officer exercising his/her duty to intervene and the review of the incidents did not indicate that an officer failed their duty to intervene. • Out of the 22 incidents involving the use of force, 16 involved force being used against 19 separate individuals. There were 6 animals euthanized by officers. • Out of the 44 officers involved in the 16 use of force incidents against people, 1 superficial injury was sustained by an officer, and 1 superficial injury was sustained by a suspect. • There were no violations of Department policy during this review period. • Out of the 19 use of force incidents against people, arrests were made 16 times (84.2%). • Mental health was identified by officers as being a factor in 4 of the 16 incidents involving the use of force against persons (25%). • Drugs and/or alcohol was identified by officers as being a factor in 8 of the 16 incidents involving the use of force against persons (50%). • Out of the 19 times force was used on persons, 2 were identified as white females (10.5%), 3 were identified as white males (15.8%), 10 were identified as black males (52.6%), 2 were identified as black females (10.5%), and 2 were identified as Hispanic males (10.5%). • Out of the 19 uses of force incidents against people, the average number of officers involved in the force was 2.32. • In total during this time, the ICPD had 4308 calls for service with 16 calls for service resulting in force being used on persons (.37%). The officer informed the subject that she was under arrest for disorderly conducted and ordered her to place her hands behind her back. The subject refused to comply and sat on a table. The officer ordered her again to place her hands behind her back. The subject got off of the table but pulled away from Officers 1 and 2 when Officer 1 tried to place handcuffs on her. The subject tensed up and would not relax her arms, so Officer 1 grabbed both of her arms, placed a foot in front of her foot, and gently nudged her to the ground. Officer 1 placed her left arm behind her back. The subject had her right arm pinned underneath her chest and would not move. Officer 2 gave multiple orders to have her relax her arm so he could place it behind her back, but she did not comply. The officer momentarily lost sight of the subject before locating him stumbling across a street. The subject was not able to keep his feet underneath him and continued to trip and fall down. The officer continued chasing the subject northbound where he fell down in a driveway. The officer then jumped on top of the subject and secured his arms. The subject was wearing a sling style bag that are commonly used to carry drugs or firearms. An assisting officer took hold of the subject's left side, and he responded by pushing or palm -striking the assisting officer with his right hand. Based on the subject's history of resisting arrest, his agitated and hostile demeanor in this incident, and his statements that he intended to fight, the officer grabbed the subject by the left arm, placed a leg behind his legs, a hand on his upper torso, and then pushed him backward while sweeping his legs from under him. The subject landed flat on his back and it seemed he got the wind knocked out of him; he was handcuffed by the assisting officer without further incident. The subject then refused to sit in the patrol car, and the officer had to push him into the back seat, resulting in the subject lying across the bench seat with his head toward the driver side. The subject was pulled across the bench seat by his shoulder so the back doors could be closed. The officers made contact with her as she continued to make unpredictable movements, speak to herself, and move towards others. She continued to be disruptive and was provided numerous opportunities to leave for the evening, refusing to do so. The officers approached the subject as she refused to leave. They each took hold of a wrist to place her in handcuffs while she refused to comply, tensing up, pulling away, and refusing to place her hands behind her back. As she continued to pull away and refuse to comply, the officers took her to the ground. Officer 1 held her right wristif arm and proceeded to sweep her right leg as Officer 2 picked her up by her left leg, all while pushing her to the ground. Officer I went to the west end of the alley where and located Officer 2 affecting the arrest of a male on the ground. In front of Officer 2 was an individual lying supine on the ground; he appeared to be unconscious. Officer 2 pointed to a college -age individual who was fleeing to the east and directed Officer 1 to apprehend him. Based on the scene and Officer 2's direction, Officer 1 believed that the fleeing individual had assaulted the subject on the ground, so Officer 1 drew their laser and pointed it at the subject, ordering him to lie down on the ground. The subject took off running to the east and Officer 1 pursued him on foot. Based on his apparent involvement in the fight resulting in a person being assaulted to the point of unconsciousness and his flight from uniformed officers, Officer I deployed the Taser at the subject's back. The first cartridge was ineffective, so Officer I deployed the second cartridge, which was also ineffective. Officer 1 turned the Taser off part way through the second cartridge deployment and holstered the device. Officer 1 holstered the taser and continued chasing the suspect until Officer 3 cut him off just past another bar, causing the subject to fall to the ground, kicking Officer 3 in the groin in the process. Officers 3 and 4 were attempting to take the suspect into custody, but he stood up and Officer 1 grabbed onto his left arm/shoulder. Officer 4 swept the subject's legs out from under him, taking him to the ground in a prone position. On the ground, the subject continued to resist by holding his arms under his chest. Officer 1 warned the subject he was going to be sprayed with pepper spray but did not deploy it because the subject ultimately relented and was handcuffed by Officers 3 and 4. On scene the officer observed the subject pushing subjects and he was pointed out by bar staff as one of the primary instigators. The officer approached the subject and made eye contact before giving him a verbal command to come to approach the officer. The subject did not comply and turned and ran southwest through the alley. The officer pursued on foot for about 20 feet until the subject ran into a female bystander resulting in him being slowed. The officer grabbed the subject around the waist and drove through his center of mass with bodyweight, tackling him to the ground. Upon reaching the ground the officer centered their torso over the subject's torso to hold him down as he tried to break free and get up. The officer gave verbal commands for the subject to give up his hands, but he did not comply. The officer used an arm to apply a chicken wing armbar to the subject's right arm and pull his right hand behind his back. The officer then used the other arm to perform the same tactic on the subject's left arm, resulting in both his hands being secured behind his back. The officer attempted to handcuff the subject but accidentally applied both cuffs on the subject's left wrist. The officer had to obtain a second set of handcuffs from the left cargo pocket and link them through the first set to secure the subject in handcuffs. During this process the subject continued tryn to pull his hands free and stand up until both wrists were secured in handcuffs. Officer 1 grabbed the subject's left arm and continued to give verbal commands to exit the vehicle. The subject said "no" several times. Maintaining a grip on the subject's left arm, Officer I attempted to pull him from the vehicle, but he grabbed onto the steering wheel in front of him and refused to let go. Officers 1 and 2 secured the subject's left arm out of the car in an armbar position; Officer 1 grabbed the subject by his right wrist and began to pull him from the vehicle. Officer 1 used a hand to grab him by the shirt collar, pulling him from the vehicle. Once out of the vehicle the subject continued to pull away from officers and tense up, refusing officers' attempts to place him into handcuffs behind his back. Officer 1 secured the subject's right arm in an armbar position as Officer 3 held his left arm, and they proceeded to escort the subject to the front of a squad car, giving him instructions to stop tensing up. The subject continued to tense up and attempt to pull away from officers. Officer 1 pulled out pepper spray and advised the subject he was going to get sprayed in an attempt to gain compliance. Officer 1 delivered a short burst across the subject's eyes and mouth. Officer 1 received spray to the left eye and continued to hold the subject against the squad car. The subject continued to tense up and not place his hands behind his back. Officer I wrapped both anus around hire and lifted him off his feet, placing him onto the ground. Once on the ground Officer I advised the subject to place his hands behind his back and advised he was under arrest. Officer I used a knuckle and placed it under the subject's chin to place pressure on the mandible pressure point to try and gain compliance. Officer I then used a hand to push the subject's chin away from officers in an attempt to roll him to his stomach and get his hands behind his back. Officers 2 and 3 were able to secure the subject into handcuffs behind his back.
