NEW BUSINESS Legislative bill to eliminate police review boards — SF2325 (now dead): Commissioner Townsend asked what happened that caused someone to want to eliminate police review boards. Commissioner Remington responded by saying that it was the State Legislature who was looking at the possible elimination of the review boards. Remington stated that she has had some meetings with the Racial Justice Group of the Iowa Citizens for Community Improvement (CCI). This group has been pushing to create a community police review board in Des Moines. Remington guessed that this might be where the push to eliminate review boards came from. The following individual appeared: Dean Abel spoke to concerns that he had about legislation that would abolish the police review boards. Abel is also concerned that the State Legislature is trying to take over local government activities by telling cities what they can and can't have in their charters. Abel mentioned talking about this issue at the Charter Review Commission meeting. Abel then asked if the board did anything about it, such as write a letter. Remington noted that the board did receive an email from the City regarding how to respond to questions asked by reporters. Remington also mentioned that in her four years with the review board, the board has never done any legislative action or commentary. Remington stated that she has done some legislation on her own but not as part of the board, and she would like to see more legislative action taken by the board. BOARD INFORMATION DRAFT Legal Counsel Ford suggested that the board discuss the wording used in the online complaint forms, and perhaps change the words so it's specific to the Iowa City Police. Ford noted that there have been a lot more complaints from outside the jurisdiction. Police Chief Liston mentioned that the form had been revised a couple of years ago so that the first question asked is if the complaint involves an officer of the Iowa City Police. BOARD'S RESPONSIBILITY: Under the City Code of the City of Iowa City, the Board's responsibilities are as follows: 1. The Board forwards all complaints to the Police Chief, who completes an investigation. (Iowa City Code Section 8-8-7(A). 2. When the Board receives the Police Chiefs report, the Board must select one or more of the following levels of review, in accordance with Iowa City Code Section 8-8-7(B)(1): a. On the record with no additional investigation. b. Interview /meet with complainant. c. Interview /meet with named officer(s) and other officers. d. Request additional investigation by the police chief, or request police assistance in the board's own investigation. e. Perform its own investigation with the authority to subpoena witnesses. f. Hire independent investigators. 3. In reviewing the Police Chiefs report, the Board must apply a "reasonable basis" standard of review. This means that the Board must give deference to the Police Chiefs report, because of the Police Chief's professional expertise. (Iowa City Code Section 13-8-7(13)(2)). According to Iowa City Code Section 8-8-7(B)(2), the Board may issue a report that disagrees with the decision set forth in the Police Chiefs or City Manager's report only if: a. The findings are not supported by substantial evidence; or b. The findings are unreasonable, arbitrary or capricious; or c. The findings are contrary to a police department policy or practice, or any federal, state or local law. 5. When the Board has completed its review of the Police Chiefs report, the Board issues a public report to the city council. The public report must include: (1) detailed findings of fact; and (2) a clearly articulated conclusion explaining why and the extent to which the complaint is either "sustained" or "not sustained ". (Iowa City Code Section 8-8-7(B)(6)). 6. Even if the Board finds that the complaint is sustained, the Board has no authority to discipline the officer involved. BOARD'S PROCEDURE The Complaint was initiated by the Complainant on December 20, 2023. As required by Section 8-8-5(B) of the City Code, the Complaint was referred to the Chief of Police for investigation. The Chiefs Report was filed with the City Clerk on February 23, 2024. As per Section 8-8-6(D) of the City Code, the Complainant was given the opportunity to respond to the Chiefs report. The complainant did not respond. The Board voted on April 9, 2024 to apply the following Level of Review to the Chiefs Report: On the record with no additional investigation, pursuant to Iowa City Code Section 8-8-7(B)(1)(a). The Board met to consider the Report on April 9, 2024 and May 14, 2024. Prior to the April 9, 2024 meeting, the Board had the opportunity to review the complaint, the Police Chief's report, and to watch and listen to body worn camera and/or in -car camera footage showing the interaction between the officers and the complainant. FINDINGS OF FACT: No specific incident was mentioned in the complaint of a lack of professionalism and respect involving the Iowa City Police Department (ICPD) however the month of October of 2023 was mentioned. The Iowa City Police Department (ICPD) had 8 contacts with the Complainant during the month of October 2023. Many of these contacts involved civil issues, over which law enforcement has no authority. Attempts to obtain further information from the Complainant, were unsuccessful. FILED MAY 14 2024 City Clerk Iowa City, Iowa COMPLAINANT'S ALLEGATION 01 — Violation of 320.5.9 • Conduct Discourteous, disrespectful or discriminatory treatment of any member of the public, or any member of this department or the City_ Chief's conclusion: Not sustained Board's conclusion: Not sustained Basis for the Board's conclusion: The Complainant alleges that they had an unfortunate encounter with a member of the Iowa City Police Department. No specific incident was mentioned and no details were provided, although the month of October 2023 was mentioned in the complaint. A review of the 8 contacts ICPD had with the Complainant in the month of October 2023 showed no incidents of inappropriate behavior being observed. Many of these contacts involved civil issues, over which law enforcement has no authority. Officers of ICPD have shown patience and often encouraged the Complainant to take advantages of resources in the community. Although the complainant is under the age of 21, he argued that he had the right to purchase the alcohol due to a religious exemption. The store clerk asked the police officer to explain to the complainant why he could not purchase the alcohol. DATED: May 14, 2024 FILED MAY 14 2024 City Clerk Iowa City, Iowa FILED Iowa City Police Department MAY 14 2024 Policy Manual City Clerk Iowa City, Iowa Major Incident Notification 330.1 PURPOSE AND SCOPE The purpose of this policy is to provide guidance to members of the Iowa City Police Department in determining when, how and to whom notification of major incidents should be made. 330.2 POLICY The Iowa City Police Department recognizes that certain incidents should be brought to the attention of supervisors or other specified personnel of this department to facilitate the coordination of activities and ensure that inquiries from the media and the public may be properly addressed. 330.3 CRITERIA FOR NOTIFICATION Most situations where the media show a strong interest are also of interest to the Chief of Police, the affected Division Commander and the City. The following list of incident types is provided as a guide for notification and is not intended to be all-inclusive: • Officer -involved shooting, whether on- or off -duty (see the Officer -Involved Shootings and Deaths Policy for special notification) • Homicides, suspicious deaths or deaths related to law enforcement activity • Crimes of unusual violence or circumstances that may include hostages, barricaded persons, home invasions, armed robbery or sexual assaults At -risk missing children or endangered missing adults In -custody deaths • Aircraft, train, boat or other transportation accidents with major damage and/or injury or death • Traffic accidents with fatalities or severe injuries • Death of a prominent Iowa City official • Significant injury or death to a member of the Department, whether on- or off -duty • Arrest of a member of the Department or prominent Iowa City official • Equipment failures, utility failures and incidents that may affect staffing orpose a threat to basic police services • Any other incident that has attracted or is likely to attract significant media attention 330.4 ON -DUTY SUPERVISOR RESPONSIBILITIES The on -duty supervisor is responsible for making the appropriate notifications. Notification should be made by using the call matrix in the All Hazards Plan.. 330.4.1 COMMAND STAFF NOTIFICATION In the event an incident occurs as identified in the Criteria for Notification section above the Captain of Field Operatoins shall be notified. The Invetigations Division Commander shall also be notified if that section is affected. The Captain of Field Operations shall notify the Chief of Police.. 330.4.2 INVESTIGATOR NOTIFICATION If the incident requires that an investigator respond from home, the on -duty supervisor shall be notified, who will then contact the appropriate investigator. 330.4.3 PATROL NOTIFICATION In the event of a major injury or traffic fatality, the on -duty supervisor shall be notified, who will then contact the appropriate investigator. The on -duty supervisor will notify the Captain of Field Operations. 330.4.4 PUBLIC INFORMATION OFFICER After members of the command staff have been notified, the Public Information Officer shall be called if it appears the media may have a significant interest in the incident. Some causes of death may not be readily apparent and some cases differ substantially from what they appear to be initially. The thoroughness of death investigations and use of appropriate resources and evidence gathering techniques is critical. 331.2 POLICY It is the policy of the Iowa City Police Department to respond, document and investigate incidents where a person is deceased. Investigations involving the death of a person, including those from natural causes, accidents, workplace incidents, suicide and homicide, shall be initiated, conducted and properly documented. 331.3 INVESTIGATION CONSIDERATIONS Emergency medical services shall be called in all suspected death cases unless death is obvious (e.g., decapitated, decomposed). For unattended deaths, the on -scene supervisor should notify the Investigation Division Commander, who will then determine whether an investigator will respond. The on -scene supervisor will make notification to command staff in accordance with the Major Incident Notification Policy. 331.3.1 REPORTING All incidents involving a death shall be documented on the appropriate form. 331.3.2 MEDICAL EXAMINER REQUEST Officers are not authorized to pronounce death. The Medical Examiner shall be called in all sudden or unexpected deaths or deaths due to other than natural causes. State law requires that the Medical Examiner be notified in any of the following cases (Iowa Code § 331.802): (a) A violent death, including homicide, suicide or accidental death (b) A death caused by thermal, chemical, electrical or radiation injury (c) A death caused by criminal abortion or by sexual abuse (d) A death that may be the result of a contagious disease and there is a possible public health risk (a) A death that has occurred unexpectedly or from an unexplained cause (f) A death of a person confined in a prison, jail or correctional institution (g) A death of a terminally ill person unattended by a physician within the preceding 30 days Copyright Lezipol, LLC 2023112/15, M Rights Reservetl '**DRAFT"' Death Investigation - 1 Published with permission by Iowa City Police Department FILED Iowa City Police Department MAY 14 2024 Policy Manual City Clerk Death Investigation Iowa City, Iowa (h) A death where the victim is unclaimed or unidentified (i) A death of a child under the age of two years from sudden infant death 331.3.3 SEARCHING DEAD BODIES (a) The Medical Examiner, his/her assistant and authorized investigators are generally the only persons permitted to move, handle or search a dead body. (b) An officer may make a reasonable search of an individual who it is reasonable to believe is dead, or near death, for the purpose of identification or for information identifying the individual as an anatomical donor. If a donor document is located, the Medical Examiner or his/her assistant shall be promptly notified. (c) The Medical Examiner, with the permission of the Department, may take property, objects or articles found on the deceased or in the immediate vicinity of the deceased that may be necessary for conducting an investigation to determine the identity of the deceased or the cause or manner of death. (d) Should exigent circumstances indicate to an officer that any other search of a known dead body is warranted prior to the arrival of the Medical Examiner or his/her assistant, the investigating officer should first obtain verbal consent from the Medical Examiner or his/her assistant when practicable. (a) Whenever reasonably possible, a witness, preferably a relative to the deceased or a member of the household, should be requested to remain nearby the scene and available to the officer pending the arrival of the Medical Examineror his/her assistant. The name and address of this person shall be included in the narrative of the death report. (f) All items removed by anyone from the body of the deceased shall be documented and a receipting included in the report. 331.3.4 SUSPECTED HOMICIDE If the initially assigned officer suspects that the death involves a homicide or other suspicious circumstances, the officer shall take steps to protect the scene. The Investigation Section shall be notified to determine the possible need for an investigator to respond to the scene. Domestic violence includes, but is not limited to: physical violence, injury, or intimidation; sexual violence or abuse; emotional and/or psychological intimidation; verbal abuse; threats; harassment; stalking; or economic abuse and control. Dating violence is any such domestic violence that occurs in an intimate or dating relationship. Sexual Misconduct: Sexual misconduct includes a range of behaviors, including but not limited to: sexual harassment; a completed nonconsensual sex act (i.e., rape); an attempted nonconsensual sex act; abusive sexual contact (i.e., unwanted touching); and noncontact sexual abuse (e.g., threatened sexual violence, exhibitionism, verbal harassment). An employee is considered to be in the workplace while in, or utilizing the resources of the employer, including but not limited to facilities, work sites, equipment, or vehicles, or while on work -related travel. Reportable use of force is defined in the Department's policy 300, which is titled Use of Force and available for public viewing on the department's website. This policy provides employees with guidelines on the use of deadly and non -deadly force. Upon receipt of the report, the supervisor is responsible for completing an administrative critique of the force. This process includes interviews with involved employees, body worn and in -car camera review, review of any additional available video, and review of written reports. The employee's use of force report and the supervisor's critique is then forwarded to the Captain of Field Operations and the Chief of Police for final review and critique. On a monthly basis, the previous month's use of force reports and supervisor critiques are reviewed by an administrative review committee consisting of a minimum of three swom personnel. This Use of Force Committee consists of two supervisors as designated by the Chief of Police and one officer, typically a certified use of force instructor. The Use of Force Review Committee met on February 26, 2024. It was composed of Lt. Fink, Sgt. Frank, and Officer Areenas. For the review of submitted reports in January 2024, the Review Committee documented the following: • 24 individual officers were involved in 12 separate incidents requiring use of force. • There were no documented cases of an officer exercising his/her duty to intervene and the review of the incidents did not indicate that an officer failed their duty to intervene. • Out of the 12 use of force incidents, 9 involved force being used against I 1 different people. Officer 2 reached behind the subject in attempt to get his phone and he proceeded to push Officer 2 back. The officers continued to order the subject to give them his phone, but he continued to ignore their order by tensing up his arms and pulling away. Officer 2 was eventually able to get the subject's phone out of his hand and place it on a table. Officer 2 then proceeded to pull the subject out of the booth he was seated at and force his hands behind his back, handcuffing him. Officer 1 grabbed the subject by the right forearm to pull him out of the booth. The subject was turned over to another officer and transported to the Iowa City Police Department. Officer 1 conducted a high -risk traffic stop on the vehicle based on knowledge of the subject's history. The driver was called out by Officer 2 and secured without incident. Officer I called the subject out and Officer 3 secured him. During the call -out, Officer 2 had their handgun displayed, but not pointed at the occupants. Officer 1 had a patrol rifle deployed, also not pointed at the occupants. Once the occupants were secured, Officer 2 deployed the shield from a patrol car and they cleared the vehicle. On arrival, Officer 1 observed the subject shirtless, bleeding, and verbally arguing with another individual. After initially leaving, the other individual returned and started arguing again with the subject, who had his eyes trained on the other individual and was verbally threatening him. The subject got into a staggered fighting stance, with visibly tensed muscles, with his eyes still targeted on the other individual. Officer I retrieved pepper spray and gave a verbal threat to spray both individuals. When Officer 1 began counting down from three, the other individual retreated and left the argument. The subject made a move to follow him and was still displaying physical signs of agitation. Officer 1 sprayed the subject across his face as he refused to disengage from the fight. Officer I observed Officer 2 put their Taser laser sight on the subject and give him verbal commands to get onto the ground. After the subject got onto his stomach, he was placed into handcuffs. The neighbor advised dispatch that she saw the subject enter the garage. The subject had an active felony domestic arrest warrant. Officers also had prior information that the subject was in possession of a stolen firearm. The subject is a convicted felon from prior robbery and burglary convictions and is prohibited from possessing firearms. Officers attempted to call the subject out of the garage and he did not come out. Officers opened the garage door and deployed a robot into the garage. As soon as the robot was deployed into the garage, they heard the subject say, "I'm coming out." Officers backed up and gave the subject room to exit the garage. Due to not knowing if the subject was armed, two officers had a shield. Two other officers had less lethal 40mm launchers. The subject came out of the garage and the officer pointed a rifle and another officer pointed a handgun at the subject, who complied and was placed into handcuffs by officers. Officer 2 went to detain the subject, and when he was told to place his hands behind his back, he jumped back and took a fighting stance against officers. Officer 1 drew their laser, activated it, and pointed it at the subject. Officer 1 gave multiple arders to mrtt around and place his hands behind his back. Officers 2 and 3 also pointed their lasers at the subject, at which time Officer I holstered their laser and placed the subject into handcuffs. Officer I then started to walk the subject to the front door, at which time he started to demand a shirt. However, because he was already uncooperative and in handcuffs, Officer 1 told him no. His response to this was "Lets go then," and he started to flail, which caused him to slip and fall to the ground. Officer 1 was holding his left arm and held him so he did not fall to hurt himself: He continued to flail and was restrained on the ground until he calmed down. The subject was assisted to his feet, and he again escalated himself and started to demand a shirt. He started to pull away from Officer 1, who held control of his left arm and pushed him toward the front door. Officer I then pulled his arm to guide him to the front door, and when they reached the area of the front door, the subject put his left fool on the counter to stop himself from going outside. He kept repeating "Lets go" and then he said "laze me then bitch ass ###," and then he head -butted Officer 1 in the lower jaw. After he hit Officer 1 in the face, Officer I lifted up on his left arm and then kicked his feet from under him, causing him to fall. Officer 2 told the subject multiple times to stop resisting. There was not much room in the apartment and there were multiple objects on the floor. When the subject continued tensing up and refused to put his hands behind his back, Officer 1 put their right foot/leg in front of his to trip him to the ground. Officer 1 started to lose footing as while attempting to avoid landing on the subject. Officer 1 then gave multiple warnings to the subject that he was going to get pepper sprayed if he did not stop resisting. The subject backed himself into a comer in between the sliding glass door and the south wall of the apat to nt. Officer 1 sprayed the subject in the face with pepper spray and was then able to put the subject's left arm behind his back and place him in handcuffs. The subject was placed outside sitting on the sidewalk, slipped his cuffs, and started fighting with Officer 2. Officer 1 went over to the subject and put a knee on his side. There was a light pole that the officer was able to pin him against. He quit attempting to run. By that time another officer was there and controlled his right arm. Jeffrey Fink RE: February 2024 Use of Force Review DATE: March 15, 2024 The Iowa City Police Department policy requires an employee to complete a written report for any reportable use of force. Reportable use of force is defined in the Department's policy 300, which is titled Use of Force and available for public viewing on the department's website. This policy provides employees with guidelines on the use of deadly and non -deadly force. Upon receipt of the report, the supervisor is responsible for completing an administrative critique of the force. This process includes interviews with involved employees, body worn and in -car camera review, review of any additional available video, and review of written reports. The employee's use of force report and the supervisor's critique is then forwarded to the Captain of Field Operations and the Chief of Police for final review and critique. On a monthly basis, the previous month's use of force reports and supervisor critiques are reviewed by an administrative review committee consisting of a minimum of three sworn personnel. This Use of Force Committee consists of two supervisors as designated by the Chief of Police and one officer, typically a certified use of force instructor. The Use of Force Review Committee met on March 15, 2024. It was composed of Lt. Fink, Sgt. Rich, and Officer McNamee. For the review of submitted reports in February 2024, the Review Committee documented the following: • 43 individual officers were involved in 22 separate incidents requiring use of force. • There were no documented cases of an officer exercising his/her duty to intervene and the review of the incidents did not indicate that an officer failed their duty to intervene. • Out of the 22 use of force incidents, 18 involved force being used against 20 different people. Officers 2 and 3 both arrived on scene to assist. Officers were directed to a bed in the northeast comer of the room and made contact with the subject, who was very worked up, yelling at officers, and would go from a standing position to sitting down on her bed. Officers switched off and on speaking with the subject and attempted to have her walk slowly towards them. The subject continued to yell and act very erratic and told officers multiple times she did not have a knife on her. Officer 1 kept the 40mm at a low ready, while the subject continued to argue with officers. Officer 3 pulled out his laser and pointed it at the subject, who at this time kneeled and placed her hands on the north wall. Officers 2 and 3 began to approach the subject from the left side to take her into custody. Officer 1 went around a bed directly behind the subject to provide cover with the 40mm. The officer turned around, followed the subject, and observed a hammer in his back left pocket. The subject continued to drive into oncoming traffic and eventually rode into a parking lot ATM area. The officer drove up beside the subject and positioned the squad car in front of his path so that he would be forced to stop. When the officer stopped the patrol car, the subject struck the rear driver's side with his bicycle. The officer immediately exited the patrol vehicle and observed the subject standing upright next to his bicycle. The officer was now in very close proximity to the subject and was concerned that he may reach for the hammer in his back pocket. The subject was immediately confrontational and demanded to know the officer's name. The officer asked the subject for his name because he was riding his bike in the wrong lane of traffic without any lights in the middle of the night. The subject refused to identify himself and was wielding an edged weapon in his hand. The officer ordered him to drop the weapon, and he did not comply. The officer drew their handgun and again ordered him to drop the weapon, but he instead put it in his pocket where it was easily accessible to him. The officer ordered the subject to get on his stomach, and he said, " I'm not getting on my stomach". Another officer bad their handgun drawn and second backup officer had a Laser deployed. The backup officers stayed with the subject while the primary officer went to grab the 40mm less lethal launcher. The subject did not comply, and his hands were pulled out and put behind his back by Officers 2 and 3. Officer 1 then assisted in rolling him over and standing him up to complete the arrest, but his demeanor worsened and he began slamming his head on the wall. Identifying the behavior as a possible excited delirium event, officers agreed the subject needed immediate medical intervention. The officer lowered the subject back down to the floor and did their best to hold him still as he continued to attempt self -harm by slamming his head on the floor. Officer 2 held the subject's legs while Officer 3 placed an arm in front of the subject's face so he would not be able to strike his head against the glass. Officer 1 grabbed his right wrist and pulled it behind his back to handcuff him, but he pulled his arm in front of him and began screaming. After not being able to make contact with either resident, Officer 1 forcefully kicked in the door with their duty weapon drawn. The subject then lowered his right hand and put it in his pocket. At this time, Officer 3 deployed one round of 40MM, which was very effective. Officers went over towards the subject and placed him into handcuffs. An ambulance was immediately requested to come to the scene to provide aid to the subject, who was placed under arrest and evaluated by EMS for his iniury to his left leg from the 40MM round. The subject was provided time to talk to the female on scene and smoke a cigarette in attempt to gain compliance, without success. The subject had lowered himself into a crouched position with his arms in front of him and back against the wall. He was informed again that he was under arrest. Officer 1 informed the subject to turn around and repeated for him to put his hands behinds his back to be placed under arrest. The subject did not comply and flexed his arms across his chest. Officer 2 grabbed hold of the subject's right arm and hand to try to pry his fingers from the clasp. The subject pushed away from Officer 2. Officer 1 grabbed suspect's left wrist to try and force it behind his back, however, he continued to flex both arms in front of him, preventing Officer 1 from being able to move his arm for handcuffing. Officer 1 warned the subject several tines that he was going to be lased as Officers 3 and 4 had their lasers drawn. Officer 1 then grabbed the suspect's upper left bicep and repeated for the subject to put his hands behind his back, grabbing his left wrist but he continued to hold his arms in front of him, preventing Officer 1 from putting his arm behind his back for handcuffing. The subject continued to not follow directions. Officers I and 2 were unable to handcuff him. At one point the subject was lased by Officer 3, and the subject began aggressively swinging his left arm near Officer 1 and 3. The initial tser deployment was ineffective and the subject was lased again by Officer 3, however, this too seemed ineffective. Officers continued to struggle with getting the subject's arms behind his back for handcuffing. The subject indicated that he didn't care about the laser. Officer I attempted to grab his left arm as the subject continued to aggressively flail his left arm while Officer 2 had ahold of his right arm. Due to the initial two laser deployments being ineffective, the subject continuing to demonstrate violent behavior by swinging his arms and legs at officers, and not complying with repeated instructions to effect an arrest, Officer 1 deployed the taser in the front left torso/thigh area of the suspect. The subject yelled indicating the laser had some effect, and Officer 1 placed the taser on the subject's left thigh to provide an additional point of contact for the initial deployment. The subject then knocked the taser out of Officer 1's hand and underneath his chest as he was now partially down on his stomach. He then continued to flail his left arras and left leg and was unable to be handcuffed. Officer 1 then secured the taser from under him, activating the initially fired probes again Officer 1 then placed the laser on the left side of his torso for an additional contact point as it was still discharging. After the secondary activation, Officer 1 held the Laser to the back of the subject's left calf but did not provide an additional shock nor deploy the second set of probes. Officer 1 told him to put his hands behind his back or he was getting lased. The subject was now all the way on his stomach and Officer l helped hold his left wrist while officers were able to successfully handcuff him. After the incident. Officer 1 found the knuckle of their right index finger was cut open and actively bleeding. While enroute, the caller called again and advised the subject was still harassing customers. Upon arrival, Officer I entered the store and saw the clerk backing away from the subject. He appeared angry. Officer I asked the subject to step outside, and he did. Outside, Officer I asked the subject what was going on, and his answers were vague, saying they were acting stupid and "fucking" with him. While Officer 1 spoke with the subject, he repeatedly stepped into Officer 1's space, even after asking him to step back. Officer 1 noticed he was visibly angry, he kept clenching and unclenching his hands into fists, and glaring into Officer I's eyes. Based on the subject's behavior, Officer 1 felt that he was thinking about punching and, due to his size and demeanor, Officer 1 felt he was a threat to their safety. The subject responded with various things, including, "I hate fucking cops. I hate you and everybody," and again walked towards Office 1 while clenching his fists. Again, Officer I felt that he was thinking about punching. Officer 1 again told him to stay back and pulled out their taser while requesting other responding officers to step it up. Officer I told the subject he would be lased if he continued to approach. He said, "Go ahead and hit me." Officer 1 told the subject to sit on the ground and gestured towards the sidewalk next to the building. He did not sit, and when other responding officers arrived, he walked towards them, while carrying himself in the same way. With their arrival, the focus was taken off Officer 1 briefly, who felt he was thinking about punching the other officers. Officer I put a hand on his chest to keep him back, but he pushed Officer 1's hand away to continue to step towards other officers. Officer 1 lased hire. Officer 2 told the subject to turn around and to get on the ground, but he did not get on the ground, so Officer 2 grabbed his left arm and pulled hire towards the ground while sweeping his left leg. While on the ground the subject continued to resist officers getting his arms behind his back. He went to the ground and was placed in handcuffs by Officers 2 and 3 while Officer 1 held the laser for additional use if needed which it was not. They both left the area, and the officer found the female subject a couple of blocks north. The officer started asking the subject about what happened, and she got upset and started yelling. The subject tried walking away a few times, and the officer had to tell her she was not free to leave. The subject continued to try and walk away, and the officer told her she would be put in handcuffs if she continued to try and walk away. The subject walked backwards away from the officer into the street while a vehicle was coming, telling the officer not to touch her. The officer walked out into the street with the subject and was able to get her out of the street into the grass. The subject continued to walk away from the officer backwards. The officer went and grabbed the subject's left wrist and elbow. The subject used her right hand and hit the officer's chest and right arm to try and get the officer to let her go. The officer let go of the subject's left wrist and used and grabbed her right arm, using a leg sweep to take the subject to the ground. The officer controlled her descent to the ground so she would not get hurt. The subject fell on her back and continued to try and pull away from the officer. The subject rolled over to her left side and tried to get up. The officer got her up into a seated position and tried to keep her from rolling onto her stomach. The subject continued to try and pull away from the officer, but the officer was able to get her into handcuffs. The officer helped the subject to her feet and walked her to the squad car. When Officer 1 arrived on scene, the subject was standing outside. Officer 1 started speaking with the subject, who was very intoxicated. Officer 1 informed the subject he was under arrest for public intoxication and grabbed his right bicep. The subject tensed up and started to pull away. Officer 1 grabbed the subject and placed him in a bear hug, telling him to comply, or he would be taken to the ground. The subject calmed down for a second. Officer I loosened their grip around the subject, but he again started to pull away. At this point Officer 1 told the subject he was going to the ground. Officer 1 took the subject to the ground, at which point Officer 1 mounted his lower back Officer 1 grabbed the subject's left wrist and pinned his left shoulder down to keep him from rolling over. Officer 1 briefly had the subject's left hand behind his back, but he pulled his hand forward and tried to place it underneath him. Officer 1 was able to get a hand under his left arm and get ahold of his left wrist. Officer 2 gave the subject warnings to stop resisting and eventually sprayed the subject in the face with pepper spray. Jeffrey Fink RE: March 2024 Use of Force Review DATE: April 29, 2024 The Iowa City Police Department policy requires an employee to complete a written report for any reportable use of force. Reportable use of force is defined in the Department's policy 300, which is titled Use of Force and available for public viewing on the department's website. This policy provides employees with guidelines on the use of deadly and non -deadly force. Upon receipt of the report, the supervisor is responsible for completing an administrative critique of the force. This process includes interviews with involved employees, body worn and in -car camera review, review of any additional available video, and review of written reports. The employee's use of force report and the supervisor's critique is then forwarded to the Captain of Field Operations and the Chief of Police for final review and critique. On a monthly basis, the previous month's use of farce reports and supervisor critiques are reviewed by an administrative review committee consisting of a minimum of three sworn personnel. This Use of Force Committee consists of two supervisors as designated by the Chief of Police and one officer, typically a certified use of force instructor. The Use of Force Review Committee met on April 29, 2024. It was composed of Lt. Fink, Sgt. Frank, and Officer McNamee. For the review of submitted reports in March 2024, the Review Committee documented the following: • 40 individual officers were involved in 23 separate incidents requiring use of force. • There were no documented cases of an officer exercising his/her duty to intervene and the review of the incidents did not indicate that an officer failed their duty to intervene. • Out of the 23 use of force incidents, 21 involved force being used against 24 different people. There were 2 animals euthanized by officers. • Out of the 40 officers involved in the 21 use of force incidents involving people, no injuries were sustained by suspects or officers. • No violations of policy were noted during this review period. • Out of the 24 uses of force against people, arrests were made 20 times (83.3%). • Mental health was identified by officers as being a factor in 2 of the 21 use of force incidents involving persons (9.5%). • Drugs and/or alcohol was identified by officers as being a factor in 17 of the 21 use of force incidents involving persons (81%). • Out of the 24 times force was used on persons, 8 were identified as white males (33.30/6), 13 were identified as black males (54.2%), I was identified as a as a Latino male (4.20/.), and 2 were identified as white females (8.3%). • Out of the 21 uses of force incidents involving people, the average number of officers involved in the force was 1.90. • In total during this time, the ICPD had 4,812 calls for service with 21 calls for service resulting in force being used on persons (.44%). The officer approached the subject and asked to see the bottle. The subject was uncooperative and began to continuously demand a supervisor. The subject handed the bottle of liquor to his friend and into the hands of another officer. The subject still did not identify himself and the decision was made to arrest him. The officer grabbed the subject and handcuffed him. The subject was then escorted to the patrol vehicle. Thee subject continued to yell. The officer asked the suspect multiple times to get in the vehicle after opening the door. The suspect refused. The officer advised the suspect that he was going to be forced into the vehicle. The officer attempted to lower the suspect's head into the vehicle, and he continued to resist by using his head to push back while getting into the car. Officer 1 made contact with the subject, who had bloodshot watery eyes, slurred speech, and was having difficulty standing without swaying. The subject got agitated and started raising his voice at the officers when he saw more officers arriving on scene. Officer 1 asked him to calm down. The subject was not making sense with his words. The subject started to back away from Officer 1 and get agitated when he saw officers 2, 3, and 4 show up on scene. The subject started getting agitated again and stated "lets go" as if to fight the officers as he was backing away. Officer 1 told the subject to have a conversation, and he responded "Pm not going". Officer I told the subject to turn around and put his hands behind his back, which he did not do. The subject then started yelling at Officer 1, who asked him if he was going to identify himself and he yelled "I been identifying myself [........ ]". Officer I then asked him to calm down. The subject kept backing away from the officers, and Officer 1 told him to stop and to rum around and put his hands behind his back as he was under arrest. The subject did not mm around and put his hands behind his back; he kept walking backwards away from officers while facing them. Officers 2 and 3 grabbed both of the subject's arms and placed them behind his back. The subject attempted to pull away from them and was pulling his arms away. Officer 1 got handcuffs out and attempted to place them on his wrists as he was resisting. Officer 1 got one cuff onto his right wrist, and then he pulled his left wrist away. Officers were able to get his left wrist behind his back again, and Officer I was able to barely get the second cuff on his wrist. Officer I told the subject he was being arrested for public intoxication, and he started yelling violently that he wasn't publicly intoxicated. Officer 1 told him multiple times to stop resisting them. The subject then started thrashing his body, and officers had to assist him in walking towards the squad car, retraining him from kicking or headbutting them. Once at the squad car Officer 1 attempted to search the subject's person. While searching the subject he continued to violently thrash his body against officers. Officer 1 heard the subject start gathering spit inside his mouth, so Officer 1 moved behind him and saw him spit directly at the area where Officer 1 was searching him. While thrashing, the subject stated, "I will take you motherfuckers one by one." The subject then pushed off against officers again and put his weight towards the ground. At that time Officer 4 deployed pepper spray in the subject's face. The subject continued to thrash his body, kicking at officers and at an employee who was now trying to assist them. The subject was placed in the back of a squad car by Officers 2 and 3. The subject continued to resist officers while in the back of the squad car so Officer 3 had to assist in pulling the subiecl all the way into the back so that the doors could be shut. The officer announced they were the police and warned him several times that he was going to get Lased. At one point while running from the officer he faced the officer while appearing to hide behind a pillar. The officer was worried to enter into a grappling fight with the subject due to his size and history of resisting arrest. The officer ordered hum to get on the ground, but he continued to run. The officer continued to order him to stop and warned him that he would be Lased. He then went to enter a nearby restaurant with customers inside. The subject then suddenly sprung up and turned toward the officer. The officer was afraid he was going to grab the taser or assault them. The officer yelled stop three times and said he was going to get tased. He was facing the officer and not complying with lawful commands, so the officer lased him again.. He then went down. At that time a backup officer arrived and assisted with handcuffing. The subject was screaming, agitated, uncooperative, and refusing to go to the hospital. Once it was decided that the subject was going to go to the hospital involuntarily, Officer 1 grabbed the subject by his left am, at which time he pulled away. Officer 2 then observed Officer and the subject fall to the ground. Officer 2 then got down on the ground and grabbed the subject by his left arm and pulled it behind his back so Officer 1 could handcuff the subject. Once in handcuffs the officers stood the subject up and walked him over to the ambulance. He started walking but asked why he as arrested. After telling him why he was under arrest, he stopped walking and placed his feet in front of him to brace against forward movement while saying "no". Officers kept walking by pushing his anus as he pushed backwards for a handful of steps. He finally walked on his own after 5-10 feet. They got to the patrol car, and Officer 1 opened the door, telling the subject to have a seat and to put his left foot first, then sit down. He said "no" and "I don't really care" while his body got stiff, and he braced his feet on the ground. Officer 2 told him to sit in the car and he remained stiff and said "I'm about to walk". Officer I. told him to get in the car and pushed his upper body in the direction of the back seat. He kept his body in a standing position so when he was pushed, he fell vertical into the car and hit the side of his shoulder and head on the top of the car. He was able to sit on the seat and began complaining about his head. The subject tamed toward the officers and tried to get his feet under him to stand up. Officer 1 told him to sit in the car and he said "no" and continued on about how Officer 1 hit him in the head. He kept his upper body stiff and would not put his feet in the car. Officer 2 went to the other side and began pulling the subject into the back seat, but he kept his legs outside of the car while laying horizontal, refusing to put his feet in the car or sit upright. Once the subject was on the floor of the back seat, he kept his feet outside of the car and his body went limp, which made it difficult to lift him up. He wouldn't help the officer by putting his feet underneath him. Officer 1 grabbed onto his right arm and pulled him upward, removing him from the floor and up onto his feet on the outside of the car. Once the subject was standing and outside of the car, he stayed standing and refused to sit back down on his own. Officer 1 asked him "please" but he stayed standing and wouldn't sit down. Officer 1 had to again push him into the back set where he was on his left side partially on the floor and seat. Officer I got in front of the subject before he could get to Officer 2 and hooked the subject's left arm at the elbow. Once they were past the squad car door, Officer 3 grabbed the subject's left arm, but he would not let go of the bars on the squad car door. Officer 1 told the subject to let go of the door and pulled on his arm twice. The subject would not let go of the door, so Officer 1 had to pull with force to get his hand off the door. Officer 1 told the subject that if he kept resisting he would go to the ground. At that time the subject went limp and fell to the ground. Officers 2 and 3 tried to stand him up once he was in handcuffs. The subject made his legs go limp so the only thin holding him up was Officers 2 and 3. The subject eventually made their way inside of the mall where the teenager had been making attempts to distance himself The subject, still visibly upset and yelling, took off his jacket, throwing it to the ground and took a fighting stance as if to fight with the teenager. The officer walked over to the subject and advised he was under arrest. The subject dropped to his knees clenching his hands towards his chest. The officer pulled his right arm behind his back while he laid on his stomach. The subject attempted to pull his arms back under his body, but the officer maintained a grip using a right knee to place it on the subject's arm, preventing him from moving any further. The officer ran after the subject, commanded him to stop, and that he would be lased. The subject ignored these commands and continued running. As the subject was running, the officer observed him reaching for his waistband. The subject tripped in a mulch area. The subject jumped back up and started looking at the fence as if he was going to attempt to jump over it. The officer was eventually able to catch up to the subject, close enough to where the laser was believed to be effective. The officer deployed the first set of taser probes, which didn't achieve NMI as the subject continued to run. The officer continued pursuing the subject and shot the second set of probes. The subject tripped and fell down to the ground. As the officer approached him, he started to sit up and face toward the officer. At this time the officer wasn't sure if a backup officer was close by, if the subject actually had anything in his waist band, or if he was going to start fighting when the officer went down to the ground with him. The officer made connection with the laser (drive stunned) to the subject's upper body in an attempt to achieve NMI. After making contact with him with the laser, he immediately rolled over onto his stomach and put his hands behind his back The officer turned off the laser, straddled the subject and put weight on his lower backilegs. The officer placed the subject in handcuffs and asked him what he was doing. The officer assisted the subject to his feet and walked him back to the patrol vehicle. The subject was advised by officers to let go of his phone. The officers continued to tell the subject to let go of his phone and put his hands behind his back as requested. The subject was already in an excited state in which he was yelling at Officers on scene and saying they were harassing him. Officers had explained to him why they were out with him and he did not seem to care and continued to remain visibly upset throughout the entire confrontation. The officer secured the subject's left hand behind his back, but tensed his right arm up, moving it towards his chest with his cell phone in hand, not placing it behind his back. The officer attempted to pull the subject's right hand behind his back, and was met with resistance. The subject was pulling his arm away from the officer and not allowing it to be placed behind his back. With the subject being escalated, the officer did not want to risk a fight standing up. The officer swept the subject's feet from underneath of him, placing hire onto the ground. The subject landed on the ground, where the officer used a hand to control his head from popping back up. The subject's right arm was retrieved and placed behind his back. The officer was then able to secure the subject into handcuffs. The officer picked the subject to his feet and instructed him to walk to the squad car. While walking to the squad car the subject teased his arms up and attempted to lean his body weight back. The officer was able to keep the subject walking forward by guiding him with an arm. The subject came to a stop, and the officer advised him if he tensed up his body again a hand would be placed over his handcuff to escort him to the vehicle. The subject did not walk forward and advised officers to wait a minute. The officer used the subject's left hand and placed pressure on it over his handcuffs to get him to walk forward. The subject tried pulling away and, while Officer 1 controlled his left arm, and Officer 2 held his right arm as they assisted in moving him to the wall on the opposite side of the walkway. Officer 1 tried to leg sweep the subject, but it was unsuccessful. Against the new wall, Officer 1 warned the subject that he would be "sprayed" if he didn't comply. Officer I heard somebody verbalize that they should lower the subject to the ground, so Officer 1 attempted a leg sweep again. Officer I applied downward pressure to the subject's upper torso while conducting the sweep, assisted by Officer 2. The sweep and combined efforts were effective, and the subject was lowered into a prone position on the ground. Around the same time this was happening, a large group of the subject's friends began gathering around police on -scene and began heckling and causing a disturbance. Once the subject was on the ground, he continued his non-compliance and refused to cooperate. He had his left arm to his side and Officer 1 could feel that he was still tensing up and actively trying to pull his arm under his body. Thus, Officer 1 knelt on the subject's forearm with full body weight, effectively pinning his arm in place. Officer 1 maintained this position on the subject until it was time to handcuff his left hand. Once Officer 2 got his right hand behind his back and in handcuffs, Officer 1 released pressure and swiftly pulled the subject's left arm to the small of his back Once the subject was in handcuffs and detained, Officer 1 reached under his left arm and assisted in lifting him straight up and onto his feet. Officers 1 and 3 helped the subject stand up, and he pulled his arms away from them. Officer 3 put the subject's right arm into a wrist lock to prevent him from getting away. Officer I and 3 walked the subject to the squad car. The subject sat in the squad car with his feet outside of the squad car. Officer 3 told the subject to put his feet inside of the squad car and he said, "Hell no, you're going to have to move my feet in there." Since the subject was already not complying with police and was refusing a lawful order to get into the squad car, Officer 3 pushed the subject's chest with both hands and pushed him into the Squad car. When Officer 1 arrived on scene, officers from another agency were already on scene. Officer 1 was able to see the subject, and he began to flee north in the ped mall. Officer 1 initiated a foot pursuit and chased the subject, last seeing him heading east through the alley of the ped mall. When Officer 1 arrived at the alley, a witness pointed in the direction of a dead end, which led to the rear doors of a bar. There was a transformer and other objects blocking Officer 1's view. Since it was unknown if the subject had any weapons, and Officer I lost eyes on the subject who had reportedly assaulted someone prior to arrival, Officer 1 drew their laser and held the area secure until more officers arrived. An officer from another agency arrived on scene and also drew his laser. Officer I displayed the taser toward the center mass area of the subject's body and instructed him to put his hands up and get on the ground. The subject was screaming and slurring his words. It was apparent he was intoxicated and was not complying with commands. The other officer on scene then grabbed the subject's right arm, and he pulled away. Officer 1 then holstered the taser and grabbed the subject's left forearm and held on to it to control. Officer 2 then arrived on scene, and they assisted the subject to the ground. They placed the subject in handcuffs and placed him in the back of a patrol car. During a search, Officer 1 located a black bag that contained individually packed packages containing marijuana. Once located, Officer 1 walked over to the subject and told him to place his hands behind his back. The subject took off reining, so Officers 1 and 2 pursued on foot and attempted to grab his coat. Officer 1 kept losing grip on the subject while he was running as his coat was starting to come off, so Officer I pulled him down by his hair as Officer 2 had a hold of the back of his jacket and the left side of his body. Once the subject was on the ground, he complied and placed his hands behind his back. Officers 1 and 2 went over to the subject and told him he needed to leave or go to jail. The subject was intoxicated and said he was not leaving. After multiple orders for him to leave, Officer 1 went to place the subject under arrest by grabbing his left arm. The subject tried pushing the officers away, flexing his arms, and coming away. Officers 2 and 3 had a hold both of the subject's arms. Officer 2 eventually pushed the subject against a nearby table. Officer 1 let go of his arms and grabbed both of his legs and pulled him to the ground with assistance from Officers 2 and 3. Once on the ground, the subject wouldn't roll over, so Officer 1 slid their left arm under the subject's left leg and over his right leg with the assistance of Officer 3. Officer I pushed the subject's left leg and pulled his right leg in order to flatten his hips. Once the subject's hips were flat on the ground, Officer I sat on his hips to prevent him from standing up. Officer 1 then used an arm to hook his right arm to bring it behind his back, as Officers 2 and 3 assisted with pulling his arms out from under him. Officer l was able to handcuff and double lock the cuffs. The subject refused to stand up, so Officer 1 had to lift him and escort him to the patrol car. The officer did not want to give him the reason because he was standing in the line of people, in case there were more suspects from this assault in line. One male behind the subject motioned for him to go with the officer and told him to do so. The officer told the subject that they needed to speak with him again and told him to come to another area, away from the line. The officer reached out to grab the subject's arm and he pulled away. The officer reached out to grab the subject again and told him to turn around. The subject backed away from the officer and slapped their hands down. The officer told the subject that he was under arrest. The subject kept backing away from the officer and was pulling his arms away. Due to the subject already not listening to commands, physically pulling away, and the belief that he was going to try to run away, the officer wrapped both arms under the subject's arms and took him to the ground. The subject landed on his back and was rolled to his stomach. Another officer placed the subject into handcuffs with his hands behind his back. After being placed into custody, the Jail requested the subject be medically cleared for jail. While at the hospital, the subject began to refuse to walk on his own and the officer had to strongly grab ahold of his arm to direct him towards the triage room. While there, the subject continued to attempt to stand up and kick his legs, which caused the officer to place an arm diagonally across his chest and apply pressure in order to prevent him from moving while medical staff spoke with him and determined options. This occurred and it appeared at one point that the subject attempted to bite the officer, however the officer continued to hold him in place between a wall and his seat. Eventually he was physically assisted to chair for transport to a hospital room. While in the room, the subject attempted to kick his legs and sit up which caused the officer to physically hold his legs down to the bed at multiple points in order to prevent him from moving as hos ital staff administered medication.
