Notice is hereby given that a public hearing will be
held by the City Council of Iowa City, Iowa, at
which time the Council will consider:
A resolution to amend the

the City Council thereafter as posted by the City

Ordinance rezoning approximately 1.04 acres of land at 804, 810, and
824 Maiden Lane; 410, 416, and 418 E. Benton Street, and 815 Gilbert
Court from Intensive Commercial (CI-1) zone and Medium Density
Single -Family Residential (RS-8) zone to Community Commercial (CC-2)

Whereas, the Owners, Sheridan Family LLC, and Frank Simon, have requested the rezoning
of approximately 1.04 acres of land at 804, 810, 824 Maiden Lane; 410, 416, and 418 E. Benton
Street; and 815 Gilbert Court from Intensive Commercial (CI-1) zone, and Medium Density Single -
Family Residential (RS-8) zone to Community Commercial (CC-2) zone; and
Whereas, the Comprehensive Plan future land use map indicates that the subject area is
appropriate for Mixed Use; and
Whereas, a portion of the subject property is located within the Gilbert Subdistrict of the
Downtown & Riverfront Crossings Master Plan which envisions this area "designed to be a
defining feature of this creative neighborhood", and includes objectives to maintain the informal
and eclectic character of the neighborhood, and in terms of development character notes
maintaining smaller -scale and lower intensity of use, promoting a variety of fors and materials,
and the creative and adaptive use of existing structures; and
Whereas, the Planning and Zoning Commission has reviewed the proposed rezoning and has
recommended approval.
Now, therefore, be it ordained by the City Council of the City of Iowa City, Iowa:
Section I Approval. Property described below is hereby reclassified Commljty.. Covert ercial
(CC-2) zone, as indicated;-

834, being located within Lyon's First Addition, Block 4, Lots 6 thru 10 inclushia, as rigwrded .in
Dbk. 12 — Pg. 188, and Pbk. 2 — Pg. 31, and real estate described in Warrari*Paerirecorded
Oct. 4, 1996, in Bk. 2166 — Pg. 16 all in the Johnson County, Iowa Recorders bifice, gollectively
described as follows: m
418 East Benton St.: The west �/2 of the East %2, of said lots 9 and 10; and
416 East Benton St.: The East'/2 of the West %, of said Lots 9 and 10; and

Section II. Zoning Mao. The building official is hereby authorized and directed to change the
zoning map of the City of Iowa City, Iowa, to conform to this amendment upon the final passage,
approval and publication of the ordinance as approved by law.

Section III. Certification And Recording. Upon passage and approval of the Ordinance, the
City Clerk is hereby authorized and directed to certify a copy of this ordinance, and record the
same in the Office of the County Recorder, Johnson County, Iowa, at the Owner's expense, upon
the final passage, approval and publication of this ordinance, as provided by law.
Section IV. Repealer. All ordinances and parts of ordinances in conflict with the provisions of
this Ordinance are hereby repealed.
Section V. Severability. If any section, provision or part of the Ordinance shall be adjudged to
be invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a
whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
Section VI. Effective Date. This Ordinance shall be in effect after its final passage, approval
and publication, as provided by law.

Resolution to amend the Comprehensive Plan future land use map from
Public/Semi-Public to Residential 16-24 du/acre and the Southwest District
Plan future land use map from Public Services/Institutional to Medium to
High Density Multi -Family for approximately 9.9 acres of land located at
611 Greenwood Drive (CPA25-0002)
Whereas, the Iowa City Comprehensive Plan serves as a land -use and planning policy
guide by illustrating and describing the location and configuration of appropriate land uses
throughout the City; by providing notification to the public regarding intended uses of land; and by
illustrating the long-range growth area limit for the City; and
Whereas, TWG Iowa City, LP, has requested that the future land use designation for
approximately 9.9 acres of land located at 611 Greenwood Drive be changed from Public/Semi-
Public to Residential 16-24 du/ac and from Public Services/Institutional to Medium to High Density
Multi -Family within the Southwest District Plan, as shown in Attachment 1; and
Whereas, if circumstances change and/or additional information or factors come to light, a
change to the Comprehensive Plan may be in the public interest; and
Whereas, circumstances have changed since the adoption of the IC2030 Comprehensive
Plan and the Southwest District Plan, including the closure of the Roosevelt Elementary School
in 2012, the subsequent shutdown of The Roosevelt Education Center in 2019, and the sale of
the property to a private entity in 2021; and
Whereas, the proposed amendment is compatible with other policies and provisions of the
Comprehensive Plan, including policies that support infll redevelopment opportunities in areas
where services and infrastructure are already in place, encourage a diversity of housing options in
all neighborhoods, and discourage sprawl by promoting infill development; and
Whereas, the Planning and Zoning Commission reviewed this proposed amendrrtant at its
meeting on August 27, 2025 and determined that circumstances changed to the extetPthat an
amendment to the Comprehensive Plan is warranted and in the public interest aiiffithaproposed
amendment is compatible with other policies or provisions of the Comprehensive 6�b .

Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa, that:*

Ordinance conditionally rezoning approximately 9.9 acres of land located
at 611 Greenwood Drive from Neighborhood Public (P-1) zone to Medium
Density Multi -Family Residential Zone with a Planned Development
Overlay (OPD/RM-20) (REZ25-0010).
Whereas, TWG Iowa City, LP, has requested the rezoning of approximately 9.9 acres of land
located at 611 Greenwood Drive from Neighborhood Public (P-1) zone to Medium Density Multi -
Family Residential Zone with a Planned Development Overlay (OPD/RM-20); and
Whereas, the Comprehensive Plan indicates that the subject area is appropriate for residential
development at a density of 16-24 du/ac and the Southwest District Plan envisions Medium to
High Density Multi -Family development; and
Whereas, due to the topographic challenges with providing a sidewalk along Greenwood
Drive, the rezoning creates a public need for the installation of a 10' wide publicly accessible
pedestrian connection from W. Benton Street north through the subject property to Greenwood
Drive; and
Whereas, the rezoning creates a public need to restrict vehicular to Greenwood Drive and
ensure that access is provided at a near 90-degree angle with Greenwood Drive; and
Whereas, the rezoning creates a public need to improve pedestrian facilities (tough the
installation of a raised crosswalk across Greenwood Drive near the entrance to the sr4e ubject to
review and approval by the City Engineer; and
Whereas, the Planning and Zoning Commission has determined that, with appropriate
conditions regarding the improved pedestrian facilities including a raised crosswalk. and-4 10' wide
public pedestrian path, vehicular access restricted to Greenwood Drive, and the driveto the site
on Greenwood Drive at a near 90-degree angle the rezoning is consistenl^..Wth the

Whereas, Iowa Code §414.5 (2025) provides that the City of Iowa City may impose
reasonable conditions on granting a rezoning request, over and above existing regulations, in
order to satisfy public needs caused by the requested change; and
Whereas, the owner, TWG Iowa City, LP has agreed that the property shall be developed in
accordance with the terms and conditions of the Conditional Zoning Agreement attached hereto to
ensure appropriate development in this area of the City.
Now, therefore, be it ordained by the City Council of the City of Iowa City, Iowa:

This agreement is made between the City of Iowa City, Iowa, a municipal corporation (hereinafter
"City"), and TWG Iowa City, LP (hereinafter referred to as "Owner).
Whereas, Owner is the legal title holder of approximately 9.9 acres of property located at
611 Greenwood Drive, legally described below; and
Whereas, the Comprehensive Plan indicates that the subject area is appropriate for
residential development at a density of 16-24 du/ac and the Southwest District Plan envisions
Medium to High Density Multi -Family development; and

2. Owner acknowledges that the City wishes to ensure conformance to thergifi cip4'3 of the.
Comprehensive Plan. Further, the parties acknowledge that Iowa Cod6.§4141F(2025)
provides that the City of Iowa City may impose reasonable conditions"on grantinga.
rezoning request, over and above the existing regulations, in order to satisfy public needs':
caused by the requested change.
3. In consideration of the City's rezoning the subject property, Owner agrees that
development of the subject property will conform to all requirements of the Zoning Code,
as well as the following conditions:
a. Prior to issuance of a Certificate of Occupancy, installation of a 10' wide pedestrian
connection and dedication of an associated public access easement along the
eastern portion of the property to extend from W. Benton Street to Greenwood Drive.
Pedestrian path shall also include pedestrian scale lighting to be reviewed and
approved by the City during the site plan review process. Lighting shall be installed
and maintained by the Owner.
b. Vehicular access to the site from W. Benton Street is restricted to emergency
vehicles only.
c. Prior to issuance of Certificate of Occupancy, installation of a raised crosswalk
across Greenwood Drive near the entrance to the site subject to review and approval
by the City Engineer.
d. As part of the site plan approval, ensure that the design of the access drive from
Greenwood Drive to the subject property is at or near a 90-degree angle subject to
review and approval by the City Engineer.
4. The conditions contained herein are reasonable conditions to impose on the land under
Iowa Code §414.5 (2025), and said conditions satisfy the public needs that are caused by
the requested zoning change.
5. This Conditional Zoning Agreement shall be deemed to be a covenant running with the
land and with title to the land, shall inure to the benefit of and bind all successors,
representatives, and assigns of the parties, and shall remain in full force and effect unless
and until released of record by the City for the above -described property, upon which
occurrence these conditions shall be deemed satisfied and this agreement of no further
force and effect. Nothing in this Conditional Zoning Agreement shall be construed to
relieve the Owner from complying with all other applicable local, state, and federal
regulations.
6. This Conditional Zoning Agreement shall be incorporated by reference into the ordinance
rezoning the subject property, and that upon adoption and publication of the ordinance,
this agreement shall be recorded in the Johnson County Recorder's Office at the Owner's
expense.

Notice of Meeting of the City Council of the City of Iowa City,
State of Iowa, on the Matter of the Proposed Authorization of a
Loan and Disbursement Agreement and the Issuance of Not to
Exceed $36,000,000 Sewer Revenue Capital Loan Notes, and the
Public Hearing on the Authorization and Issuance Thereof
Public Notice is hereby given that the City Council of the City of Iowa City, State of
Iowa, will hold a public hearing on the 2n4 day of September, 2025, at 6:00 P.M., in the Emma J.
Harvat Hall, City Hall, 410 E. Washington, Iowa City, Iowa, at which meeting the Council
proposes to take additional action for the authorization of a Loan and Disbursement Agreement
by and between the City and the Iowa Finance Authority and the issuance to the Iowa Finance
Authority of not to exceed $36,000,000 Sewer Revenue Capital Loan Notes, to evidence the
obligations of the City under said Loan and Disbursement Agreement, in order to provide funds
to pay the costs of the acquisition, construction, reconstruction, extending, remodeling,
improving, repairing and equipping all or part of the Municipal Sewer System, including costs
associated with Phase I of the Wastewater Treatment Facility Digester Rehabilitation project.
The Notes will not constitute general obligations or be payable in any manner by taxation, but
will be payable from and secured by the Net Revenues of the Municipal Sewer System.
At the above meeting the City Council shall receive oral or written objections from any
resident or property owner of the City to the above action. After all objections have been
received and considered, the City Council will at this meeting or at any adjournment thereof,
take additional action for the authorization of a Loan and Disbursement Agreement and the
issuance of Notes to evidence the obligation of the City thereunder or will abandon the proposal
to issue the Notes.
This Notice is given by order of the City Council of the City of Iowa City, State of Iowa,
as provided by Sections 384.24A and 384.83 of the Code of Iowa, as amended.
