Resolution approving applications for retail tobacco, tobacco products, alternative nicotine
products, vapor products, and device retailer permits, as required by Iowa Code 453A.47A

Executive Summary:
Pursuant to Iowa Code §453A.47A, a retail permit is required to sell tobacco, tobacco
products, alternative nicotine products, or vapor products at any place of business or through
delivery sales. All permits provided for in Iowa Code §453A.47A expire on June 30 of each
year and require payment of the applicable fee established in Iowa Code §453A.47A(7). The
Iowa Department of Revenue implements the retail permit requirements of Iowa Code
§453A.47A. The City Clerk's Office issues all permits for retailers located within city limits. As
part of the retail permit process, the Iowa Department of Revenue requires applications be
approved by the City Council once the City receives the completed application and the
appropriate fee is paid.
Background / Analysis:
During the 2024 legislative session, the Iowa legislature enacted Iowa Code §453E.3, which
regulates and taxes the sale of devices effective January 1, 2025. Per the legislation, a
"device" is defined as any equipment or product, made in whole or in part of glass or metal,
that is designed for use in inhaling through combustion tobacco, hemp, other plant materials,
or a controlled substance. A device retailer shall only display and sell devices in a location of
a retail outlet where the device retailer ensures that the devices are not visible to a person
younger than twenty-one years of age and where no person younger than twenty-one years
of age is present or permitted to enter at any time. Based on this legislation, we have
included 'device' in the permit approval resolution and will indicate the permit type for which
each business has applied.

Executive Summary:
Pursuant to Iowa Code Section 384.22, the City must file the AURR for each of the 10 active
urban renewal areas as of the end of FY2025. This report must be approved by a majority of
the City Council, and filed prior to the publication and adoption of the City budget. Filing this
report is required before the Department of Management will certify the City's taxes back to
the County Auditor.
Background / Analysis:
Tax Increment Financing (TIF) is one of the few tools that allow cities to financially support
local economic development projects. Iowa City has established 14 Urban Renewal Areas
(11 of which are active) enabling the use of TIF. Each Urban Renewal Plan specifies the
goals and planned urban renewal projects. Since 2003, the City has been a financial partner
in several TIF projects ranging from industrial businesses adding jobs and new products, to
the redevelopment of blighted properties and high-rise mixed -use buildings. The attached
chart, New Value Created by TIF projects, shows all of the TIF projects the City has assisted.
The increase in taxable value (the increment) for Iowa City's current TIF projects exceeds
$234,000,000 and generates approximately $8.5 million in property taxes every year.

Resolution approving the Fiscal Year Ending 2025 Annual Urban Renewal
Report.
Whereas, in an effort to provide greater public access to information about urban renewal
activities, including the use of tax increment financing, the Iowa Legislature enacted changes in
Iowa Code Sections 384.22 to require, among other things, the filing of an annual report detailing
the City's urban renewal activities; and
Whereas, the City of Iowa City had ten (10) active Urban Renewal Areas during the most
recently ended fiscal year; and
Whereas, City staff has prepared an urban renewal report in compliance with state law and has
placed said plan on file in the office of the Finance Director, City Hall, Iowa City, Iowa; and
Whereas, the report must be approved by City Council before its submission to the Iowa
Department of Management on or before December 1, 2025.
Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa:
1. The Fiscal Year Ending 2025 Annual Urban Renewal Area Report, attached hereto, is
hereby approved.
2. The Finance Director is hereby directed to submit it to the Iowa Department of Management
by December 1, 2025 on fortes and pursuant to instructions prescribed by the Department.

Executive Summary:
The City is required to file an annual TIF debt certification with the County Auditor by
December 1st of each year which specifies the increment collected for each active urban
renewal area.
Background / Analysis:
The annual TIF debt certification to the County Auditor specifies the tax increment collected
for each urban renewal area in which there is activity. Depending on the activity in an urban
renewal area, different forms are submitted to the County Auditor.
Form 1 initiates the collection of tax increment for projects not certified with the Auditor
previously (new activity). Form 2 requests a specific dollar amount less than the full amount
of available increment, such as when the available increment is more than the project/activity
costs. Form 3 ends the collection of tax increment. Attached is a summary of the 2025
certification forms, followed by the full version of the forms to be submitted to the County
Auditor before December 1, 2025.

Resolution directing the filing of Tax Increment Financing (TIF) certification
under Iowa Code Section 403.19 for the 2025 end of year certification of
urban renewal projects.
Whereas, the City of Iowa City, Iowa has established the various urban renewal plans for
certain urban renewal areas (the "Urban Renewal Areas") and is undertaking certain projects within
the Urban Renewal Areas (the "Projects"); and
Whereas, it is the intention of the City to certify the amount so incurred and advanced,
together with interest, for reimbursement under Iowa Code Section 403.19.
Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa:
1. There has been established separate tax increment revenue funds for the City -University
Project I Urban Renewal Area; Foster Road Urban Renewal Area; Heinz Road Urban Renewal
Area, Highway Six Urban Renewal Area; Moss Green Urban Renewal Area; Riverside Drive Urban
Renewal Area; Sycamore & 1s' Avenue Urban Renewal Area; Scott Six Urban Renewal Area; and
Towncrest Urban Renewal Area (collectively the "Tax Increment Funds"), into which incremental
property tax revenues received from the respective urban renewal areas are deposited. The Council
finds the Projects identified in the attached TIF certifications to be Urban Renewal Projects as
defined in Iowa Code Chapter 403 and directs that the amounts specified in said exhibits be certified
for reimbursement under Iowa Code Section 403.19.
2. The Clerk and other City officials having responsibility for the books and records of the
City shall take such actions as are necessary to comply with this Resolution, including but not limited
to, certification for reimbursement under Iowa Code Section 403.19.

Executive Summary:
This agenda item authorizes an agreement to provide consultant services for the FY2026
Pavement Rehabilitation Project.
This agreement includes design services for the reconstruction of Washington Street, from
Madison Street to Capitol Street, and Juniper Drive, from Alpine Court to 3116 Juniper Drive.
Additionally, the agreement includes asphalt resurfacing of Pine Street, Ash Street, Franklin
Street, and Yewell Street, between Deforest Avenue and Ginter Avenue. The overlay will
generally be designed to include milling and overlaying with approximately 3"-4" of asphalt.
Crosswalks and sidewalk ramps will be included to meet Americans with Disabilities Act
(ADA) guidelines.
Background / Analysis:
The segments of Washington Street and Juniper Drive are in poor condition and are nearing
the end of their useful service life. Pavement surfaces have deteriorated significantly in
recent years and staff has observed pavement cracking, joint deterioration, and spalling.
This leads to decreased ride quality and increased maintenance for public works staff.
Given that the pavement condition is poor and would likely not support a pavement overlay,
reconstruction of the streets is necessary.

Whereas, the City desires to obtain the services of a qualified consulting firm to provide land

1. Scope of Services
The consultant agrees to provide the following services for the City and to do so in a timely
and satisfactory manner. For purposes of planning, scope development and tracking, and
budgeting for work with the FY2026 Project Annual Pavement Rehabilitation Fund, the
project will include development of two (2) separate project plan sets:
• Project A (Pine Street, Ash Street, Franklin Street, Yewell Streets) -The plan
set will include improvements to streets by resurfacing and installing sealcoat.
• Project B (Washington Street, Juniper Street) - The plans will include
improvements for street reconstruction.
A. Project Coordination
1.0 Proiect Kickoff Meeting
Facilitate one (1) project kickoff meeting with City to discuss the project scope,
goals, and administrative details of the project. This meeting could serve both
projects.
2.0 Project Management
Provide project management services including management of the project
schedules, resources, risks, communication, and costs. Provide updates of the

projects regularly during the design process.
3.0 City Staff Review
Coordinate meetings to review each plan set for resurfacing and reconstruction
projects for a total of six (6) meetings with City Staff:
• (2) Preliminary Plan Review.
• (2) Check Plan Review.
• (2) Final Plans / Field Review (In Person).
B. Site Investigation
1.0 PROJECT A - Field Review, Land Surveying and Base Mapping.
Consultant shall conduct a field review with City Public Works using aerial
imagery prior to beginning work on project to complete the following:
o Review curb and gutter and patching areas.
o Review driveway impacts.
o Review concept ADA Ramp layout for impacts. Create project base
map for ADA curb ramp locations for use with design.
Consultant shall conduct land surveying and based mapping to include:
• Contact Iowa One Call for mapping and utility locates.
• Right-of-way and existing easements are not included however Johnson
County GIS line work will be used to represent approximate Right of way
limits. No full boundary review and investigation will be included in the scope.
• Storm and Sanitary Sewer structure review and survey.
• Utilize Iowa State Plane South Coordinate System.
• Includes drone imagery to be provided for project corridor civil design.
• No boundary survey to be completed. Platting is not anticipated for this project
location.
2.0 PROJECT B - Field Review, Land Surveying and Base Mapping.
Consultant shall conduct a field review with City Public Works and University of
Iowa using aerial imagery prior to beginning work on project to complete the
following:
• Review project limits and potential utility impacts
• Review ADA Ramp locations and discuss options for updates and concems
for impacts.
Consultant shall conduct full land surveying and based mapping to include:
• Contact Iowa One Call for mapping and utility locates.
• Obtain the current site GIS and CAD files from the City or other consulting
firms (as approved by the City) to review known utility information.
• Utilize a combination of drone survey and/or field topographic survey of the
site area to create a project base map. Survey will utilize Iowa State Plane
South Coordinate System.
• Create project base map for civil design.
• Provide a new drone aerial image for use with presentation and design.

Boundary survey to locate existing monuments and determine existing right-
of-way for project corridors. Boundary survey includes boundary research,
boundary field work, boundary office calculations, create a boundary base map
for civil design.
• The need for Acquisition Plats or Temporary Easement Plats are not
anticipated and fees do not include platting services however may be added
by amendment if there is a need during project design.
• The Consultant will identify existing marked utilities to provide horizontal
location only and obtain the maps and field locates for public utilities. No
potholing is included in this scope; however, potholing services and
supplemental survey may be added, if necessary, as an added service if
design identifies a potential conflict.
• Utility coordination will include coordination with the City and University of
Iowa to provide a representation of public water, storm sewer, sanitary sewer,
City and University telecommunications, and fiber, or other utilities during this
phase.
• Consultant will include a utility, coordination sheet with development and
coordinate either by joint utility meeting or separate meeting to provide
coordination of possible conflicts.
3.0 - Proiect B - Subsurface Investigation
a. The Consultant will coordinate subsurface investigation and analysis (e.g.
geotechnical report) to soil analysis for soil borings along Washington Street
and Juniper Drive to include five (5) test borings along the roadways.
I Two (2) borings will be extended to depths of 10 feet below existing grade
along Washington Street.
2) Three (3) borings will be extended to depths of 10 feet below existing grade
along Juniper Drive.
3) All borings will include standard penetration tests or thin -walled tube
sampling at 2 % foot vertical intervals to a depth of 10 feet and at 5-foot
intervals at greater depths.
4) Traffic Control costs included.
b. An engineering analysis, including subbase and recommended pavement
thickness, and a written report shall be provided.
C. Document Development
1.0 Concept Development (Pro iact A and B)
Consultant will develop concept plans and estimates for the project locations:
• Reconstruction of Juniper Drive from Alpine Ct to 3116 Juniper Drive and
Washington Street between Madison St to Capitol Street.
• Resurfacing of Pine Street, Ash Street, Franklin Street, and Yewell Streets
between Deforest and Avenue and Ginter Avenue.
2.0 Preliminary Design Documents (Proiect A)
The Consultant shall develop preliminary plans for layout only, of ADA sidewalk
layout and impacts anticipated to offsite areas beyond right of way, cost opinion
and schedule.
• Design level is intended to provide high level review of curb ramp layout and
cost opinion to review prior to detailed layout in further phases.
• Assess storm and sanitary sewer structure condition, riser height and
adjustment needed. Intake adjustment included as deemed necessary
based on condition and costs.

• No runoff or drainage analysis included.
• Review and determine any need for temporary construction easements
following the review meeting.
3.0 Preliminary Plan Design Documents (Proiect B)
The Consultant shall develop preliminary plans for the proposed improvements
for Washington Street and Juniper Drive. The preliminary plans will include
project extents, removals, sidewalk layout and ADA access for the ramps at the
intersection of Madison and Washington Streets and preliminary traffic control
layout.
• Storm intake structures and piping is included in the design however this does
not include drainage analysis.
• Preliminary plans will be submitted to City of Iowa City for review. Preliminary
design deliverables will include preliminary project plans and preliminary
opinion of probable construction cost.
D. Construction Document Development
1.0 Check Plan Design Documents (Proiect A)
The scope of work does not include development of check plan documents for
Project A.
2.0 Check Plan Design Documents (Project B Only)
Based upon approved preliminary design, the Consultant shall subsequently
proceed with the development of Check Plans. The Check Plans will include
documents at approximately 90% complete for project extents, grading plan
including storm water drainage assessment, sidewalk and ADA access,
removals, estimate of quantities, estimate reference information, tabulations,
traffic control layout, erosion control plans, and utility plans (as needed).
• Preliminary supplementary specifications if required shall be provided to the
City of Iowa City for review.
• The Check Plans for the project will be approximately 90% complete. Check
Plan design deliverables will include Check Plans, Opinion of Probable
Construction Cost, Preliminary Supplemental Specifications.
• Submit to City and attend City staff review meeting to discuss comments.
• Finalize temporary construction easement locations following the review
meeting.
3.0 Draft Final Documents (Project A and Project B)
Consultant shall provide final draft plans including all plan items listed in previous
project reviews for each set, specifications, cost opinion and schedule, draft front-
end documents.
• Submit the 100% unapproved set to the City for review.
• Attend City staff review meeting to discuss comments.
4.0 Final Print Documents (Project A and Project B)
Consultant shall provide final complete plans, specifications, cost opinion and
schedule, draft front-end documents.
• Submit the Final set to the City for bidding.
E. Bidding and Construction Phase Services
Consultant shall provide limited bid phase services following the completion of project
bidding and contract award.

Consultant shall provide limited bid phase services following the completion of
final project documents. The project will include bidding two (2) separate Project
sets as noted for Project A and Project B. Bidding services shall include:
• Attending two (2) project pre -bid meetings.
• Provide responses to questions from prospective bidders and provide
darifications and interpretations of the two (2) separate bidding documents.
• Review the bids received for the two (2) projects and provide a formal
recommendation to the City.
2.0 Construction Phase
Consultant shall provide limited construction phase services following the award
to contractor. The project will include award and separate construction schedules
for two (2) projects as noted for Project A and Project B. Construction services
shall include:
• Attend a total of two (2) pre -construction meetings, one for each project.
• Attend four (4) construction progress meetings for each project for a total of
eight (8) meetings.
• Respond to Requests for Information (RFls).
• Attend final walk through of the project and assist with preparing final punch
list.
F. Additional Services
Consultant may perform the following additional services upon execution of a written
amendment to this agreement. However, these additional services shall not be
performed without prior written authorization.

III. Compensation for Services
The Consultant shall be compensated for performing the Scope of Services on an hourly basis in
accordance with the Standard Hourly Fee Schedule, attached hereto and incorporated herein by this

N. General Terms
A. Consultant will not unlawfully discriminate in its hiring or discharge of any individual,
or in its terms and conditions of employment. Consultant agrees to prohibit such
unlawful discrimination in any subcontract.
B. Should the City terminate this Agreement, the Consultant shall be paid for all work and
services performed up to the time of termination. However, such sums shall not be
greater than the "not -to -exceed" amount listed in Section III. The City may terminate
this Agreement upon seven (7) calendar days' written notice to the Consultant.
C. This Agreement shall be binding upon the successors and assigns of the parties
hereto, provided that no assignment shall be without the written consent of all Parties
to said Agreement.
D. It is understood and agreed that the retention of the Consultant by the City for the
purpose of the Project shall be as an independent contractor and shall be exclusive,
but the Consultant shall have the right to employ such assistance as may be required
for the performance of the Project.
E. It is agreed by the City that all records and files pertaining to information needed by
the Consultant for the project shall be available by said City upon reasonable request
to the Consultant. The City agrees to furnish all reasonable assistance in the use of
these records and files.
F. It is further agreed that no Party to this Agreement shall perform contrary to any state,
federal, or local law or any of the ordinances of the City of Iowa City, Iowa.
G. At the request of the City, the Consultant shall attend meetings of the City Council
relative to the work set forth in this Agreement. Any requests made by the City shall
be given with reasonable notice to the Consultant to assure attendance.
H. The Consultant agrees to furnish, upon termination of this Agreement and upon
demand by the City, copies of all basic notes and sketches, charts, computations, and
any other data prepared or obtained by the Consultant pursuant to this Agreement
without cost, and without restrictions or limitation as to the use relative to specific
projects covered under this Agreement. In such event, the Consultant shall not be
liable for the City's use of such documents on other projects.
I. The Consultant agrees to furnish all reports, specifications, and drawings with the seal
of a licensed professional as required by Iowa law.
J. The City agrees to tender the Consultant all fees in a timely manner, excepting,
however, that failure of the Consultant to satisfactorily perform in accordance with this
Agreement shall constitute grounds for the City to withhold payment of the amount
sufficient to property complete the Project in accordance with this Agreement.
K. Should any section of this Agreement be found invalid, it is agreed that the remaining
portion shall be deemed severable from the invalid portion and continue in full force
and effect.
L. Original contract drawings shall become the property of the City. The Consultant shall
be allowed to keep reproducible copies for the Consultant's own filing use.
M. Fees paid for securing approval of authorities having jurisdiction over the Project will
be paid by the City.
N. Upon signing this Agreement, Consultant acknowledges that Section 362.5 of the Iowa
Code prohibits a City officer or employee from having an interest in a contract with the
City, and certifies that no employee or officer of the City, which includes members of
the City Council and City boards and commissions, has an interest, either direct or
indirect, in this Agreement, that does not fall within the exceptions to said statutory
provision enumerated in Section 362.5.
O. Indemnification
1. To the full extent permitted by law, Consultant agrees to defend, indemnify, and
hold harmless the City against any and all claims, demands, suits, loss, expenses,
including attorneys fees, and for any damages which may be asserted, claimed
or recovered against or from the City by reason of personal injury, including bodily
injury or death, and property damages, including loss of use thereof, caused by
Consultant's negligent acts, errors or omissions in performing the work and/or
services provided by Consultant to the City pursuant to the provisions of this
Agreement.
2. Consultant assumes full responsibility for any and all damage or injuries which
may result to any person or property by reason of Consultant's negligent acts,
errors or omissions in connection with the work and/or services provided by
Consultant to the City pursuant to this Agreement, and agrees to pay the City for
all damages caused to the Citys premises resulting from the negligent acts, errors
or omissions of Consultant.
3. The Consultant's obligation to indemnify the City shall not include the obligation to
indemnify, hold harmless, or defend the City against lability, claims, damages,
losses, or expenses, including attorney fees, to the extent caused by or resulting
from the negligent act, error, or omission of the City.
4. For purposes of this paragraph, the term "Consultant" means and includes the
Consultant, its officers, agents, employees, sub -consultants, and others for whom
Consultant is legally liable, and the term "City" means and includes the City of Iowa
City, Iowa its Mayor, City Council members, employees, and volunteers.
P. Insurance
1. The Consultant agrees at all times material to this Agreement to have and maintain
professional liability insurance covering the Consultant's liability for the
Consultant's negligent acts, errors and omissions in the sum of $1,000,000 Per
Claim, $1,000,000 Annual Aggregate, or a $1,000,000 Combined Single limit. To
the fullest extent permitted by applicable state law, a Waiver of Subrogation Clause
(endorsement) shall be added.
2. Consultant agrees to provide the City a certificate of insurance evidencing that all
coverages, limits and endorsements required herein are maintained and in full
force and effect, and certificates of Insurance shall provide a minimum thirty (30)
day endeavor to notify, when available by Consultant's insurer. If the Consultant
receives a non -renewal or cancellation notice from an insurance carrier affording
coverage required herein, or receives notice that coverage no longer complies with
ME
the insurance requirements herein, Consultant agrees to notify the City within five
(5) business days with a copy of the non -renewal or cancellation notice.
Q. Standard of Care
1. The Consultant shall perform services for, and furnish deliverables to, the City
pertaining to the Project as set forth in this Agreement. The Consultant shall
possess a degree of learning, care and skill ordinarily possessed by reputable
professionals, practicing in this area under similar circumstances. The Consultant
shall use reasonable diligence and professional judgment in the exercise of skill
and application of learning.
2. Consultant represents that the Services and all its components shall be free of
defects caused by negligence; shall be performed in a manner consistent with the
standard of care of other professional service providers in a similar Industry and
application; shall conform to the requirements of this Agreement; and shall be
sufficient and suitable for the purposes expressed in this Agreement.
3. All provisions of this Agreement shall be reconciled in accordance with the
generally accepted standards of the Engineering Profession.
4. Consultant's obligations under this Section shall exist without regard to, and shall
not be construed to be waived by, the availability or unavailability of any insurance,
either of City or Consultant.
R. There are no other considerations or monies contingent upon or resulting from the
execution of this Agreement, it is the entire Agreement, and no other monies or
considerations have been solicited.
S. This Agreement shall be interpreted and enforced in accordance with the laws of the
State of Iowa. Any legal proceeding instituted with respect to this Agreement shall be
brought in a court of competent jurisdiction in Johnson County, Iowa. The parties
hereto hereby submit to personal jurisdiction therein and irrevocably waive any
objection as to venue therein, including any argument that such proceeding has been
brought in an inconvenient forum.

eight people filling this position. It is anticipated there there will be a long-term vacancy for
one of these positions.
The proposed staffing increase will maintain the current level of service that is being provided
to the Public. Staff feels maintaining the current level of service with temporary employees
would not be possible due to the skill required and the long-term nature of this vacancy.

The project included four (4) change orders related to additional storm sewer and pavement,
exploratory excavation and concrete removal, and support of a signal pole during excavation.
Background / Analysis:
The Highway 6 Water Main Replacement Project included the replacement of approximately
2,100 linear feet of 16-inch ductile iron and PVC water main on the north side of Highway 6
between Fairmeadows Boulevard and Industrial Park Road. Additionally, this project installed
new ADA compliant curb ramps and new storm sewer at Fairmeadows Boulevard. Street and
sidewalk pavement were replaced as necessary to complete this project.

The project was bid as a unit price contract, and the final contract price is $663,717.67.
There were four (4) change orders on this project as follows:
1. Storm sewer at the intersection of Fairmeadows Boulevard and Highway 6 $47,845.50
2. Exploratory excavation and concrete removal $5,014.00
3. Pavement removal and PCC pavement, 7-inch with 3-inch HMA overlay $12,748.00

Executive Summary:
Preliminary design for the Taft Avenue Reconstruction Project is underway. A preliminary
assessment indicates the proposed improvements require the acquisition of permanent right-
of-way, permanent utility and temporary construction easements from property owners within
the project corridor.
Because the anticipated acquisitions include agricultural land, the City is giving notice of
intent to commence the project to all property owners whose properties may be acquired in
whole or in part for the project, even if not required for street and highway projects under
Iowa Code. This resolution begins the process to commence acquisitions.
Background / Analysis:
Taft Avenue is currently a rural roadway (one -lane in either direction) with ditches. To
support projected growth within the southeast quadrant of the City, the roadway and
associated infrastructure needs upgrading to current minor arterial design standards.
Identifying this future need in 2015, the City prepared functional design plans for Taft Avenue
(American Legion Road to E Court Street) to establish design parameters and identify
preliminary right-of-way needs. This project will extend the northern limits from E Court Street
to Lower West Branch Road SE.

Resolution authorizing mailing and publication of notice of intent

Whereas, under the provisions of Sections 6B.2A and 6B.2B of the Iowa Code, a governmental
body which proposes to acquire property under power of eminent domain for a public improvement
project is required to give notice of intent to commence the project to all property owners whose
properties may be acquired in whole or in part for the project; and
Whereas, the City Council of the City of Iowa City intends to commence a project to construct the
Taft Avenue Reconstruction Project, which includes the reconstruction of Taft Avenue (American
Legion Road to Lower West Branch Road), which project is to be known as the Taft Avenue
Reconstruction Project; and
Whereas, funds for this project are available in the Taft Avenue -American Legion Road to Lower
West Branch Road account # S3959; and
Whereas, before the City of Iowa City can proceed with said project, the City Council must:
a. Hold a public hearing, providing the opportunity for public input on the question of
proceeding with the public improvement and on the acquisition or condemnation of property
interests for the project; and
b. Adopt a resolution declaring its intent to proceed with said project and authorizing the
acquisition of property interests required for the project by negotiation or condemnation.
Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa, that:
1. Documentation showing the proposed location of the Taft Avenue Reconstruction Project shall
be placed on file in the office of the City Clerk and made available for public viewing.
2. A public hearing on the City's intent to proceed with the Taft Avenue Reconstruction Project and
to acquire property rights therefore is to be held on the r day of December, 2025, at 6:00 p.m.
in the Emma J. Harvat Hall, City Hall Center, Iowa City, Iowa, or if said meeting is cancelled, at
the next meeting of the City Council thereafter as posted by the City Clerk.
3. The Department of Public Works and City Clerk are hereby authorized and directed to cause
notice of the City's intent to proceed with said project and authorize the acquisition of property
for said project to be mailed not less than thirty (30) days and published in a newspaper
published at least once weekly and having a general circulation in the City, not less than four
(4) nor more than twenty (20) days before said hearing.

Executive Summary:
This agenda item begins the bidding process for the Terrell Mill Roller Park Project. This
project generally includes site preparation, removals, earthwork, erosion control, drainage,
asphalt paving, concrete paving, shelter installation, site furnishing installation, skatepark
equipment installation, planting, native seeding, and turf seeding restoration.
Background / Analysis:
The existing skate park is nearing an age where replacement is necessary for it to continue to
draw skaters, as well as for improved maintenance and addition of safer beginner skating
areas. This project generally includes renovating the aging skate park with an added skate
park area, as well as introducing a new bicycle pump track. The addition of a bicycle pump
track is expected to bring even more users to the facility. New paths will also be included for
improved use access. Public input meetings and an on-line survey were conducted in
January and February 2024 to gather user input. A $250 000 Federal Land and Water
Conservation Fund grant was secured for this
the final design and bidding process.

Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa that:
1. The project manual and estimate of cost for the above -named project are hereby
approved.
2. The amount of bid security to accompany each bid for the construction of the above -
named project shall be in the amount of 10% (ten percent) of bid payable to City of Iowa
City, Iowa.
3. The City Clerk is hereby authorized and directed to post notice as required in Section 26.3,
not less than 13 days and not more than 45 days before the date of the bid letting, which
may be satisfied by timely posting notice on the Construction Update Network, operated
by the Master Builders of Iowa, and the Iowa League of Cities website.
4. Sealed bids for the above -named project are to be received by the City of Iowa City, Iowa,
at the Office of the City Clerk, at the City Hall, before 3:00 p.m. on the 2nd day of
December, 2025. At that time, the bids will be opened by the City Engineer or his
designee, and thereupon referred to the City Council of the City of Iowa City, Iowa, for

Executive Summary:
This resolution is to adopt an assessment schedule for unpaid mowing, property clean-up,
and snow removal.
Background / Analysis:
The City has the authority under Iowa Code §364.13B to assess the nuisance abatement
costs in the same manner as a property tax. This resolution allows the City Clerk to certify to
the Johnson County Treasurer the abatement cost to be assessed against the property. This
assessment is being pursued only after the City took many steps to resolve the matter. The
City notified the owners to abate the nuisance (for example, to remove snow from the
sidewalk) and after the owner did not take action to abate the nuisance, the City abated the
nuisance and billed the owner. After being billed at least twice, these owners still have not
paid the abatement costs. The City has sent a letter to the owner giving them notice that this
resolution would be on the agenda, a copy of which is attached to the resolution. No interest
will be charged if the owner pays within 30 days of the first required publication. Attached as
an exhibit to the resolution is a list of the properties that will be assessed and the amount that
will be assessed.

amount to be assessed against certain lots for the actual unpaid abatement costs of mowing,
cleaning up property, removing snow, repairing sidewalks, and repairing stop boxes in the same
manner as property taxes; and
Whereas, said schedule is attached as Exhibit A to this resolution and incorporated herein by this
reference; and
Whereas, Iowa Code § 364.13B authorizes the City Council to assess against the property said
abatement costs in the same manner as property taxes; and
Whereas, the City Council finds that the property owners listed in Exhibit A have received a written
notice of the date and time of the public hearing on the adoption of said assessment schedule, in
substantially the same form attached hereto as Exhibit B.
Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa:
Exhibit A is adopted as the final assessment schedule pursuant to Iowa Code § 384.60(1).
The amounts listed in Exhibit A for unpaid mowing charges, clean-up property charges, snow
removal charges, sidewalk repair charges and stop box repair charges are confirmed and levied
against the properties listed in Exhibit A.
All unpaid assessments not paid within thirty (30) days after the first publication of the final
assessment schedule shall bear interest at the rate of 9% per annum, commencing on
December 18, 2025.
Assessments are payable at Johnson Country Treasurer, 13 South Dubuque Street, Iowa City,
Iowa. Until December 17, 2025, payment may be made at the City Clerk, 410 E. Washington
Street, Iowa City, Iowa.
The City Clerk is hereby directed to certify the schedule as set out in Exhibit A to the Treasurer
of Johnson County, Iowa for collection in the same manner as property taxes. The assessment
cannot be paid in installments.
The City Clerk is further directed to publish notice of the schedule once each week for two
consecutive weeks in the manner provided in Iowa Code § 362.3, the first publication of which
shall be not more than fifteen (15) days from the date of filing of the final assessment schedule.
