HomeMy WebLinkAbout2013-02-05 Correspondence4c(1) Liquor License Renewal Agreement between the City of Iowa City Police Department and Caffrey I.C., Inc, d /b /a Iowa City Fieldhouse. WHEREAS, the Iowa City Police Department (hereinafter "ICPD ") based on the criminal charges currently pending against one of the owners of Caffrey I.C., Inc., d /b /a Iowa City Fieldhouse (hereinafter "The Fieldhouse "), which related to the willful injury of a bar patron, at the bar, cannot recommend approval of the liquor license renewal application made by The Fieldhouse; and WHEREAS, the ICPD wishes for The Fieldhouse to continue operating while they resolve this ownership issue; and WHEREAS, a six (6) month license is available in lieu of a twelve (12) month license; and WHEREAS, following the completion of the six (6) month license, ICPD and other City staff will again assess whether all owners at that time are "persons of good moral character", which will include a review of their criminal history, any pending criminal charges, and the nature of those convictions and /or charges. NOW THEREFORE, as a condition for the recommended approval of a six (6) month license renewal, The Fieldhouse agrees to withdraw their application for a twelve (12) month license, and re -file for a six (6) month license. The ICPD will recommend approval of the six (6) month license assuming no other problems develop at the Fieldhouse between the execution of this Agreement and the City Council meeting at which the approval will be considered by Council. The Fieldhouse ownership acknowledges that a conviction or pending criminal charge, even at a misdemeanor level, of any then - current owner, may serve as a basis for a denial of The Fieldhouse's liquor license renewal. It is not the building itself that troubles me the most. It was the way the decision came about. As I watched the final work session it seemed that most of the council members were set on their decision a long time ago. None of the council members called upon the expertise of the city's financial advisor or probed Mr. Throgmorton about his expertise in the area of urban planning and design. As a citizen who decided to get actively involved in this civic process, I felt extremely let down by the council member's involvement. I hope as this development moves forward, the council will actively make decisions on expertise and experience rather than business -as -usual justifications. I also sincerely hope the council will thoughtfully critique the Moen proposal and demand ways to make it the most environmentaly friendly and neighborhood centric projec that it can be. I am not a member of the coop but do occasionally shop there. I am however a citizen who values my health and think quality food is essential to everyone. The fact that the council would chose a bowling alley over the Pioneer coop which provides a healthy food option to Iowa City says a lot about the mindset of the council. You had several options that took into consideration the health of the citizens of Iowa City and you ignored it. Like much of our community I was surprised when I heard that most members of City Council voted for Moen's The Chauncey instead of one of the more energy efficient buildings with the New Pioneer Coop as an anchor tenant. While I appreciate the environmental benefit of building up instead of sprawling, many of us are concerned about scale (twenty stories) compared to the rest of the low density commercial neighborhood. The drastic rezoning does not make sense with the Iowa Comprehensive Plan or the current neighbors. Seven of the nine proposals had included New Pioneer Coop as anchor tenant. Thousands of New Pioneer Coop members voted to relocate to the new site out of the flood plain. New Pioneer, a democratic organization with a track record of running profitable business, could expand the store to have more local items and be able to hire more locals full time at good wages and benefits. New Pioneer has donated so much to our community. If thousands voted in the New Pioneer poll, don't you worry that these active community voters will be more careful about who they elect to city councils in the future? I am proud that in Iowa City there is a huge commitment to the environment and that is what I want my TIF to support. I am very concerned that the extreme and chaotic weather that Iowa has been having is a natural result of having such a large increase in heat - trapping gasses that humans add to the air when we burn fossil fuels. If we have more years of flood, drought, and early spring /ruined fruit crops Iowa is going to be in a world of hurt. There seemed to be so much support for the buildings that produced energy through solar power and were highly energy efficient. Lastly, why are the taxpayers of Iowa City and the entire school district affected expected to subsidize another Moen tower? Other projects would borrow less money from the taxpayers and pay back our community sooner. I hoped that the project chosen would prioritize affordable options for housing. I would rather be part of a community that cares for the vulnerable and helps lift up the lowly, not a city where our tax dollars help privilege the already wealthy. The size of the proposed development doesn't bother me, it was the exclusion of the New Pioneer Co -op in favor of... a bowling alley and a movie theater? These aren't very forward- looking choices for a progressive city. I am completely mystified. I hope the Chauncey's developer isn't pulling your strings. As a member of and frequent shopper at the New Pioneer Co -op I was hoping the store would stay downtown. Now that they'll probably have to go elsewhere, I will have one less reason to go downtown. I regret that I am rarely aroused to comment on city issues. I more deeply regret not registering my enthusiasm for the proposals including New Pioneer Co -op with you earlier. Your letter contains a number of inaccuracies, which I would like to correct. They are germane to the way in which changes in zoning are determined in Iowa City. Christian Retirement Services ( Oaknoll) has a policy, which seems benign, of seeking community input before requesting a zoning variance. Such an event was held last spring on May 30 in connection with the then - proposed addition. Your letter characterizes it as a "meeting." It was not a meeting in the normal sense of the term, but an occasion for neighborhood residents to stop by and talk with several Oaknoll representatives, including the director Pat Heiden and the architect, Mark Siebold. Ellen and I were among those who came. On that occasion, I asked Mr. Siebold about my two main concerns: noise from the building's heating/cooling systems, and winter shade (in part because I am serious about energy conservation and rely upon significant solar gain in the winter). As to the former, Mr. Siebold assured me that there would be no ventilation fan or other noise pollution, as the heating /cooling system will be geothermal. As to the latter, he told me that a shade study had been done, which found that my house would not be shaded by their structure in winter. So it is false that "the 'shadow' impact of the Oaknoll project was never raised by neighbors as an issue." What is true, to be sure, is that I did not attend the zoning commission meetings and raise the issue there because I had been informed by the architect that the matter had been studied and that there would be no impact. Foolishly, I believed what I was told. On Nov. 14, you sent me a letter informing me of a minor zoning modification being requested by Oaknoll to permit a somewhat higher roof line on part of the building. A bit worried, and not knowing where height would be added (which proved immaterial), I then made some measurements and did the shadow calculations myself for my house, a quite simple matter. Making some allowance for an uncertainty of a few feet concerning how tall the Oaknoll structure would be in relation to grade -level at my house, I discovered that, in fact, my house will be largely engulfed by Oaknoll's shadow for roughly three late- fall /winter months. Attending the Nov. 28 meeting with Ellen, Mr. Siebold, and a representative of the zoning commission (whose name I've forgotten), I asked Mr. Siebold whether a shade study had been done. This time, he denied it. According to your Dec. 28 letter to Ellen, Mr. Siebold added that the building will in any case be only "about the same height" as the trees Ellen has growing along her south property line. There is only one such tree, and it is deciduous, casting little shade when the leaves are gone. In any event, there's some irony in the fact that, a year and a half ago, I cut down a line of spruce and hemlocks along my south fence line that had grown to about 50 feet — because they were shading my house in winter. Now I mourn the loss of a visual screen. Others besides me may notice a certain inconsistency in Mr. Siebold's statements about a shade study, and between what I was told and the facts concerning shading of my house. You note, correctly and obviously, that Oaknoll "has the legal right to proceed with the project as approved." It appears that they also have the legal right to misinform neighbors so as to forestall objections and obstacles to the re- zoning process. My question to you and to the City Council is: how effective can open- meeting and public -input policies be in assuring fair decisions, when builders and developers can mislead the public with apparent impunity? One of our Sycamore 12 theatre guests lodged a complaint with the city because of our policy regarding "R" rated movies and minors. Skipping the legalize, the commission has informed us that we are in violation of the Iowa City Public Accommodation Ordinance in that we do not allow children under the age of six to attend "R" rated movies. Having little conception of the law, I am certain that Marcus Theatres, Iowa City government representatives and the vast majority of Iowa City residents, are all interested in what is reasonable and prudent regarding this very timely issue. I use a wheelchair. I used to use SEATS for going to work and Doctors appointments and meetings and socializing. I no longer work, but now I take classes at the Senior Center. You may or may not need a wheelchair, but I can guarantee that if you are fortunate you will get old. Frailty may impede access to other forms of transportation. SEATS is a vital service for our community. It allows individuals to participate more fully in their community. I encourage the representatives of all our local governments to negotiate a new contract for SEATS that does not deprive the disabled and elderly from participation in life outside their homes. It has also come to my attention that the City of Iowa City is planning a monetary contribution of whatever type in the range of fifteen million to a local entrepreneur so that matching funds can be obtained from financial institutions with the objective of building a twenty four story building in downtown Iowa City. SEATS, which is to my understanding a not for profit or nonprofit paratransit system that serves the elderly, and disabled many of whom are frail and use assistive devices to get around. The disabled of any age who fall within guidelines of SEATS may have invisible and visible disabilities and may also have concomitant medical conditions and mobility devices can use the door to door service as well. . Many elderly and disabled individuals already utilize the municipal transit system as much as they can especially during non -peak hours and utilize their senior, low income (of any ability) disabled passes. Where are they going? Where are you who do not use SEATS going? To a movie at Sycamore Mall, out to CoralRidge Mall and surrounding businesses to shop, or to do so in either cities downtown. They go to the dentist, have to be seen by their medical doctor and all the supplemental appointments for health required such as rides to physical therapy. They go to work, to classes at the U, at Kirkwood, at Senior Center, I.C. Recreation Center. They go to visit with friends at coffee shops or to enjoy a brew just as you do. They go to get haircuts, hair styled, They enjoy parks and music festivals.They have packages to mail. Their cats need the vet. Everywhere you go. We go. I am a rider too. SEATS provides a door to door service for these individuals that is safer and more expedient. The driver makes sure that you safely embark and disembark. Often carrying packages to the door or lending you an arm. Your bus driver can not do that. Nor can a friend's car or a taxi offer this. Alone using a taxi service in a manual wheelchair unless the wheelchair will fit in the trunk, its rider can transfer alone into the seat and negotiate the precise details of their residence or(at least one taxi service has offered to obtain the training and vehicles with the city's approval of the grant) destination..If you drive or walk consider the number of errands, classes, services you attend and imagine doing it when the only transportation available to you is non existent.. Why are funds available out of whichever pot the city takes it to provide for high rise buildings in a city of this size not available for transportation which enhances quality of life of all its citizens? There are enough things the City of Iowa City falls short on such as low to moderate income housing, and from all appearances allowing certain areas to be designated either student ghettos or ghettos for those of color, of differing income levels, and allowing infrastructure departments such as Housing & Inspection to suit the needs of better heeled entrepreneurs some of whom still seek the city's financing; while dropping services the many need. Isn't it bad enough that the University of Iowa Hospitals and Clinics has chosen to cease transportation of citizens to save a million dollars while continuing its incessant building which always costs several million? We pay for that too. Tell me, what is more important in a city you want to live in- parks, shade trees with wildlife and grass for all to enjoy, libraries, recreation facilities that recognize the needs of all its citizens.whatever their intellectual capacity, number of limbs, religion or income? Pause a moment.. Do any of you remember summer evenings in the Ped Mall listening to others playing music and view people dancing spontaneously? I do. Or is it more important to have a city where half empty buildings block the light but do not provide shade? Is a city's responsibility to meet the needs of all its citizens to purchase foodstuffs, enjoy the goodness of the earth in parks, read the books in place and meet the varying requests in our libraries, taking one's ease at home and the ability to expand one's mind and soul through classes, music, fishing? Without SEATS those who use the service and need it are not allowed the same access as those who have yet to reach the time of sickness, old age, or disability. The quality of a city lies, I believe lies in its efforts to care for the souls, it harbors than to meet the profit of a few. I believe in the diversity of the population and the encouragement of more and more green space. I believe that the qualities of its services is how one should measure a city.. SEATS is a necessary and vital service. If anything I would like to see an expansion of public transport not a reduction. Who and how are these cities prepared to meet the needs of the users of paratransit? Are the cities ready to build a paratransit service when one already exists? I have also witnessed Seats in action serving people with a diversity of disabilities in a responsible and respectful manner. Unfortunately we are now at a crossroads where the contract for Seats funding is up at the end of June and the City and Johnson County are again struggling to pay for a federally mandated paratransit service. Basically, Johnson County wants Iowa City and Coralville to pay it's fair share. I believe that TIF monies have been used for other projects and most significantly the million dollar high rise in downtown Iowa City. The people of Iowa City and Johnson County pay a high amount of taxes to live and enjoy this progressive and diverse community. Having appropriate transportation services is paramount to ensure that persons with disabilities can continue to contribute to the diversity here and enjoy the perks of living in the Iowa City / Coralville area. Currently Seats is providing close to 500 trips a day and the requests for trips is growing. History has shown that the users of Seats will not succumb to a privatization of paratransit services. Please be wise and support a transportation service that is already working well for the entire community. Remember the old adage: If it isn't broken, don't fix it. On any given Sunday morning, I see a number of busses transporting people to worship services that would be otherwise unatainable on a public system at this time of the week. These same busses provide weekday opportunities to attend concerts, lectures, doctors appointments, wellness classes and social events. I have a fitness business, and over 60% of my classes are geared toward the Older Adult and /or Special Needs Population, many of whom arrive on the SEATS bus. Without this door -to -door service, they would not be able to participate in an important component of their well being — that of fitness. How will Iowa City be able to compete for the Blue Zone Project if you remove the funding for this program? The Blue Zone looks at communities that are proactive in their choices and opportunities for health, wellness and lifestyle for all demographics - all of which will be greatly diminished for this population should they not have SEATS available. Three of the nine components for being a Blue Zone Community include: a sense of belonging, positive social ciricles, and shedding stress, all of which will be affected with the cessation of funding for SEATS. Please think about creative ways to continue SEATS funding. Invite others to join in the process. Iowa City and Coralville need this service. Federal law requires municipalities with fixed route bus systems to also provide Para transit services. Historically the county has subsidized these services in Iowa City (about $500,000) and Coralville (about $100,000), but have announced plans to reduce this subsidy in the coming year and eliminate it in two years. The county SEATS program with Johnson County expires in the summer. Established over 40 years ago, this is a county government department that provides Para transit services throughout the county. Rides are provided to elderly folks and people with disabilities who would otherwise be unable to take the fixed route bus systems. Eligibility: In Iowa City, Coralville, North Liberty and University Heights eligibility to be a SEATS customer is determined by each communitys transit system based on the Americans with Disabilities Acts guidelines and categories. Usage: Many of the riders have no way to get out except by SEATS. While there are some trips where riders do get out socially, most use it in order to get to needed medical appointments and for seriously disabled individuals to get to employment such as Goodwill. Trained staff: Some examples of SEATS trained staff stepping up above and beyond daily driving to make sure customers cared for: • SEATS saved a couple's life out in the Lone Tree area when they got carbon monoxide poisoning. Staff knew not to leave the house and dismiss it a missed ridebecause the couple had never missed a ride before. • SEATS staff located a lady with Alzheimer's who was missing for a day because of dispatch sending out a message to all drivers and a driver recognizing her wandering down a street. • On multiple occasions SEATS has had drivers perform CPR and call an ambulance because they recognized that the person was not reacting normal. • SEATS scheduling staff, who have worked with the different riders for years, know exactly what specific customers with communication handicaps are requesting. • A severely life -long mentally handicapped man in his late 40s and alone at his home was to be transported to his Goodwill job by SEATS. When he didnt come out of the house, the driver checked, found him on the floor, called an ambulance. Unfortunately the mans heart attack was fatal despite this, but he was not left to die alone and lay dead in his home till found something much appreciated by his grieving mother. To change a system with all new drivers and schedulers would not only cause mass confusion but it will disrupt many of the riders whose stability rests in a routine life without huge changes in their lives. All of these things add up to a safe environment that is not cheap, but in paratransit standards is made less expensive and highly efficient via keeping costs down by having a shared service centrally located for fueling, repairs, driver coordination, and where one call can be placed for someone to take multiple trips to where needed in Johnson County. I believe that supporting SEATS in its present state is best economically for everyone and hope that you can find a way to make sure this needed (and federally required) service continues as is. My late husband, #tpgeE"4:isl who died Aug. 26 of last year, was a passenger of the SEATS: bst ' service for about two years. He had been the manager of the 'oraaille Transit- System for 25 years-, a CTS driver for the 6 years before that. The following narrative presents the reasons I am advocating Iowa City and Coralville financial support for the Johnson County SEATS system. Roger started showing signs of Alzheimer's, the illness that would take his life from him by age 72, when he was just 61. At 62 the problems necessitated his early- By 63 the diagnosis became certain, and within just a few years t realized that i could not keep him at home all day every day. Luckily, I was able to get him to the excellent Pathways Adult Day Care in Iowa City, where he soon spent all day 5 days a week. At first I. drove him over there in the morning, then came to retrieve him in the late afternoon - -I spent nearly 2 hours on the road those days. Then the Pathways leaders suggested that he ride the SEATS bus home. This proved to be a great suggestion, as the SEATS drivers kept him safe and happy en route, and I got one more precious hour in which to get my work done. Rog. rode the SEATS bus. for nearly every weekday thereafter from. Pathways for two years, by which time he had gone downhill enough to warrant his move to Legacy Gardens dementia carte facility. Even years thereafter, when a SEATS bus was driven down our street, the driver would wave "hello ", remembering the Coralville resident whom the driver brought home from Iowa City. The Johnson County SEATS system deserves all the financial support you can allocate for itM The system is extraordinarily well coordinated, the drivers are very well trained, always courteous and. protective of the most vulnerable passengers, who have physical and /or mental disabilities. The SEATS system and the service it provides is working extremely wellM! PLEASE don't mess with successM! You CANNOT provide a comparable level of coordinated, efficient and courteous service for less money than Johnson County is seeking from you!!! l plead with you to do what it takes to keep this great service running just as it is right now!! Regular buses that permit roll -on wheelchairs are no substitute: they do not go everywhere, their schedules may leave people in wheelchairs in the rain, freezing conditions (both of which harm the wheelchairs as well as the person who uses them) or heat - stroke inducing heat. One has to be very unaware of the actual conditions of persons with disabilities (or very mean - spirited) to think this is a good thing to cut or restructure! Katherine H. My Mother is close to 95 years of age, and The Seats Program, with their professional staff and caring personnel, make it possible for her to have great dignity to her life, by assisting her to necessary appointments and recreational opportunities to thrive well, be independent and have joy in her life. The transition was nearly seemless and she trusts and cares for the drivers, as they also care for her. They take her grocery shopping, to medical appointments, to the Senior Center to play bridge, and shopping. Without them, she wouldn't be able to get out into the community as much as she is able to now. They are kind, caring, and extremely patient with the elderly and those that need a little extra time and attention. We, as her family, can relax and feel confident in her safety knowing that she is in good hands with the caring SEATS staff. The services SEATS provides are a lifesaver for so many. In addition, SEATS is a major transporter of many of the patients I see at the hospital. Once again, without this service, many of these people would be without transportation from a service provided by people that care. Doing away with this service would be a detriment to our community and to servicing the elderly and those that need this type of special help. PLEASE do not get rid of this service and /or change it into something that doesn't offer the same type of special caring attention that the current service provides. Thank you for considering!! Johnson County SEATS is an integral partner in our pursuit to provide individuals with the highest quality of life possible, including but not limited to personal employment. This employment not only elevates a sense of self -worth, but allows persons, who otherwise would not be able to, to be fiscally productive in our society. If we are talking budget "equity" here, why not take a closer look at governmental contributions to -- say, the Airport, which tends to be serving pretty much the opposite end of the socioeconomic spectrum? The socioeconomically just and expedient action, if any, should be to INCREASE the support for SEATS..... Please bear in mind that many SEATS users are "invisibly handicapped ", yet may be needing the service as much as people with immediately obvious handicaps. Johnson County has been heavily subsidizing the cost of serving these communities, and they can do so no longer. From my work experience, working with individuals with disabilities from Reach, REM Iowa, Goodwill and Systems Unlimited, a loss like this would severely impact the quality of life and independence of these individuals. SEATS allows these clients the independence to safely get to and from their destinations, without 1:1 staff at all times. By ending these services, it would cause agencies to HAVE to provide the services, which in turn would either increase the funding needed for these services within the agencies OR if it could not be funded and it would cause these individuals to not be able to access their community.
