INDEMNIFICATION AGREEMENT
The applicant agrees to:
pay on behalf of the City all sums which the City shall be obligated to pay by reason of any liability
imposed upon the city for damages of any kind resulting from use of public property and the public
right of way, whether sustained by any person or person, caused by accident or otherwise and shall
defend at its own expense and on behalf of the City any claim against the City arising out of the use
of public property and the public right of way.
Applicant agrees to provide the City with a certificate of insurance by the last working day before placing the
landscaping container on the sidewalk or in City Plaza. Applicant agrees to follow the rules listed on the following
page.

RULES
1. The container must contain live plant material used strictly for ornamental purpose.
2. Container must be within two inches of the building at all times.
3. Container cannot include any advertising.
4. If the container is a wagon, the wagon handle must remain in a vertical position.
5. No more than two containers allowed.
6. Containers may only be displayed on the sidewalk or City Plaza from 10:00 a.m. to 10:00 p.m. to facilitate
City cleaning efforts.
