ITEM 3d. Resolutions and Motions:
ITEM 3d(1) HOUSING EXTERIOR LOAN PROGRAM - RESOLUTION AUTHORIZING
THE CITY MANAGER TO SIGN LOAN AGREEMENTS FOR THE HOUSING
EXTERIOR LOAN PROGRAM (HELP).
Comment: Last November Council amended the code to better address
exterior housing code issues as one way to foster healthy neighborhoods
and support a strong urban core. Also, Council has directed staff to
increase enforcement of the Housing Code in the University impacted
neighborhoods. In response, staff created the Housing Exterior Loan
Program (“HELP”) to assist qualified homeowners and landlords with
exterior improvements. Loans will cover one-half of the costs of the
eligible improvements, up to a maximum of $10,000 at 0% interest. For
rental property owners, repayment terms will be for 5 years, and for
income eligible homeowners, the loan will be a deferred payment loan,
payable when the home is sold or no longer owner occupied. This
resolution authorizes the City Manager to enter into HELP agreements.
ITEM 3d(2) FIREWORKS AGREEMENT WITH UNIVERSITY – RESOLUTION
APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN
THE CITY AND THE UNIVERSITY OF IOWA REGARDING THE 2016
INDEPENDENCE DAY FIREWORKS DISPLAY.
Comment: This resolution will approve the Memorandum of
Understanding developed by the City and the University to facilitate the
City’s Independence Day fireworks display on July 3rd. The display will
take place at the University’s Hubbard Park, with their permission and
assistance.

ITEM 3d(3) CONSENT AGREEMENT WITH EPA - RESOLUTION APPROVING
A CONSENT AGREEMENT WITH THE UNITED STATES
ENVIRONMENTAL PROTECTION AGENCY REGARDING THE
IOWA CITY SANITARY LANDFILL
Comment: The EPA conducted an inspection of the landfill on July 15,
2014 and found violations of the Clean Air Act and its implementing
regulations regarding the gas collection systems of sanitary landfills.
Following additional documentation provided by the City, the EPA issued a
Notice of Violation to the City on September 3, 2015. City staff has
implemented or is in the process of implementing a number of measures to
address the violations, which have been approved by EPA. In addition,
the EPA has accepted the City’s proposal to do a Supplemental
Environmental Project (SEP) in-lieu of a portion of the fine. The Consent
Agreement documents the corrective measures to be implemented, the
SEP project and the remaining $8,225.00 fine.
ITEM 3d(4) MERCER PARK PLAYGROUND REPLACEMENT - RESOLUTION
ACCEPTING THE WORK FOR THE MERCER PARK PLAYGROUND
REPLACEMENT PROJECT.
Comment: The project has been completed by Dostals Construction
Company of Gretna, Nebraska, in substantial accordance with the plans
and specifications. The Engineer’s Report and Performance and
Payment bonds are on file with the City Clerk.
Project Estimated Cost: $ 200,000.00
Project Bid Received: $ 247,500.00
Project Actual Cost: $ 247,500.00
ITEM 3d(5) BY-LAW CHANGES – MOTION TO FORWARD TO COUNCIL RULES
COMMITTEE BY-LAW CHANGES FOR THE AIRPORT COMMISSION,
COMMUNITY POLICE REVIEW BOARD, HISTORIC PRESERVATION
COMMISSION, PLANNING AND ZONING COMMISSION AND
TELECOMMUNICATION COMMISSION.
Comment: At Council orientation in November 2015 staff outlined a
process for individuals to apply for multiple Boards and Commissions at
one time, retain applications for a longer period, and Council
appointments be made twice a year. In order to group vacancies to
provide for appointments twice a year it is necessary to modify terms of 5
current Boards and Commissions. A Rules Committee meeting will be
held prior to the June 21 Council meeting and resolutions adopting new
bylaws will be considered at that time.

ITEM 3d(6) APPROVAL OF FLOOD BUYOUT APPLICATION - RESOLUTION TO
SUBMIT A HAZARD MITIGATION GRANT PROGRAM APPLICATION
TO PURCHASE PROPERTY IN THE 100-YEAR FLOODPLAIN,
PROVIDE THE 25% REQUIRED LOCAL MATCH AND AUTHORIZE
THE CITY MANAGER TO SUBMIT AND SIGN ALL CONTRACTS AND
AMENDMENTS FOR SAID PROGRAM.
Comment: The State of Iowa has notified staff that additional FEMA
disaster funding under the Hazard Mitigation Grant Program (HMGP) may
be available. Staff has identified two (2) residential properties in the
Ralston Creek flood plain for acquisition, and the homeowners have
expressed an interest in selling to the City. This resolution authorizes the
City Manager to sign a grant application and grant agreement and it
commit the City to providing 25% of the costs which can include in kind
contributions. The proposed budget is $535,544 for acquisition and
demolition, which means a commitment by the City of $133,886.
ITEM 3d(7) PARKING GARAGE MAINTENANCE PROGRAM 2015 -
RESOLUTION AWARDING CONTRACT AND AUTHORIZING
THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A
CONTRACT FOR CONSTRUCTION OF THE CITY OF IOWA
CITY PARKING GARAGE MAINTENANCE PROGRAM 2015
PROJECT.
REVISED COMMENT: Bids for this project were opened on Thursday,
June 2, 2016, and the following bid was received:
Western Specialty Contractors West Des Moines, IA $ 361,066.45
Engineer's Estimate $ 331,422.00
Public Works and Resource Management recommends award of the
contract to Western Specialty Contractors, West Des Moines, IA. The
project will be funded from the Parking Facility Restoration Repair
account # T3004.
Comment: Bids for this project will be opened at 2:30 p.m. on Thursday,
June 2, 2016, a blank resolution is included in the packet at this time.
ITEM 3d(8) 2015 SEWER REPAIR - RESOLUTION APPROVING THE FINAL
CONTRACT PRICE FOR THE 2015 SEWER REPAIR PROJECT.
Comment: The final cost of this project was incorrectly included in the
resolution and on the agenda accepting the project on May 3, 2016. This
resolution corrects the final contract price to $142,427.22.
ITEM 3d(9) PROCUREMENT OF CAB AND CHASSIS TRUCKS - RESOLUTION
AUTHORIZING THE PROCUREMENT OF TWO (2) CAB AND CHASSIS
TRUCKS FOR THE STREETS DIVISION.
Comment: This resolution will approve the procurement of two (2) new
Freightliner medium duty cab and chassis trucks. Request for Bid #16-277
was solicited for this purchase. The total purchase cost will be
$161,945.00, which exceeds the $150,000.00 spending authority of the
City Manager, and so requires Council approval.

ITEM 3d(10) ASPHALT RESURFACING PROJECT 2016 - RESOLUTION
RESCINDING RESOLUTION 16-117 AND AWARDING CONTRACT AND
AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO
ATTEST A CONTRACT FOR CONSTRUCTION OF THE ASPHALT
RESURFACING PROJECT 2016.
Comment: Bids for this project were opened on Thursday, April 21,
2016, and the following bid was received:
L.L. Pelling Company North Liberty, IA $ 975,732.56
Engineer's Estimate $ 1,177,000.00
Following award of the contract at the May 3rd council meeting, an error
was noted in the resolution. This resolution rescinds the original
resolution 16-117 and includes Public Works and Engineering
recommendation to award the contract to L.L. Pelling Company of North
Liberty, Iowa. The project will be funded with Road Use Tax proceeds
and GO bonds.
ITEM 3e Setting Public Hearings:
ITEM 3e(1) AMENDING DOWNTOWN URBAN RENEWAL AREA PLANS -
RESOLUTION DETERMINING THE NECESSITY OF AND SETTING
DATES OF A CONSULTATION (June 23) AND PUBLIC HEARING
(July 19) ON A PROPOSED AMENDMENT NO. 14 TO THE CITY-
UNIVERSITY PROJECT I URBAN RENEWAL PLAN IN THE CITY OF
IOWA CITY, IOWA
Comment: This Resolution of Necessity is the first step to amend an
Urban Renewal Plan. The amended plan adds land to the City-University
Project 1 Urban Renewal Area, specifically, Block 44 of the original Iowa
City plat, the block on which City Hall and the former Unitarian
Universalist Church are located. The objective of this amendment is to
allow for the future contemplation of a public/private partnership involving
all or part of the amended area for the potential preservation of a historic
structure, expansion of the fire station, municipal offices, parking facilities,
and residential or commercial uses.
ITEM 3e(2) 2016 LANDFILL GAS COLLECTION SYSTEM EXPANSION PROJECT
– RESOLUTION SETTING A PUBLIC HEARING ON JUNE 21, 2016 ON
PLANS, SPECIFICATIONS, FORM OF CONTRACT AND ESTIMATE
OF COST FOR THE CONSTRUCTION OF THE 2016 LANDFILL GAS
COLLECTION SYSTEM EXPANSION PROJECT, DIRECTING CITY
CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING
THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC
INSPECTION.
Comment: This project consists of expanding the existing landfill gas
collection system to cover recently constructed landfill cells along with
improving the system to capture more landfill gas in accordance with
State and Federal landfill regulations. The estimated base construction
cost is $840,000 with possible alternate costs of $245,000 for a possible
total cost of $1,085,000 and will be funded by landfill revenues.

ITEM 3e(3) ZONING CODE AMENDMENT, INCLUSIONARY HOUSING
ORDINANCE – MOTION SETTING A PUBLIC HEARING FOR JUNE 21
ON AN ORDINANCE AMENDING CITY CODE SECTION 14-2G TO
ADOPT A RIVERFRONT CROSSINGS INCLUSIONARY HOUSING (IH)
ORDINANCE.
Comment: At its May 19 meeting, by a vote of 6-0 (Freerks absent), the
Planning and Zoning Commission recommended approval of this zoning
code amendment. The purpose of the ordinance is to ensure that a
minimum percentage of new housing units constructed in the Riverfront
Crossings District are affordable to households with limited incomes.
ITEM 3e(4) ZONING CODE AMENDMENT, COMMUNITY SERVICE LONG TERM
HOUSING – MOTION SETTING A PUBLIC HEARING FOR JUNE 21
ON AN ORDINANCE AMENDING CITY CODE TITLE 14, ZONING
CODE, TO ESTABLISH A NEW USE, COMMUNITY SERVICE – LONG
TERM HOUSING, AND ESTABLISHING PARKING, DENSITY, AND
PROVISIONAL AND SPECIAL EXCEPTION CRITERIA FOR SAID USE.
Comment: At its May 19 meeting, by a vote of 6-0 (Freerks absent), the
Planning and Zoning Commission recommended approval of this Zoning
Code amendment. This amendment will add a definition and associated
development standards for long-term multi-family housing that is
managed by a public or non-profit agency for persons with disabilities.

ITEM 5a VACATION OF WATERFRONT DRIVE – ORDINANCE VACATING THE
WATERFRONT DRIVE PUBLIC RIGHT-OF-WAY (VAC15-0007). (PASS
AND ADOPT)
Comment: At its January 21 meeting, by a vote of 6-0 (Freerks absent),
the Planning and Zoning Commission recommended approval of an
application submitted by Equity Ventures for the vacation of an
approximately 13,454 square feet of Waterfront Drive running east-west
between 1402 and 1411 Waterfront Drive located in the southeast corner
of Highway 6 and S. Gilbert Street, subject to a final plat being approved
for the property including plans for access, and relocation of utilities.
(VAC15-00007) A final plat was not yet received for the property, and
staff recommends deferral to the May 17 meeting; and deferred to the
June 6 to allow a public hearing be held on conveyance.

ITEM 5b CONVEYANCE OF VACATED WATERFRONT DRIVE - RESOLUTION
TO CONVEYANCE A PORTION OF VACATED WATERFRONT DRIVE
RIGHT-OF-WAY WITHIN SOUTHGATE ADDITION, PART 1.
Comment: City Council is considering the vacation of this right-of-way to
accommodate redevelopment of the adjacent land at the corner of Highway
6 and South Gilbert Street. The developer would like to acquire this
property and incorporate it into its redevelopment. State law requires that
the City be paid fair market value for these property rights. Based upon an
examination of the assessed value of adjacent property, the cost of
relocating the sewer contained within this area, and the value of the Gilbert
Street right-of-way the applicant has agreed to dedicate to the City, Staff
finds that fair market value for this conveyance is $79,312.80, and thus
recommends approval of this offer.

ITEM 5c. SOUTHGATE ADDITION, PART TWO – RESOLUTION APPROVING
FINAL PLAT (SUB16-00005)
Comment: This final plat is a re-subdivision of Southgate Addition, Part 1
and auditor’s parcel 99006 into an approximately 3.07 acre, 3-lot
commercial subdivision. This subdivision will facilitate commercial
redevelopment of the subject properties through reconfiguration of the
lots and associated public rights-of-way, and parking aisles and drives.
Staff recommends approval of the final plat subject to approval of legal
papers and construction drawings by the City Attorney and City
Engineer. It is anticipated that legal papers and construction drawings will
be approved prior to the June 6 City Council meeting.

ITEM 6. NUISANCE PROPERTY SALE, 1504 YEWELL STREET - RESOLUTION
AUTHORIZING CONVEYANCE OF A SINGLE FAMILY HOME LOCATED AT 1504
YEWELL STREET.
Comment: The property at 1504 Yewell Street was declared a nuisance and acquired
by the City for $60,000 through condemnation. State law requires the City to convey
the property to a buyer that will either rehabilitate it or demolish it and construct a
new house. The City has entered into an agreement for the sale of 1504 Yewell
Street in the amount of $71,000. This sale will best reimburse the City for the
expenses incurred.

ITEM 7. PURCHASE AGREEMENT FOR CITY HALL NORTH PARKING LOT -
RESOLUTION APPROVING PURCHASE AGREEMENT BY AND BETWEEN THE
CITY OF IOWA CITY AND ASPEN VENTURES, LLC FOR THE CITY PROPERTY
TO THE NORTH OF CITY HALL THAT IS CURRENTLY USED AS A PARKING
LOT.
Comment: Aspen Ventures proposes to purchase the property to the North of City
Hall for the development of multi-family residential housing, office space, a multi-
story parking facility, and a fire station for use by the City. The City Manager has
signed a Purchase Agreement that is contingent on City Council approval as well as
the execution of a mutually-agreeable Developer’s Agreement. The purchase price
is for the current appraised value of $3,330,000 and may be adjusted by the parties
to reflect any public benefits negotiated in connection with the Development
Agreement.

ITEM 8. WORKFORCE HOUSING TAX CREDITS - RESOLUTION IN SUPPORT OF THE
APPLICATION OF IOWA CITY SENIOR, LLC FOR THE WORKFORCE HOUSING
TAX INCENTIVES PROGRAM FROM THE IOWA ECONOMIC DEVELOPMENT
AUTHORITY TO CONSTRUCT SENIOR RENTAL HOUSING AT 1030-1070
WILLIAM STREET AND COMMITTING LOCAL FUNDS TO THE PROJECT.
Comment: Iowa City Senior, LLC. is applying for Workforce Housing Tax Incentives
from the Iowa Economic Development Authority (IEDA) to assist financing the
construction of up to 40 mixed income residential units for seniors 55 and older. As
part of its application, the developer needs a resolution by the local governmental
subdivision supporting the application and committing at least $1,000 per dwelling
unit to this project. Previously, the City committed to a local contribution of $600,000
for this project at their October 20, 2015 City Council meeting. No additional funds
are necessary for the application to IEDA.

ITEM 9. WORKFORCE HOUSING TAX CREDITS - RESOLUTION IN SUPPORT OF THE
APPLICATION OF MONARCH LLC FOR THE WORKFORCE HOUSING TAX
INCENTIVES PROGRAM FROM THE IOWA ECONOMIC DEVELOPMENT
AUTHORITY TO CONSTRUCT RESIDENTIAL HOUSING AT 7 S. LINN STREET
AND COMMITTING LOCAL FUNDS TO THE PROJECT.
Comment: Monarch LLC is applying for Workforce Housing Tax Incentives from the
Iowa Economic Development Authority to assist financing the construction of up to
72 residential dwelling units. The applicant anticipates that all the proposed housing
units will qualify under this program. As part of its application, the developer needs a
resolution by the local governmental subdivision supporting the application and
committing at least $1,000 per dwelling unit to this project (at least $72,000 for 72
assisted housing units). This resolution also authorizes the City Manager to enter
into a funding agreement with Monarch LLC.

ADDITION OF NEW ZONE LOCATION - CONSIDER AN ORDINANCE AMENDING
SECTION 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC," CHAPTER 3,
ENTITLED "RULES OF THE ROAD," SECTION 6, ENTITLED "SPEED
RESTRICTIONS", SUBSECTION C, ENTITLED “SCHOOL SPEED ZONES” TO
CREATE A 20 MPH SCHOOL SPEED ZONE FOR ALEXANDER ELEMENTARY
SCHOOL AND TO EXPAND THE HOURS DURING WHICH REDUCED SPEED IS
IN EFFECT IN ALL SCHOOL SPEED ZONES. (FIRST CONSIDERATION)
Comment: Iowa City Code Section 9-3-6(c) defines school speed zone limits and
does not establish a zone for Alexander School. A reference to “Sycamore Street”
from Lehman Avenue to a point 600 feet north of Daniel Place should be added to
ensure consistency in the application of school speed limit zones on arterial streets
adjacent to elementary schools. Title 9-3-6(c) also defines school speed zone limits
(20 MPH) and the hours during which they are in effect. Currently the code specifies
reduced speeds to be in effect from 8:00 AM until 5:00 PM, Monday through Friday.
Beginning in August, elementary schools will be in session from 7:55 until 2:55 PM. If
adopted the ordinance would expand the hours that School Speed Zones are in
effect to 7:00 AM to 5:00 PM. All speed zone signage will be updated to reflect this
change.

ITEM 11. AMENDMENTS TO TAXICAB REGULATIONS - ORDINANCE AMENDING TITLE
5, ENTITLED “BUSINESS AND LICENSE REGULATIONS," CHAPTER 2,
ENTITLED “TAXICABS," TO ELIMINATE A LOCAL OFFICE, 24/7 SERVICE, AND
INSPECTION OF NEWER MODEL VEHICLES AND TO ALLOW A SURCHARGE
FEE ON CERTAIN DAYS AND NEMT SERVICES. (SECOND CONSIDERATION)
Comment: In response both to HF 2414 which the Governor. signed on May 9, and
the City’s recent adoption of the “Transportation Network Company” (aka, the uber
ordinance), this ordinance eliminates certain requirements and allows business to
charge a new fee and provide Non-Emergency Transportation (NEMT) services.
HF2414 prohibits cities from requiring a taxi company from having a physical place of
business in the locality beginning 1/1/17. This ordinance also eliminates the
requirements that the company provide 24/7 service and City inspection of vehicles
newer than 10 years. Additionally, the ordinance allows for businesses to charge a
flat fee (“surcharge”) on UofI football weekends, UofI graduation weekends, and New
Year’s Eve. Staff intends to revise the administrative rules to allow taxicab
businesses to submit private background checks rather than requiring the drivers to
pay for Dept. of Criminal Investigation reports. Staff requests expedited action.

ITEM 12. TAXICAB FEES - RESOLUTION RESCINDING PRIOR RESOLUTION NO. 15-
36 AND SETTING FEES WITH RESPECT TO THE ADMINISTRATION OF
REGULATIONS FOR NETWORK AND METERED TAXICABS, AND
ESTABLISHING A NEW FEE FOR INSPECTION OF VEHICLES LESS THAN
TEN (10) YEARS OLD.
Comment: This resolution sets a fee of $35 for annual inspection of vehicles
that are ten (10) years old or newer for color scheme, taximeter, lighted dome,
and lettering only; and sets $15 credit for returned decals. No other changes in
fee amounts are being made.
