Resolutions and Motions: ITEM 2d(1) 2016 DERWEN DRIVE PAVEMENT REHABILITATION AND DRAINAGE TILE INSTALLATION - RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR CONSTRUCTION OF THE 2016 DERWEN DRIVE PAVEMENT REHABILITATION AND DRAINAGE TILE INSTALLATION PROJECT. (Revised) Comment: Bids for this project were opened on Thursday, August 12, 2016, and the following bids were received: All American Concrete, West Liberty, IA $ 91,798.00 Yordi Excavating, Cedar Rapids, IA $ 92,821.50 Rogers Construction, Iowa City, IA $ 138,640.00 Engineer's Estimate $ 110,000.00 Public Works and Engineering recommend award of the contract to All American of West Liberty, IA. The project will be funded with Stormwater revenues. The project will be funded with Stormwater revenues. Comment: Bids for this project were opened on Thursday, August 11, 2016. Staff is reviewing the bids and a recommendation for award will be presented to Council at the Council meeting on Tuesday, August 16th. The estimated cost of construction is $110,000 and will be funded with Stormwater revenues. ITEM 2d(2) 2015 SEWER REHABILITATION - RESOLUTION ACCEPTING THE WORK FOR THE 2015 SEWER REHABILITATION PROJECT. Comment: The project has been completed by Municipal Pipe Tool Company of Hudson, Iowa, in substantial accordance with the plans and specifications. The Engineer’s Report and Performance and Payment bonds are on file with the City Clerk.  Project Estimated Cost: $ 300,000.00  Project Bid Received: $ 215,368.70  Project Actual Cost: $ 274,184.85 August 16, 2016 City of Iowa City Page 3 ITEM 2d(3) SILVER SLOPE, PART TWO - RESOLUTION ACCEPTING THE WORK FOR THE STORM SEWER, SANITARY SEWER, WATER MAIN, AND PAVING PUBLIC IMPROVEMENTS FOR SILVER SLOPE - PART TWO, AND DECLARING PUBLIC IMPROVEMENTS OPEN FOR PUBLIC ACCESS AND USE. Comment: The project has been completed by JDM Concrete of Kalona, Iowa, in substantial accordance with the plans and specifications. The Engineer’s Report and Performance and Payment bonds are on file in the City Engineer’s office.  Project Estimated Cost: $ 100,500.00  Project Bid Received: $ 78,117.44  Project Actual Cost: $ 63,801.28 ITEM 2d(5) FIBER INFRASTRUCTURE, IOWA CITY SOUTH PART 1, DUCT INSTALLATION - RESOLUTION ACCEPTING THE WORK FOR THE FIBER INFRASTRUCTURE - IOWA CITY SOUTH PART 1 - DUCT INSTALLATION PROJECT. Comment: This project replaced damaged duct and add a redundant cable route to multiple City facilities on the South side of Iowa City. The project has been completed by Slabach Construction of Kalona, Iowa, in substantial accordance with the plans and specifications. Comment: See Engineer’s Report. ITEM 2d(8) PROCUREMENT OF WATER METERS - RESOLUTION AUTHORIZING THE PROCUREMENT OF WATER METERS FOR FISCAL YEAR 2017. August 16, 2016 City of Iowa City Page 4 Comment: This Resolution will approve the procurement of water meters needed for utility billing for miscellaneous sizes of water meters needed for new home/business installation and meter repairs from Ferguson Waterworks for $186,000. This purchase exceeds the $150,000 spending authority of the City Manager, and so requires Council approval. Funds are available in account #7373014. ITEM 2d(9) CONDITIONAL USE PERMIT - RECOMMENDATION TO JOHNSON COUNTY 4522 TAFT AVENUE SE (CZ16-00002) Comment: At its August 4 meeting by a vote of 7-0 the Planning and Zoning Commission recommended forwarding a letter to the Johnson Planning and Zoning Commission recommending approval of a Conditional Use Permit to allow a tree trimming and removal business located at 4522 Taft Avenue SE in Area B of the Iowa City/Johnson County Fringe Area. (CU16-00003) ITEM 2d(10) DESIGN, PRODUCTION, AND MAILING OF CITY BILLS AND WEB SERVICE - RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE RENEWAL OF A CONTRACT FOR DESIGN, PRODUCTION, AND MAILING OF THE CITY OF IOWA CITY UTILITY BILL, LANDFILL BILL, ACCOUNTS RECEIVABLE BILL, ENVELOPES, AND WEB SERVICE FOR ONE ADDITIONAL YEAR. Comment: The original contract with SourceHov was for services through September 2014. This contract was extended for an additional 2 years through September 2016. This resolution will allow the services to be extended for the additional year through September 2017. ITEM 2d(11) MAYORS’ MONARCH PLEDGE - RESOLUTION AUTHORIZING MAYOR TO SIGN MAYORS’ MONARCH PLEDGE. Comment: The Mayors’ Monarch Pledge shows the City’s support in helping the declining population of the Monarch buttery. The pledge also commits the city to action items in the upcoming year towards monarch conservation efforts. ITEM 2e. Setting Public Hearings: ITEM 2e(1) SYCAMORE STREET AND LOWER MUSCATINE ROAD LANDSCAPE IMPROVEMENTS – RESOLUTION SETTING A PUBLIC HEARING ON SEPTEMBER 6, 2016 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE SYCAMORE STREET AND LOWER MUSCATINE ROAD LANDSCAPE IMPROVEMENTS PROJECT 2016, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project involves street tree installation along Lower Muscatine Road from Kirkwood Boulevard to First Avenue, and along Sycamore Street from Lower Muscatine Road to Lehman Avenue. The project also includes landscape installation for (2) roundabouts installed in 2015 along Sycamore Street. The estimated cost for this project is $261,368.84 and will be funded with Road Use tax proceeds. August 16, 2016 City of Iowa City Page 5 ITEM 2e(2) EASTSIDE MIXED USE FORM-BASED CODE – MOTION SETTING A PUBLIC HEARING FOR SEPTEMBER 6 ON AN ORDINANCE AMENDING TITLE 14: ZONING TO ESTABLISH FORM-BASED ZONING STANDARDS FOR THE EAST SIDE MIXED USE ZONE AND TO CLARIFY AND REFINE CERTAIN PROVISIONS THAT APPLY DOWNTOWN AND IN THE RIVERFRONT CROSSINGS DISTRICT. Comment: At its August 4 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of these zoning code amendments. Approval will establish a new form-based code district to provide a better transition between Downtown Iowa City and the residential neighborhoods to the east. In addition, amendments will clarify and refine the language to improve certain provisions of the Riverfront Crossings form-based code; adjust parking requirements and apartment mix standards to encourage student housing in areas abutting the University campus and encourage housing for a broader mix of populations throughout Riverfront Crossings and the Eastside Mixed Use Districts; and ensure that zoning requirements for exterior lighting are applied in the Riverfront Crossings and Eastside Mixed Use Districts. ITEM 2e(3) REZONING TO EAST SIDE MIXED USE (EMU) – MOTION SETTING A PUBLIC HEARING FOR SEPTEMBER 6 ON AN ORDINANCE REZONING MULTIPLE PROPERTIES ENCOMPASSING PORTIONS OF THE 500 BLOCKS OF IOWA AVENUE, COLLEGE STREET, WASHINGTON STREET AND BURLINGTON STREET FROM CENTRAL BUSINESS SUPPORT (CB-5), CENTRAL BUSINESS SERVICE (CB-2) AND NEIGHBORHOOD STABILIZATION RESIDENTIAL (RNS-20) TO EASTSIDE MIXED USE (EMU) (REZ16- 00006). Comment: At its August 4 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of this rezoning. Approval will rezone all properties located within the new Eastside Mixed Use District so that the form-based code will apply when redevelopment occurs in this transitional area between Downtown Iowa City and neighborhoods to the east. ITEM 2e(4) HEBL AVENUE IMPROVEMENTS - RESOLUTION AUTHORIZING MAILING AND PUBLICATION OF NOTICE OF THE CITY’S INTENTION TO PROCEED WITH FUNDING FINAL DESIGN AND PROPERTY ACQUISITION FOR THE PROPOSED HEBL AVENUE IMPROVEMENTS PROJECT AND SETTING PUBLIC HEARING THEREON FOR SEPTEMBER 20, 2016. Comment: The City of Iowa City must acquire right-of-way, fee title, permanent easements and/or temporary construction easement to construct the Hebl Avenue Improvements Project. This project consists of the reconstruction of Hebl Avenue from IWV Road to the Landfill and Recycling Center entrance. The project will be funded with Landfill revenues. RIVERSIDE DRIVE AND 103 COMMERCIAL DRIVE – ORDINANCE CONDITIONALLY REZONING APPROXIMATELY 36, 416 SQUARE FEET OF PROPERTY FROM GENERAL INDUSTRIAL (I-1) ZONE TO INTENSIVE COMMERCIAL (CI- 1) ZONE LOCATED AT 2114-2118 S. RIVERSIDE DRIVE AND 103 COMMERCIAL DRIVE. (REZ16-00004) Comment: At its July 21 meeting, by a vote of 4-1 (Signs voting no, Martin and Hensch absent), the Planning and Zoning Commission recommended approval of this rezoning subject to a conditional zoning agreement specifying that vehicle sales will be limited to the west side of the building at 2114-2118 S. Riverside Drive. Approval will allow this property to be used for intensive commercial uses including car repair and sales. (This is one property with six commercial condominiums located on it.) 1. (VAC16-00001) (PASS AND ADOPT) Comment: At its June 2 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of this vacation subject to any necessary utility easements. Approval will allow the property to be added to the adjacent residential lot. The vacation has been requested to allow an addition to the house at 1420 Yewell Street. Action: Adopted, 7/0 _____________________________ ITEM 4c CONVEYANCE OF COTTONWOOD AVENUE - CONVEYANCE OF A PORTION OF COTTONWOOD AVENUE EAST OF YEWELL STREET TO LAURA CROSSETT. Comment: Laura Crossett has requested that the City vacate and convey via quit claim deed that portion of Cottonwood Avenue east of Yewell Street to facilitate an addition to her house. She has offered to pay the City fair market value for this land, as determined by an appraisal, in the amount of $15,000. The owner of the other adjacent property has indicated he is not interested in purchasing any portion of this right-of-way. 1. PUBLIC HEARING Action: Closed _______________________________ 2, CONSIDER A RESOLUTION Action: Approved, 7/0 _________________________ ITEM 4d REZONING JOHNSON COUNTY AMBULANCE AND MEDICAL EXAMINER FACILITY – REZONING PROPERTY LOCATED AT 818 SOUTH DUBUQUE STREET FROM INTENSIVE COMMERCIAL(CI-1) ZONE TO PUBLIC (P-1) ZONE. (REZ16-00005) (SECOND CONSIDERATION) Comment: At its July 7 meeting, by a vote of 5-0 (Freerks absent; Hensch abstained), the Planning and Zoning Commission recommended approval of this rezoning. Approval of the rezoning acknowledges the ownership and use of the property for public purposes. The subject property, along with an abutting property are being developed with a new building that will consolidate the Johnson County Ambulance Center, Medical Examiner’s facility, and provide storage for the Auditor’s Office. Staff requests expedited action. Action: Waived second consideration, 7/0 __________ Adopted, 7/0 __________________________ August 16, 2016 City of Iowa City Page 8 ITEM 4e HISTORIC PRESERVATION – RESOLUTION AUTHORIZING THE HISTORIC PRESERVATION COMMISSION TO FILE AN APPLICATION FOR A CERTIFIED LOCAL GOVERNMENT (CLG) GRANT TO OBTAIN FUNDS FOR THE PURPOSE OF UPDATING THE 2001 SURVEY AND EVALUATION OF THE CENTRAL BUSINESS DISTRICT. Comment: In 2001 the Historic Preservation Commission completed a Survey and Evaluation of the Central Business District. Since the completion of that survey, some downtown buildings have been lost to fire, some have been restored, and new buildings have been constructed. These changes may affect the eligibility of properties for the National Register of Historic Places. The Historic Preservation Commission proposes to apply for a CLG Grant for the purpose of hiring a historic preservation consultant to update the survey. The goal of the project is to identify properties worthy of designation as landmarks or as part of a historic district. The Commission is applying for a $12,000 grant requiring a local match of $8,000. Action: Approved, 7/0 ____________________________ ITEM 5. ROSE OAKS - RESOLUTION AUTHORIZING TRANSITION PAYMENT TO TENANTS OF ROSE OAKS APARTMENTS FROM CITY’S AFFORDABLE HOUSING FUND. Comment: At the Council’s direction this resolution makes available, until October 31, 2016, a $250.00 payment to each household with a valid lease at the Rose Oaks Apartments on February 27, 2016, the day after the Rose Oaks property was acquired by College Fund LLC and Todd Quiring whose managers notified tenants that their leases would not be renewed so as to enable a full scale renovation, including the demolition of some buildings and remodel of others. CHAUNCEY BUILDING TIF REVENUE BONDS – RESOLUTION APPROVING AND AUTHORIZING LOAN AGREEMENTS AND AUTHORIZING AND PROVIDING FOR THE ISSUANCE AND SECURING THE PAYMENT OF $12,805,000 TAXABLE URBAN RENEWAL REVENUE CAPITAL LOAN NOTES, SERIES 2016E, OF THE CITY OF IOWA CITY, STATE OF IOWA UNDER THE PROVISIONS OF THE CITY CODE OF IOWA, AND PROVIDING FOR A METHOD OF PAYMENT OF THE NOTES. Comment: Approved on June 8, 2015 was a resolution to institute proceedings for the issuance of tax increment revenue bonds of not to exceed $14.2 million for the purpose of funding a grant to facilitate the construction of the Chauncey Building. The City has negotiated a $12,805,000, 20-year tax increment revenue bond agreement with Midwest One Bank and First National Bank, Ames, Iowa for the purpose of financing the grant to construct the Chauncey Building. This resolution provides final authorization for the issuance of $12,805,000 Taxable Urban Renewal Revenue Capital Loan Notes, Series 2016E. CITY CHARTER AMENDMENT – RESOLUTION AUTHORIZING AND DIRECTING THE JOHNSON COUNTY AUDITOR TO PLACE A PROPOSED AMENDMENT TO THE CITY’S HOME RULE CHARTER TO AMEND SECTION 7.03(A)(NUMBER OF SIGNATURES) OF ARTICLE VII (INITIATIVE AND REFERENDUM) TO CHANGE THE NUMBER OF SIGNATURES REQUIRED ON INITIATIVE AND REFERENDUM PETITIONS BEFORE THE QUALIFIED ELECTORS OF THE CITY OF IOWA CITY, IOWA AT A SPECIAL CITY ELECTION ON NOVEMBER 8, 2016. Comment: A valid petition has been filed proposing an amendment to the City Charter to change the number of signatures required on initiative and referendum petitions from the current requirement of eligible electors (residents of Iowa City) equal in number to at least twenty-five percent (25%) of the number of persons who voted at the last regular city election, but not less than three thousand six hundred (3,600), to eligible electors equal in number to at least ten percent (10%) of the number of persons who voted at the last regular city election, but not less than ten (10). In accordance with Section 372.11 of the Iowa Code and Section 8.01 of the City Charter, this resolution will submit the proposed amendment to the voters at a special city election on November 8, 2016. Action: Approved, 7/0 ________________________________ ITEM 8. NEWSPAPER BOXES IN PUBLIC RIGHT-OF-WAY - ORDINANCE AMENDING TITLE 16 OF THE CITY CODE, ENTITLED "PUBLIC WORKS," CHAPTER 1, ENTITLED, "STREETS, SIDEWALKS AND PUBLIC RIGHT OF WAY," TO ESTABLISH A PERMIT SYSTEM FOR USE OF NEWSPAPER BOXES IN PUBLIC RIGHT-OF-WAY. (SECOND CONSIDERATION) Comment: The City has received complaints over the years regarding poorly maintained and seemingly abandoned newspaper boxes (referred to as “publishers’ boxes” in the ordinance) located on the ped mall and sidewalks. To ensure that the boxes are maintained and do not obstruct pedestrian traffic, the ordinance requires that boxes have a permit and that the permit policy be established by resolution. The resolution will be considered at the same meeting as the passage of the ordinance.
