Resolutions and Motions: ITEM 3d(1) ACT FIRST ADDITION – RESOLUTION APPROVING FINAL PLAT (SUB16-00008) Comment: Staff recommends approval of the final plat subject to approval of legal papers by the City Attorney. It is anticipated that legal papers will be approved prior to the September 6 City Council meeting. Approval will allow the development of ACT First Addition, a 2-lot, 18.07-acre industrial subdivision located at the northwest corner of the intersection of Scott Boulevard and Highway 6. September 6, 2016 City of Iowa City Page 3 ITEM 3d(2) CDBG / HOME AMENDMENT FOR HOUSING PROJECTS - RESOLUTION ADOPTING IOWA CITY’S FY16 ANNUAL ACTION PLAN AMENDMENT #4, WHICH IS A SUB-PART OF IOWA CITY’S 2016-2020 CONSOLIDATED PLAN (CITY STEPS), AUTHORIZING THE CITY MANAGER TO SUBMIT SAID PLAN AND ALL NECESSARY CERTIFICATIONS TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT. Comment: The FY16 Plan Amendment #4 reduces the number of single room occupancy (SRO) units from eight to four and includes rehabilitation as an eligible activity for the FY16 CHARM Homes LLC acquisition project. The City had awarded CHARM Homes LLC funds to acquire two homes but due to lack of ADA accessible homes, they request to acquire one property and rehabilitate it for accessibility. ITEM 3d(3) NEIGHBORHOOD TRAFFIC CALMING POLICY REVISIONS – RESOLUTION RESCINDING RESO 11-294 AND ADOPTING EVALUATION CRITERIA FOR THE IOWA CITY NEIGHBORHOOD TRAFFIC CALMING PROGRAM. . Removed for separate consideration after Consent Calendar. Comment: This resolution will rescind Resolution 11-294 and establish certain criteria for the City’s adopted Neighborhood Traffic Calming Program. The revised criteria are intended to ensure broad neighborhood support for traffic calming projects at the onset, direct limited resources towards projects showing the greatest need, and to formalize aspects of the program that require clarification. The proposed criteria are not expected to result in additional cost, other than staff time assisting neighborhoods accessing the Program. ITEM 3d(4) NORTHSIDE OKTOBERFEST - RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY AND IOWA CITY DOWNTOWN SELF-SUPPORTED MUNICIPAL IMPROVEMENT DISTRICT TO ALLOW THE TEMPORARY AND LIMITED SALE, CONSUMPTION, AND POSSESSION OF BEER DURING NORTHSIDE OKTOBERFEST WITHIN A SPECIFIED AREA ON A CITY STREET AND PARKING LOT. Comment: Section 4-5-3 of the City Code allows for the sale and consumption of alcohol in a city park, on a right-of-way, or other public ground, excluding public buildings, pursuant to written agreement. The agreement, which is attached to the resolution, allows the “Downtown District” to sell beer in a fenced off area on the 200 and 300 block of Market St., the City parking lot on the north side of the 300 block of Market St., and the section of the 100 block of N. Linn Street located north of the alley during the Northside Oktoberfest on Sept. 24. The exact location and dimension of the site is attached as an exhibit to the proposed agreement. The agreement is substantially similar to the one executed last year. September 6, 2016 City of Iowa City Page 4 ITEM 3d(5) IOWA DEPARTMENT OF TRANSPORTATION MAINTENANCE AND REPAIR AGREEMENT - RESOLUTION AUTHORIZING THE MAYOR TO SIGN AN IOWA DEPARTMENT OF TRANSPORTATION AGREEMENT FOR MAINTENANCE AND REPAIR OF PRIMARY ROADS IN MUNICIPALITIES. Comment: This agreement outline the responsibilities for maintenance and repair of the primary roads within the corporate limits of the City during the period of July 1, 2016 through July 1, 2021. ITEM 3d(6) NORMANDY DRIVE RESTORATION PHASE IIIB - RESOLUTION ACCEPTING THE WORK FOR THE NORMANDY DRIVE RESTORATION PHASE IIIB PROJECT. Comment: The project has been completed by L.L. Pelling Company of North Liberty, Iowa, in substantial accordance with the plans and specifications. The Engineer’s Report and Performance and Payment bonds are on file with the City Clerk.  Project Estimated Cost: $ 210,000.00  Project Bid Received: $ 223,030.55  Project Actual Cost: $ 222,548.05 ITEM 3d(7) U.S. HIGHWAY 6 AND SYCAMORE STREET INTERSECTION IMPROVEMENT - RESOLUTION ACCEPTING THE WORK FOR THE U.S. HIGHWAY 6 AND SYCAMORE STREET INTERSECTION IMPROVEMENT PROJECT. Comment: The project has been completed by Peterson Contractors, Inc. of Reinbeck, Iowa, in substantial accordance with the plans and specifications. The Engineer’s Report and Performance and Payment bonds are on file with the City Clerk.  Project Estimated Cost: $ 1,778,650.00  Project Bid Received: $ 1,845,737.04  Project Actual Cost: $ 1,852,422.25 September 6, 2016 City of Iowa City Page 5 ITEM 3d(8) ASSESSMENTS - RESOLUTION ADOPTING AN ASSESSMENT SCHEDULE OF UNPAID MOWING, CLEAN-UP OF PROPERTY, SNOW REMOVAL, SIDEWALK REPAIR, AND STOP BOX REPAIR CHARGES AND DIRECTING THE CLERK TO CERTIFY THE SAME TO THE JOHNSON COUNTY TREASURER FOR COLLECTION IN THE SAME MANNER AS PROPERTY TAXES. Comment: The City has the authority under Iowa Code §364.13B to assess the nuisance abatement costs in the same manner as a property tax. This resolution allows the City Clerk to certify to the Johnson County Treasurer the abatement cost to be assessed against the property. This assessment is being pursued only after the City took many steps to resolve the matter. The City notified the home owners to abate the nuisance (for example, to remove snow from the sidewalk) and after the home owner did not take action to abate the nuisance, the City abated the nuisance and billed the owner. After being billed at least twice, these owners still have not paid the abatement costs. The City has sent a letter to the home owner giving them notice that this resolution would be on the agenda, a copy of which is attached to the resolution. No interest will be charged if the owner pays within 30 days of the first required publication. Attached as an exhibit to the resolution is a list of the properties that will be assessed and the amount that will be assessed. ITEM 3d(9) PARK MASTER PLAN - RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND RDG PLANNING AND DESIGN, INC. OF DES MOINES, IOWA TO PROVIDE CONSULTANT SERVICES FOR IOWA CITY PARK MASTER PLAN PROJECT. Comment: This agreement authorizes RDG Planning and Design, Inc. to provide consultant services related to the Park Master Plan Project. The project generally includes developing a 10 year Master Plan for park facility improvements that prioritizes providing equitable, accessible and well maintained park facilities throughout Iowa City. Project includes an assessment of current park facilities to evaluate for accessibility and compliance with the American Disabilities Act, assessment of current safety and maintenance needs, determination of probable lifespan of current facilities and recommendations for future facility needs based upon community social-economic demographics, recreational use trends and community interests. The total cost of consulting services for this project is $70,000 and will be funded by the General Fund. ITEM 3e. Setting Public Hearings: ITEM 3e(1) AMENDING FY2017 BUDGET - RESOLUTION SETTING A PUBLIC HEARING ON AMENDING THE FY2017 OPERATING BUDGET. Comment: This resolution sets a public hearing for September 20, 2016 to amend the FY2017 operating budget. Information will be available to the public on Friday September 9, 2016. Council will discuss # 5a, 5b, 5c at formal meeting) ITEM 5a EASTSIDE MIXED USE FORM-BASED CODE – ORDINANCE AMENDING TITLE 14: ZONING TO ESTABLISH FORM-BASED ZONING STANDARDS FOR THE EAST SIDE MIXED USE ZONE AND TO CLARIFY AND REFINE CERTAIN PROVISIONS THAT APPLY DOWNTOWN AND IN THE RIVERFRONT CROSSINGS DISTRICT. Comment: At its August 4 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of these zoning code amendments. Approval will establish a new form-based code district to provide a better transition between Downtown Iowa City and the residential neighborhoods to the east. In addition, amendments will clarify and refine the language to improve certain provisions of the Riverfront Crossings form-based code; adjust parking requirements and apartment mix standards to encourage student housing in areas abutting the University campus and encourage housing for a broader mix of populations throughout Riverfront Crossings and the Eastside Mixed Use Districts; and ensure that zoning requirements for exterior lighting are applied in the Riverfront Crossings and Eastside Mixed Use Districts. 1. (REZ16-00004) (SECOND CONSIDERATION) Comment: At its July 21 meeting, by a vote of 4-1 (Signs voting no, Martin and Hensch absent), the Planning and Zoning Commission recommended approval of this rezoning subject to a conditional zoning agreement specifying that vehicle sales will be limited to the west side of the building at 2114-2118 S. Riverside Drive. Approval will allow this property to be used for intensive commercial uses including car repair and sales. (This is one property with six commercial condominiums located on it.) SYCAMORE STREET AND LOWER MUSCATINE ROAD LANDSCAPE IMPROVEMENTS – APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE SYCAMORE STREET AND LOWER MUSCATINE ROAD LANDSCAPE IMPROVEMENTS PROJECT 2016, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project involves street tree installation along Lower Muscatine Road from Kirkwood Boulevard to First Avenue, and along Sycamore Street from Lower Muscatine Road to Lehman Avenue. The project also includes landscape installation for (2) roundabouts installed in 2015 along Sycamore Street. The estimated cost for this project is $261,368.84 and will be funded with Road Use tax proceeds. a. PUBLIC HEARING Action: Closed ______________________________________ b. ICAD FUNDING - RESOLUTION OF INTENT TO BUDGET $70,000 IN ANNUAL FUNDING FOR IOWA CITY AREA DEVELOPMENT GROUP FOR THE FOUR FISCAL YEARS 18-21 AND UP TO AN ADDITIONAL $100,000 FOR THE MERGE BUILD OUT IN FISCAL YEAR 2017. Comment : This resolution is for the approval of four fiscal years of continuing annual financial assistance of $70,000 per year and approval of the City Manager’s authority to disburse additional funding up to $100,000, if necessary, for the build out of the new MERGE Innovation Space. Action: Approved, 7/0 ________________________________ ITEM 8. UNDER 21 EXCEPTION CERTIFICATE REVOCATIONS - ORDINANCE AMENDING TITLE 4, ALCOHOLIC BEVERAGES, CHAPTER 5, PROHIBITIONS AND RESTRICTIONS, SECTION 8, PERSONS UNDER THE LEGAL AGE IN LICENSED OR PERMITTED ESTABLISHMENTS, SUBSECTION B, PARAGRAPH B, REFERENCING THE CITY’S UNDER 21 LAW, TO SHORTEN THE REVIEW AND REVOCATION PERIODS FOR COMPLIANCE CHECK FAILURES FOR HOLDERS OF EXCEPTION CERTIFICATES. (FIRST CONSIDERATION) Comment: This amendment to the Under 21 ordinance will shorten both the review period in which sales to minors are counted against establishments with exception certificates, and the period of revocation should they sell to minors more than once in a two year period. FARMERS MARKET VENDORS - ORDINANCE AMENDING TITLE 10 OF THE CITY CODE, ENTITLED "USE OF PUBLIC WAYS AND PROPERTY," CHAPTER 11, ENTITLED "FARMER'S MARKET," TO REQUIRE THAT THE RULES ADDRESS VENDOR SELECTION AND TO ELIMINATE THE REQUIREMENT THAT GRILLING VENDORS PROVIDE SUBSTANTIALLY DIFFERENT FOODS. (FIRST CONSIDERATION) Comment: This ordinance proposes two changes that essentially codify current practice. One, although the Code gives priority to a vendor from a previous year over a new vendor, it does not provide how competing new vendors will be selected. As with mobile vendors on the ped mall, staff recommends that the selection standards be set forth in the Administrative Rules. Two, the Code requires that grilling vendors vend substantially different food products which has not been enforced and should be eliminated.
