Iowa City City Council regular meeting, 7:00 p.m. at City Hall. Mayor Throgmorton
presiding. Council members present: Botchway, Cole, Mims, Taylor, Thomas,
Throgmorton. Absent: Salih. Staff members present: Fruin, Monroe, Andrew, Dilkes,
Voparil, Havel, Hightshoe, Sitzman. UISG: Stewart.
The Mayor proclaimed: ADA Awareness Day — July 21, Simon Andrew, Assistant to
the City Manager accepting; Iowa City Strawless Initiative Day — July 17, Tricia
Windschitl, Preschool teacher from Preucil School of Music, and students accepting.

A public hearing was held on an ordinance conditionally rezoning approximately 8.02
acres of property located at the southwest corner of Lower West Branch Road and Taft
Avenue, from Interim Development Single Family Residential (ID-RS) zone to Medium
Density Single-Family (RS-8) zone and Low Density Multi-Family (RM-12) zone (REZ18-
00015). Development Service Coordinator Sitzman presented a power point. John Yapp,
Allen Homes, presented a power point.
Moved by Mims, seconded by Botchway, that the ordinance conditionally rezoning
approximately 8.02 acres of property located at the southwest corner of Lower West
Branch Road and Taft Avenue, from Interim Development Single Family Residential (ID-
RS) zone to Medium Density Single-Family (RS-8) zone and Low Density Multi-Family
(RM-12) zone (REZ18-00015), be given first vote.
Moved by Botchway, seconded by Mims, to adopt Res. 18-211, Comprehensive
Plan, Annexation Policy, to add a section pertaining to affordable housing. Moved
by Botchway, seconded by Mims, to amend resolution with Mayor's previously suggested
language. The Mayor declared the motion carried by voice vote. The Mayor declared the
amended resolution adopted. NDS Director Hightshoe presented a power point. Charlie
Eastham appeared. Individual Council members expressed their views.
A public hearing was held on a resolution approving plans, specifications, form of
agreement, and estimate of cost for the construction of the Wastewater Treatment Facility

Influent Channel Modifications Project, establishing amount of bid security to accompany
each bid, directing City Clerk to post notice to bidders, and fixing time and place for
receipt of bids. City Engineer Havel provided an overview of the project. -
Moved by Mims, seconded by Botchway, to adopt Res. 18-212, approving plans,
specifications, form of agreement, and estimate of cost for the construction of the
Wastewater Treatment Facility Influent Channel Modifications Project, establishing
amount of bid security to accompany each bid, directing City Clerk to post notice
to bidders, and fixing time and place for receipt of bids.
Moved by Mims, seconded by Taylor, that the rule requiring ordinances to be
considered and voted on for final passage at two Council meetings prior to the meeting at
which it is to be finally passed be suspended, the second consideration and vote be
waived, and that Ord. 18-4761, amending Title 17, entitled "Building and Housing,"
Section 5, entitled "Housing Code," to add the requirements for deadbolt locks and
duplex separation requirements to Section 19, entitled "Responsibilities of Owners
Relating to the Maintenance and Occupancy of Premises," be voted on for final
passage at this time. Moved by Mims, seconded by Botchway, that the ordinance be
finally adopted at this time.
Moved by Mims, seconded by Taylor, that the rule requiring ordinances to be
considered and voted on for final passage at two Council meetings prior to the meeting at
which it is to be finally passed be suspended, the second consideration and vote be
waived, and that Ord. 18-4762, to Adopt the Code of Ordinances of the City of Iowa
City, Iowa, 2018, AKA "City Code," be voted on for final passage at this time. Moved
by Mims, seconded by Botchway, that the ordinance be finally adopted at this time.
Moved by Botchway, seconded by Mims, to adopt Res. 18-213, establishing the fee
an owner may opt to pay in lieu of providing affordable housing in the Riverfront
Crossings District and rescinding Resolution No. 16-216. NDS Director Hightshoe
presented a power point. Individual Council members asked questions and expressed
their views. Moved by Botchway, seconded by Thomas, to accept correspondence from
Cheryl Cruise.
Moved by Botchway, seconded by Mims, to adopt Res. 18-214, adopting the Aid to
Agencies process. Moved by Mims, seconded by Cole, to amend resolution by taking
out staggered funding clause. The Mayor declared the amendment carried by voice vote.
The Mayor declared the amended resolution adopted. NDS Director Hightshoe provided
an analysis of funding. Individual Council members expressed their views.
Moved by Mims, seconded by Taylor, to adopt Res. 18-215, Approving an
Agreement for Private Development By and Among the City, Foster Road
Developers, L.L.C., Vintage Cooperative of Iowa City, and Ewing Land Development
& Services, L.L.C. for Foster Road and The Vintage Cooperative Senior Living.
Assistant to the City Manager Andrew presented a power point. Individual Council
members expressed their views. City Manager Fruin noted continuing progress with the
affordable housing action plan with this resolution and thanked staff for all their work on
this project.
Mayor Throgmorton announced appointment to Historic Preservation Commission for
the East College Street District. Individual Council members expressed their views.
Moved by Mims, seconded by Botchway, to defer indefinitely appointment to the Historic
Preservation Commission (E. College St) for a three-year term, July 1, 2018 — June 30,

2021 . Applicants MUST reside in Iowa City and be 18 years of age unless specific
qualifications are stated. [Staff will not publish additional notices after the initial
announcement; but will continue to advertise vacancies on the City website and Council
agenda. More information may be found on the City website or in the City Clerk's office.
The Mayor noted the previously announced vacancies to Boards and Commissions:
Community Police Review Board for an unexpired term, Upon appointment — June 30,
2021; Library Board of Trustees for an unexpired term, Upon appointment — June 30,
2021 . Applications must be received by 5:00 P.M., Tuesday, August 14, 2018. Airport
Commission for a four-year term, July 1, 2018 — June 30, 2022; Airport Zoning Brd. of
Adjustment for a five-year term, January 1, 2014 - December 31 , 2018 (Formerly
advertised); Airport Zoning Brd. of Adjustment for a five-year term, January 1, 2016 -
December 31, 2020 (Formerly advertised); Historic Preservation Commission (Jefferson
St)— One vacancy to fill a three-year term, July 1, 2016 — June 30, 2019 (New District
formed); Telecommunications Commission for two vacancies to fill a three-year term, July
1, 2018 — June 30, 2021. Vacancies Will Remain Open until Filled.
Community Comment, Gustave Stewart, UISG Liaison, appeared with UISG updates.
Council members reported on various meetings attended, upcoming meetings,
community events, and items of interest.
Council member Botchway reported he would be submitting his resignation after
adjournment of meeting. He reported he will be accepting a position at Waterloo
Community Schools as Chief of Human Resources and Equity. Council member
Botchway highlighted key accomplishments in his tenure and thanked staff, Council and
citizens for all of their support. Council members and city staff wished him well and
thanked Council member Botchway for his years of service.

Consultation with Planning &Zoning regarding the proposed rezoning at 12 E. Court
Planning &Zoning Commission members present: Mike Hensch, Mark Signs, Phoebe Martin, Carolyn
Dyer, Billie Townsend, Larry Baker
Mayor Throgmorton summarized the purpose for the joint meeting with the Council and gave a brief
review of the Council vote from May 29th and asked the Commission members to give their rationale for
recommending approval with the specific conditions that were noted. Commission members spoke
about the process and the conditions that were added to the Conditional Zoning Agreement. Individual
Council members expressed their views.
Action: Staff will meet to discuss a communication tool that relays staff design review committee
decisions back to the Planning and Zoning Commission. This will hopefully clear up the
misunderstandings that a few P &Z members mentioned during the consultation.
Climate Action Steering Committee Report & Presentation
Lindy Wordlaw with Elevate Energy presented a power point on the Climate Action and Adaptation Plan
which included the following 5 action areas: Buildings, Transportation, Waste, Adaptation, and
Sustainable Lifestyle. The following individuals presented additional information: Jesse Leckband,
MidAmerican Energy; Brenda Nations, Sustainability Coordinator; and Matt Krieger, Certified Architect
from Neumann-Monson Architects. Individual Council members expressed their views.
Action: Staff will continue to work with the climate plan committee on the finishing touches to the
report. Staff will look to provide more clarity to the recommendations and lay out the initial projects that
will be pursued to begin implementation. After the public meeting, the plan will be revised one last time
and then presented to Council for formal adoption. At that time the Council will discuss the structure of
an ongoing committee to monitor the implementation and continue outreach efforts.

Discuss City Assistance with Relocation
City Manager Fruin presented information and gave a summary on items included in the memo
provided. Individual Council members expressed their views.
Action: Staff will work on a case management approach for relocation assistance to the residents on
Prairie DuChien. The total will equal an average of$2k per household plus administrative expenses.
Funds to come from Emergent Needs portion of Affordable Housing Fund. Staff will report back to
Council once the plan is solidified.
Clarification of Agenda Items
• [Agenda Item 2d(10)]... Legal Services Contract ...Mayor Pro tern Taylor asked if the legal firm
listed was new to the City. Assistant City Manager Monroe confirmed it was and was due to a
retirement of the previous attorney.
• [Agenda Item 21(18)]... Laura Routh: Bridge on Sheridan Ave [Staff response included]... Mayor
Pro tern Taylor commended staff on taking care of the issue.
• [Agenda Item 2f(6)]... Magda Montiel Davis: SERIOUS SAFETY ISSUES—All Glass Building,
201 E Washington St ... Mayor Throgmorton asked for an update. City Manager Fruin gave a
summary of the situation and how it is being handled.
• [Agenda Item 2f(1)]... Amy Charles: query on Uber assaults [Staff response included] ... Mayor
Throgmorton noted the series of emails and inquired as to if they had been responded to. City
Manager Fruin summarized the correspondence and noted the restrictions the City has on
regulating Transportation Network Companies (TNC's). Individual Council members expressed
their views regarding public service announcements.
Action: Staff will work on a public service announcement that focuses on safe practices while
traveling to and from home (taxis, ridesharing, walking home, walking to a car, etc.).

Racial Equity) Council member Botchway noted he was in favor of the recommendations
and suggested an addition of language to the purpose. Council member Mims also
supported the recommendations and asked if Council could have a short work session
discussion regarding the purpose. Individual Council members expressed their views.
Action: Staff will incorporate the all of the recommendations for changes to the SJRE grant
program that were contained in the 5/31 IP memo. Staff will schedule a short work session
in the near future for the Council to review the stated purpose of the grant program.

December 2018) Mayor Throgmorton asked Council to review and discuss any issues with
the proposed meeting schedule.
Action: Staff will submit the following for the joint meeting agenda; Annexation Policy on
Affordable Housing, ICCSD Redistricting, Johnson County Comprehensive Plan, Iowa City's
Climate Plan, RAGBRAI update, major road project updates, with the understanding that the
agenda may not accommodate all and if not, those items that are most timely(e.g.
RAGBRAI, road project updates)will have priority.

Meeting) Mayor Pro tem Taylor thanked staff for following up on the issue. Individual
Council members expressed their views.

holding the next listening post at a party in the park in August. Council agreed to hold the
next listening post at Willow Creek Park on August 16.
3. (IP6, 2017 Police Department Annual Report) Mayor Throgmorton stated the report was
excellent and noted the upcoming retirement of Captain Kelsay and the resignation on
Animal Services Supervisor Ford.

1. (IP8, Pending Work Session Topics) Mayor Throgmorton stated the Council would need to
meet for staff evaluations and stated those would be scheduled for August 7th starting at
4:00 pm.

resolution: In determining the most desirable option, preference shall be weighted toward
options that help achieve better socio-economic balance among Iowa City neighborhoods
and among schools in the Iowa City Community School District. Moved and seconded to

language back to the Housing & Community Development Commission before passage.

A public hearing was held on a resolution approving an amendment to the terms of
Midwestern Disaster Area Revenue Bonds (Iowa Cancer Cure Project) Series 2012, of
Iowa City, Iowa and specifically approving amendment of said bonds and related matters.

Moved by Mims, seconded by Botchway, to adopt Res. 18-203, approving an
amendment to the terms of Midwestern Disaster Area Revenue Bonds (Iowa Cancer

Moved by Mims, seconded by Botchway, that the ordinance amending Title 17,
entitled `Building and Housing," Section 5, entitled "Housing Code," to add the
requirements for deadbolt locks and duplex separation requirements to Section 19,
entitled "Responsibilities of Owners Relating to the Maintenance and Occupancy of
Premises," be given first vote. Senior Housing Inspector Laverman provided information.

Moved by Thomas, seconded by Botchway, to adopt Res. 18-204, adopting Iowa
City's FY18 Annual Action Plan Amendment #2, (CDBG/HOME) which is a sub-part
of Iowa City's 2016-2020 Consolidated Plan (CITY STEPS). Neighborhood &
Development Services Director Hightshoe provided information.
Moved by Mims, seconded by Botchway, to adopt Res. 18-205, awarding contract
to All American Concrete for $623,450.00 and authorizing the Mayor to sign and the
City Clerk to attest a contract for construction of the Creekside Park Improvements
2018 Project. Parks & Recreation Director Seydell-Johnson presented information.
