Resolution Removing Appointee to the Civil Service
Commission.
Comment: State law requires that removal of a person appointed by the
Council to a city office must be by written order detailing the reasons for the
removal and the appointee must be given notice of the removal and the
opportunity to be heard at a public hearing. On 3/20/2018 Council appointed
Emily Bushman to the Civil Service Commission for a 4-year term starting on
April 2, 2018. Since then numerous attempts to contact Ms. Bushman,
including those by the Chair of the Commission, have been unsuccessful. By
law the Commission has only 3 members. The lack of a full Commission will
be particularly problematic in the event of an appeal by a civil service
employee from suspension, demotion or discharge.
8.d. Churchill Meadows Part Five - Final Plat
Resolution approving final plat of Churchill Meadows

Comment: Staff recommends approval of the final plat, which will allow the
development of Churchill Meadows Part Five, a six-lot residential re-
subdivision of 1.821 acres of Churchill Meadows Parts One and Two on
Herbert Hoover Highway.

8.e. City Manager Settlement Authority
_ Resolution repealing Resolution No. 17-246 and approving
a new compilation of contractual authority delegated from
the City Council to the City Manager which increases the
City Manager's settlement authority.
Comment: Resolution No. 17-246 authorizes the City Manager to sign
certain contracts without City Council approval, including settlement
agreements of up to $20,000. This resolution increases that amount to
$60,000, in order to track the Council-approved Purchasing Manual
authority for the City Manager in approving contracts for professional
and technical services. No other changes are being made to City
Manager signature authority.
8.f. Amending budgeted positions
Resolution amending the budgeted positions in the Parks
and Forestry Division of the Parks and Recreation
Department and the Administrative pay plan by deleting
one full-time Maintenance Worker III - Parks position and
adding one full-time Assistant Superintendent of Parks
position.
Comment: The Parks & Recreation Department - Parks Division has a
vacant Maintenance Worker Ill - Parks position. After evaluating the needs of
the Parks & Recreation Department it has been determined that the needs of
the department can be better served by a new position of Assistant Parks
Superintendent. The financial impact of these changes in position
classifications is a modest savings in year one. However, the new position is
a higher classification which will result in incremental increases each year.

8.g. Iowa City Landfill and Recycling Center Consulting Services
Resolution ratifying the contract extension and
-c c 7 memoranda of understanding to the November 12, 2013
Agreement by and between the City of Iowa City and
Barker Lemar Engineering Consultants to provide
consultant services for the Iowa City Landfill and Recycling
Center.
Comment: The City of Iowa City previously entered into an Agreement with
Barker Lemar Engineering Consultants for annual Landfill Engineering
Services. Staff previously agreed to extend the contract and requested that
Barker Lemar perform additional tasks in response to deficiencies observed
during an EPA inspection. This resolution ratifies those actions. The total
cost for the contract extension and memorandums of understanding is
$160,140 and will be funded with Landfill revenues.
8.h. Idyllwild Stormwater Drainage Diversion
Resolution approving, authorizing and directing the Mayor
to execute and the City Clerk to attest Amendment No. 2 to
the September 19, 2017, agreement by and between the
City of Iowa City and HR Green, Inc. to provide
engineering consultant services for the Idyllwild
Stormwater Drainage Diversion Project.
Comment: The City entered into a Consultant Agreement to evaluate the
results of the 2016 Idyllwild Drainage Diversion Study, determine the best
stormwater bypass alternative and develop a preliminary pump station
design. This amendment revises the scope of services to more accurately
represent the City's preferred stormwater diversion and pump station. The
negotiated decrease in cost will be $20,583 for the revised services
performed, which will reduce the total consultant service fees to $192,923.

8.m.Dodge Street Functional Design
Resolution approving, authorizing and directing the Mayor
- 3o3 to execute and the City Clerk to attest an Agreement by
and between the City of Iowa City and Strand Associates,
Inc. to provide engineering consultant services for the
Dodge Street Functional Design.
Comment: This agreement authorizes Strand Associates, Inc. to provide
consultant services for the development of functional design plans that will
assist in identifying project funding and determining a schedule for the
Dodge Street Improvements Project. The project generally includes the
reconstruction of Dodge Street from Burlington Street to Governor Street.
The total cost of the services is $117,268 and will be funded by Road Use
tax proceeds.
8.n. Iowa City Public Works Facility Phase I
Resolution authorizing the Mayor to sign and the City Clerk
I . to attest an agreement between Terracon Consultants, Inc.
of Cedar Rapids, IA and the City of Iowa City for consulting
services during construction of the Iowa City Public Works
Facility Phase I Project.
Comment: The Iowa City Public Works Facility Phase I Project will require
geotechnical and construction material testing, monitoring and special
inspection services during construction. The City received proposals and has
negotiated an Agreement with Terracon Consultants, Inc. of Cedar Rapids,
IA to provide said services for $81,142.00. Funds for this project are
available in the Iowa City Public Works Facility Phase I account #P3959.

related to transfer of development rights for historic

Comment: At its October 18th meeting, by a vote of 6-0 (Baker absent), the
Planning and Zoning Commission recommended approval of this
amendment, which would allow transfer of development rights city-wide for
certain historic properties.

of the Hickory Hill Park Improvements Project — Phase 1 ,
directing City Clerk to publish notice of said hearing, and
directing the City Engineer to place said plans on file for

Comment: The Hickory Hill Park Improvements Project — Phase 1 includes
trail, bridge, and drainage improvements in Hickory Hill Park as detailed in
the Hickory Hill Park Master Plan. This project also includes new signage
and wayfinding throughout the park. The estimated cost of construction is
$306,000 and will be funded by account #R4224.
9.d. City Hall MPOJC Renovation

Hall. The estimated project cost is $126,000 and will be funded by account

Comment: This project will involve constructing a retaining wall that will

estimated cost for this project is $895,000. Funds are available in the West

sewer maintenance that includes lining sewer pipes and manholes at various

Comment: At its September 6 meeting, by a vote of 4-1 (Dyer and Parsons
absent, Baker dissenting), the Planning and Zoning Commission
recommended approval of this amendment, which would allow public art
funds received for height bonuses to be spent anywhere in the Riverfront
Crossings District, including the park, as opposed to only within the same
subdistrict as the project that requests the bonus.

Comment: At its October 18th meeting, by a vote of 6-0 (Baker absent), the
Planning and Zoning Commission recommended that the proposed zoning
not be approved. Staff recognizes that this rezoning is consistent with
S'fr Johnson County's Future Land Use Map and Comprehensive Plan, but is not
consistent with the Fringe Area Agreement, which is part of the City's
Comprehensive Plan. The Planning and Zoning Commission also
recommended that City and County staff work together to update the Fringe
Area Agreement.

Ordinance Amending Title 1 "Administration", Chapter 5 "City
Council", Section 3 "Compensation" of the City Code to
increase the salary and health insurance benefit of the Mayor
and Members of the City Council effective January 1 , 2020.

/„� Comment: At Council's direction this ordinance will increase the annual salary of
council members and the Mayor to $11,960 and $14,950, respectively, and make
health insurance benefits available to council members at the rate offered to half-
time city employees. In accordance with Iowa law, the changes will be effective
January 1, 2020.

14. Sidewalk retailing permit
Ordinance amending Title 10, entitled "Public Ways and
Property," Chapter 3, entitled "Commercial Use of Sidewalks,"
to provide for sidewalk retailing every day from March through
October. (First Consideration)
Comment: The City Code currently authorizes an annual sidewalk

,Q� retailing permit for businesses to use the sidewalk adjacent to their storefront for
9_ merchandise display. The permit is limited to Thursdays through Sundays from
March 1 to October 31. The Downtown District requests that the permit be
er expanded to all days of the week during this time period to support retail
businesses.

Resolution Authorizing the City Manager to Provide a Family
/g"3i0 and Parental Leave Benefit to Administrative and Confidential
Employees.
Comment: The City Manager Proposes to Provide a Parental and Family Leave
Benefit to Administrative and Confidential Employees and seeks City Council
Authority to do so as there will be a cost to the City. For union employees this
MsOL/ benefit is a mandatory subject for police and fire and a permissive subject of
bargaining for AFSCME.

16. Fire Station #5 Lot Purchase
Resolution approving purchase agreement with Bedrock,
L.L.C. for Lot 1 of the proposed Cherry Creek Subdivision for
future use as Fire Station number 5.
Comment: This resolution approves the Purchase Agreement negotiated with
Bedrock, L.L.C. for lot 1 of the Cherry Creek Subdivision, off of South Gilbert
Street, for potential future use as Fire Station #5. The purchase price, based on
appraised value, is $504,000.

historic preservation and technology improvements in their venues.

19. Annual TIF certification filing
Resolution directing the filing of TIF certification under Iowa
g -3 `f Code Section 403.19 for the 2018 end of year certification of
urban renewal projects.
Comment: This resolution authorizes the certification of debt/obligations which
qualify for reimbursement from the TIF special revenue funds created for the
following Urban Renewal Areas: City-University Project I; Heinz Road, Riverside
Drive, and Scott Six. This is an annual certification due to the County Auditor by
December 1, as required by state law.

20. Assessment Schedule
Resolution adopting an assessment schedule of unpaid
13-315 mowing, clean-up of property, snow removal, sidewalk repair,
and stop box repair charges and directing the Clerk to certify
the same to the Johnson County Treasurer for collection in the
same manner as property taxes.
Comment: The City has the authority under Iowa Code §364,13B to assess the
nuisance abatement costs in the same manner as a property tax. This resolution
allows the City Clerk to certify to the Johnson County Treasurer the abatement
cost to be assessed against the property. This assessment is being pursued only
after the City took many steps to resolve the matter. The City notified the
homeowners to abate the nuisance (for example, to remove snow from the
sidewalk) and after the homeowner did not take action to abate the nuisance, the
City abated the nuisance and billed the owner. After being billed at least twice,
these owners still have not paid the abatement costs. The City has sent a letter to
the homeowner giving them notice that this resolution would be on the agenda, a
copy of which is attached to the resolution. No interest will be charged if the
owner pays within 30 days of the first required publication. Attached as an exhibit
to the resolution is a list of the properties that will be assessed and the amount
that will be assessed.
