6.a. November 2019 Disbursement
Motion to approve disbursements in the amount of $15,152,586.75
for the period of November 1 through November 30, 2019, as
recommended by the Finance Director subject to audit.
Disbursements are published and permanently retained in the City
Clerk's office in accordance with State Code.
6.b. Brookwood Pointe Fifth Addition
Resolution accepting the work for the storm sewer, file lines,
drainage ways, sanitary sewer, water main, and paving public
improvements for Brookwood Pointe Fifth Addition, and declaring
public improvements open for public access and use.
Comment This item will accept the public improvements for Brookwood Pointe I'M
Addition, and extends Terrapin Drive and Covered Wagon Drive west of Russell Drive.
6.c. Riverfront Crossings Paris, Phase 2
R - 2- R L, Resolution accepting the work for the Riverfront Crossings Park,
Phase 2 Project.
Comment The project has been completed by Trioon General Construction of Cedar
Rapids, Iowa, in substantial accordance wdrh the plans and specifications. The Engineers
Report and Performance and Payment bonds are on file Wb the City Cleric.

6.d. Accepting Outlot for New Park in Peninsula
2q -7 Resolution accepting the dedication of Outlot G, Peninsula
Neighborhood, Second Addition as public open space.
Comment: In connection with the Peninsula Neighborhood, Second Addition, the
owner agreed to dedicate Outiot G within said subdivision to the City as public open
space. The Parks & Rec. Dept and Public Works Dept. have inspected the property
and determined it is suitable for dedication at this time and recommends the City Council
waive the contingency for all the plantings required by the OPDH because the current
plantings are sufficient and appropriate for the space. [Deferred from 12103119]
6.e. Naming New Park in Peninsula "Emma Harvat Square Park"
Resolution naming the proposed park defined as Outlot G in
Peninsula Neighborhood, Second Addition as "Emma Harvat
Square Park."

Comment: In the previous item, Council accepted the dedication of Oudot G in the
Peninsula. City policy requires the naming of parks to be approved by City Council and
an adhoc committee comprised of staff and the Parks & Rec. Commission. This
resolution names the park "Emma Harvat Square Park," in honor of the CiVs first
female mayor. [Deferred from 12103/19]
Emma Harvat Square Park Maintenance Agreement
Resolution approving an agreement with the Peninsula
Neighborhood Homeowners Association, Inc. regarding use and
maintenance of Emma Harvat Square Park.
Comment: In the previous items, the City Council accepted Outlot G, an area of land in
the peninsula neighborhood bordered by Willenbrock Circle, Martin Street Walker Circle,
and Foster Road, as open space and named it Emma Harvat Square Park. The
Peninsula Neighborhood Homeowners Association, Inc. has maintained Oudot G as a
public open space for the neighborhood for over ten years and wishes to continue to
provide some maintenance which is acceptable to City staff. This resolution approves the
attached maintenance agreement. [Deferred from 12103119]

ICAD Lease Extension
Resolution authorizing the City Manager to sign Lease
Amendment #1 to a Lease Agreement With the Iowa City Area
Development Group for commercial space within the Iowa City
Public Library, extending the lease for four years.
Comment The Iowa City Area Development Group, Inc., pursuant to a Lease
Agreement approved by the Iowa City Council in Resolution number 15-394 on
December 15, 2016, has been using the commercial space for office purposes, as well
as to collaborate WIJh the University of Iowa in mentoring and fostering entrepreneurial
efforts. Pursuant to the terns of the Lease, the parties have negotiated a second four-
year tern, to run from March 1, 2020 through February 29, 2024, With rent payable
monthly in the amount of $2,000.00, with all other terns and conditions to remain the
same.
Storm Water Specialists Position Addition
Resolution amending the AFSCME pay plan by adding the
position Storm Water Specialist to grade 12.
Comment The FY20 budget included the addition of a position within Storm Water
Operations, and this item formally adds a Storm Water Specialist position to the Citys
classification and compensation plan for AFSCME employees. The duties, responsibilities
and requiremerits or the position have been evaluated and the position is being
recommended for placement in grade 12 of the AFSCME pay plan.
6.i. Budgeted Positions -Development Services Division
Resolution amending the budgeted positions in the Development
Services Division of the Neighborhood and Development Services
Department by adding .5 FTE Associate Planner position to
increase an existing Associate Planner position from .5 FTE to 1.0
FTE.
Comment This resolution amends an existing Associate Planning position in the
Development Services Division from .5 FTE to 1.0 FTE to better serve the needs of the
City.
6.j. Personnel Policies Update - November 2019
-'� Resolution rescinding Resolution No. 17-198 and adopting
updated Personnel Policies.
Comment The Citys Personnel Polices have recently been reviewed and updated
to incorporate best practices and legislative updates, to streamline policy documents by
incorporating other existing standalone policies, and to better communicate
organizational expectations. The City Code requires that Personnel Policies be
established by resolution of the City Council. [Deferred from 11/19/19 and 12/03/19]

7. Setting Public Hearings
7.a. McCollister Boulevard — Gilbert Street to Sycamore Street
Improvement
q - 30 Resolution setting a public hearing on January 7, 2020 on project
manual and estimate of cost for the construction of the McCollister
Boulevard — Gilbert Street to Sycamore Street Improvement
Project, directing City Clerk to publish notice of said hearing, and
directing the City Engineer to place said project manual on file for
public inspection.
Comment: This project involves the extension of McCollister Boulevard from Gilbert
Street to Sycamore Street and the installation of bicycle lanes and sidewalk which will
oonnect to the regional trial network. The project also includes the installation of water
main, new storm and sanitary sewer, fiber and electric conduit and street lights in the
corridor. Traffic Signals will be installed at the Gilbert Street intersection. The
estimated project cost is $3,911,000 and funds are available in acoount #tS3934.
7.b. Spruce Street Water Main Replacement
q" SOS Resolution setting a public hearing on January 7, 2020 on the
project manual and estimate of cost for the construction of the
Spruce Street Water Main Replacement Construction Project,
directing City Cleric to publish notice of said hearing, and directing
the Cfty Engineer to place said project manual on file for public
inspection.
Comment This project includes water main replacement along the west side of Spruce
Street between Deforest Avenue and Friendly Avenue/Lower Muscatine Road. The
estimated project cost is $277,878 and will be funded by the Spruce St. (1300-1400
Block) Water Main Replacement - Account #W3216.

Comment At t December 5, 2019 meeting, by a vote of 5-0 (Martin and Townsend
absent), the Planning and Zoning Commission recommended approval of the proposed
rezoning. Even though the proposed rezoning is not consistent with the policies in the
adopted Fringe Area Agreement, the Commission recommended approval since the
subject area is already partially zoned for residential uses and contains an existing
residential use, the proposed rezoning would not allow for additional residential
development, and the rezoning will create a single zoning classification for the subject area
which will allow for more efficient zoning implement and regulation.

Comment At its November 7 meeting, by a vote of 7-0 the Planning and Zoning
Commission recommended approval. The amendment will allow utility -scale, ground -
mounted solar energy systems as a provisional use in Interim Development Industrial
(ID -1), General Industrial (1-1), Heavy Industrial (1-2), Neighborhood Public (P-1), and
Institutional Public (P-2) zones, and via special exception in all Commercial zones as
well as Interim Development Research Park (ID -RP), Research Development Park
(RDP), and Office Research Park (ORP) zones.

101 Zoning code amendment related to single-family site development
standards
Ordinance amending Title 14, Zoning of the Iowa City code related
to single-family site development standards. (ZCA19-04) (Pass &
Adopt)
Comment: At its meeting on October 17 by a vote of 43 (Martin, Baker, and Signs in the
negative), the Planning and Zoning Commission recommended approval of this
amendment, which would require a 9 foot separation distance between conforming
parking spaces areas and additional paving within the required setback area. This would
apply to detached -single family homes and duplexes.

11. Rental Permit -Radon Testing
I " L4 91 Ordinance amending Title 17, entitled 'Building and Housing," Chapter 5,
entitled "Housing Code," to require radon testing and mitigation in single-
family and duplex rental units. (Pass & Adopt)
Comment The proposed ordinance requires that all residential single family detached structures
FBS- and duplexes are tested for radon prior to rental permit issuance or renewal. If the unit equals or
exceeds 4 pCVL, then a radon mitigation system must be installed and tested to ensure radon
levels do not exceed this threshold. Radon levels must be tested at least every eight years to

12. Repeal Rental Permit Moratorium
Ordinance repealing Ordinance No. 19-4793, a temporary moratorium on
new rental permits for single-family and duplex units. (First Consideration)
Comment Following a law passed last spring prohibiting the City from having a rental permit
cap, Council passed an ordinance issuing a temporary moratorium on new rental permits for
p p , single-family and duplex units in certain neighborhoods to allow staff time to explore aftemative
strategies to mitigate the impact of rental housing on such areas as neighborhood stability and
affordable housing. The moratorium automatically sunsets on March 1, 2020, and with the
passage of the ordinances on radon testing and single-family site development standards, the
