Negus, Mr. Kaspar, Mr. Higbee, Mr. Nesvacil and Mr. Adams. Chairman : Mr. Negus. Question Mr. Robert Sook asks permission to erect a residence on the South 50 ft. of Lot 8 - Block 32 - Original Town. This lot does not contain the ground area required by the Zon- ing Ordinance. Notice of Public Hearing was published in the Iowa City Press Citizen on January 17, 1941. No objections were filed. It was moved by Higbee and seconded by Kaspar that the City Inspector be authorized to issue a permit for residence on the above described property. Question: C.A.Glblin asks permission to alter present binTdirig"located on the South 60 ft. of Lot 4 Block 9 - Lyon's Second Addition , into four apartments. Notice of Public Hearing was published in the Iowa City Press Citizen on January 23, 1941. No objections were filed. It was moved by Kasper and seconded by Nesvacil that the City Inspector be authorized to issue a permit for altering building into apartments on the above described property. Upon roll call, therewere: Ayes: Negus, Kasper and Nesvacil. Nays: None. Absent: Higbee and Adams. Motion carried. 46 MINUTES OF MEETING OF BOARD OF ADJUSTME14T February 25, 1941 8:00 A.M. Council Chambers Members present: Mr. NeCus, Mr. Adams & Mr. Kaspar. Members absent: Mr. Nesvacil and Mr. Higbee. Question: Mr. -Glenn Fillman asked for permission to erect a temporary Tabernacle "The Voice of the Prophet" on the following described property: Lot 1 - Ridgewood Addition to Iowa City, Iowa, or at the intersection of Court and Muscatine Avenue. The proposed building could not conform with the setback requirements of the Zoning Ordinance and would therefore constitute a non -conformity. Notice of the Public Hearing was published in the Iowa City Press Citizen on February 19, 1941. A remonstrance was presented against said petition signed by forty persons alleging to be property holders or persons living near proposed structure. Attorney Harold Veatermark represented the property owners who signed the remon- strance. Mr. Earl Waterman and Mr. Richard Horrabin spoYe against said petition. Nr. Glenn Fillman stated his reasons for wanting to place the Tabernacle on said property. It was moved by Kaspar and seconded by Adams that the case be postponed to Thursday, February 27th, at 8 A.M. and that the opinion of the City Attorney be obtained before action is taken. Upon roll call, there were: Ayes: Negus, Kaspar and Adams. Nays: None. Absent Higbee and Nesvacil. Motion carried. Moved by Negus and seconded by Adams that they adjourn until Thursdays Feb.27th,at 8:00 A.M. Motion carried. MINUTES OF MEETING OF BOARD OF ADJUSTMENT February 27,1941 5:00 A.M. Council Chambers Members present: Mr. Kaspar, Mr. Adams & Mr. Negus. Members absent Mr. Nesvacil and Mr. Higbee. Chairman ,- Mr. Negus. Question: Continuation of hearing on Mr. CTlenn Fillman's petiton to construct a temporary Tabernacle on Lot 1 - Ridgewood Addition to Iowa City. Written opinion from Mr. Robert L. Larson, City Attorney, was received and place on file. Said opinion ruled that if the Board believed that if actual damage would be done to the surrounding property then the permit should be denied. It was moved by Adams and seconded by Kaspar that the City Inspectet's action in refusing !r permit be upheld. Upon roll call, there were: Ayes: Adams, Negus, Kaspar. Nays: None. Council Chambers Members present: Mr. Kaspar, Mr. Adams, Mr. Higbee and Mr. Nesvacil. Members absent: Mr. Negus. Question: Mr. Frank Sponar representing the Ataudard 011 Company presented plans for remodeling, the Standard 011 Station at Linn and College Streets for approval as to location and arrangement as required in the Zoning Ordinance of Iowa City, Iowa. No objections were filed. It was moved by Mr. Kaspar and seconded by Mr. Nesvacil that the plans for the remodel- ing of the Standard 011 Company Station at Linn and College Streets be approved as to location and arrangement and that the City Inspector be instructed to issue a building permit for said station. Upon roll call, there were: Ayes: Kaspar, Higbee, Adams and Nesvacil. Nays: None. Absent: Negus. Motion carried. Meeting adjourned. MINUTES OF MEETING OF BOARD OF ADJUSTMENT March 27, 1941 8:00 A.M. Question: Mr. Glenn_ Fil_l4= asked for permission to place a e�y Tabernacle "The Voice of the Prophet" on the following described property: South 110 ft. of the East 50 ft. of Lot 8 - Block 6 - Original Town, or, at the northwest corner of Market and Governor Street. The proposed building, because it is atemporary structure must have the action of the Board of Adjustment. Notice of the Public Hearing was published In the Iowa City Press Citizen on March 25, 1941. �rt A remonstrance was presented against said application signed by property owners and occupants of property near the proposed site for said structure. Mr. Glenn Fillman spoke for his structure. Mr. Warren Hirsh, Mr. M. R. Bulichek, Mr. Ph -11 Englert and Mrs. Holubek spoke against the structure. It was moved by Kaspar and seconded by Adams that the City Inspector be instructed to deny said permit. Upon roll call, there were: Ayes: Negus, Kasper, Higbee, Nesvacil, and Adams. Nays: None. Motion carried. Question: FI&ine Griffen asks permission to enclose a porccone residence on West 40 ft. of the East 64 ft. of Lot 1 - Block 46 - Original Town. Board of Adjustment. S: 00 A.M. March 27,1941 It was moved by Mr. Higbee and seconded by Mr. Adams that Miss Griffen's request be granted and that the City Inspector be instructed to issue a permit for the porch enclosure on t)ae West 40 ft. of the East 64 ft. of Lot 1 - Block 46 - Original Town. May 1,1941 Members present: Mr. Adams, Mr. Kasper, Mr.. Higbee and Mr. Nesvacil. Absent: Mr. Negus. Chairman - Mr. Higbee. Question: Attorney Dan Dutcher petitioned the Board of Adjustment to set a date for Public Hearing on proposed substation to be con- structed on Lot 12 - Blk. 5 - Rundell Addition - in order to obtain a favorable recommendation of the Board of Adjustment to the City Council for the placing of said substation according to Article VII - Sec. 308 - Subsec.(h) of the Zoning Ordin- ance of Ioora City - 1936. It was moved by Kaspar and seconded by Adams that the matter be set for Public Hearing on May 7,1941, at 8:00 A.M. Upon roll call, there were: Ayes: Higbee, Or Nesvacil, Adams and Kaspar. Nays: None. Absent: Mr. Negus. Question: Dr. S. A. Neumann requests permission to place a ront house line of a proposed residence within 8 ft. of the front building line and that does not meet the lot line building reuirements as set out in the Zoning Ordinance of Iowa City, Iowa. Said Residence is to be constructed on the follow- ing described property: Beginning at a point 240 ft. South of the Northeast corner of Block 7 - Manville Addition, thence West 150 ft.; thence South 160 ft.; thence East 150 ft.; thence North to the point of beginning. Notice of Public Hearing was published in the Iowa City Press Citizen on the 25th of April, 1941. No objections were filed. It was moved by Kaspar and seconded by Adams that the City Inspector be authorized to issue a building permit to Dr. S. A. Neumann to construct a residence on the above mentioned property. Vin Tompkins requested permission to remodel present residence at the southeatt corner of Dubuque and Davenport Streets more specifically set out as the North 45 ft. of the West 65 ft. of Lot 4 - B1k. 69•L Original Town. The lot line requirements will not meet those established by the Zoning Ordinance of Io*,Ta City and the lot area requirements per family cannot be met. It was moved by Higbee and seconded by Nesvacil that Mrs. Tompkins be instructed to publish a notice of Public Hearing and that said Hearing be held at 8:00 A.M. biay 7, 1941. Motion carried. It was moved by Kaspar and seconded by Nesvacil that the Board adjourn to meet again at 8:00 A.M., May 7, 1941. Chairman - Mr. Negus. Question Public Hearing on Mrs. Vine Tompkins's request to remodel present reside ce on the North 45 ft. of the West 65 ft. of Lot 4 - Block 69 - Original Town. Lot line requirements will not meet those established by the Zoning Ordin- ance of Iowa City and the lot area requirements per family cannot be met. Notice of Public Hearing was published in Iowa City Press Citizen on May 1,1941. A remonstrance was filed objecting to the proposed work and was signed by twenty-three residents and property owners in that vicinity. Speaking against: Mrs. Elizabeth Kane, Mrs. F. J. Wicks and Mrs. L. C. Ansel. Speaking for: Mr. Lamarr Tompkins. He presented a plat of the houses on the east side of Dubuque Street and on the south side of Davenport Street. It was moved by Mr. Kasper and seconded by Mr. Negus that the City Inspector be upheld in his denial of a permit to Mrs. Tompkins. Upon roll call, there were: Ayes: Negus, Kaspar and Higbee. Chairman: Mr. Negus Question: Continuation of the ZwaCity Light & Power Company's request for a favo"4alTi'e recommenda- t off- oi'"the Board of Adjustment to the City Council for permission to place a substation on Lot 12 - Block 5 - Rundell Addition - in accordance with Article VII -Sec. 308 - Sub- section (h) of the Zoning Ordinance of Iowa City, Iowa. Continued from the meeting of May 7, 1941. Speaking for Light Company: Attorney Dan C. Dutcher and Mr. Roscoe Taylor. Speaking against: Attorney Floyd Brant. Attorney Brant also filed written objections signed by seventeen property owners and residents of the immediate neighborhood and a letter of objection from W. R. Kern of Chicago who is a property owner in the neighborhood. It was moved by Mr. Nesvacil and seconded by Mr. Kaspar that recommendations be made that the City Council grant the application of the Iowa City Light & Power Company to place a substation on Lot 12 - Blk. 5 - Rundell Addition to Iowa City with proper restrictions as to care and upkeep of both lot and sidewalk and as to the wishes of the adjoining property owners being complied with as to landscaping and care of lot. Objections: Mr. Negus received a telegram from Mrs. Elizabeth Kane objecting to proposed plans. A remonstrance signed by fourteen residents and property owners objecting to proposed plan was filed. Discussion: Mr. Gordon Webster asked permission to divicTe—has property on S. Clark Street, legally described as follows: Beginning at a point in Clark Street, Summit Hill Addition to Iowa City, Iowa, forty feet South of a point thirty feet East of the Southeast corner of Lot 6, Blk. 4, in said Addition, thence South 70 ft., thence East 265 ft., thence North 70 ft., thence West 265 ft. to the point of beginning, so that a residence may be built on the East 100 ft. of the above tract. Sept. 6,1941 Members present: Mr. Negus, Mr. Adams & Mr. Nesvacil. Members absent: Mr. Higbee and Mr. Kaspar. Question: Due to a misunderstanding thru the plans submitted and the minutes of the meeting of May 26, 1941, it was necessary to call the members of the Board of Adjustment to get the actual action of the Board as on May 26, 1941. The minutes of the meeting of May 26,1941, regarding the action taken by the Board on the petition of Mrs. Vina Tompkins and Mr. LaMarr Tompkins be corrected to read as follows: It was moved by Mr. Nesvacil and seconded by Mr. Kaspar that the City Inspector be authorized to issue said Permit with the southwest alteration to be made even with the porch and that all other parts of said applications for alteration shown on the plans submitted be refused.
