be authorized by the Board of Adjustment only after a public

use; shall be non -transferable; and shall be issued to the
person or persons who propose to use the premises as the

South Riverside Drive Area Comes Under Fire—
Zoning Ordinance Raises Controversy
One of Iowa City's zoning ordi-
nances became a controversial is-
sue in a somewhat heated discus-
sion at the city council meeting
Monday night.
The area in question is that on
the west aide of Riverside drive
south of the Burlington street—
Melrose avenue Grand avenue
The controversy was touched
off by a letter received by the
council from the city planning and
zoning commission relative to a
business establishment located
across the street from the hy-
draulics building.
In its letter, the commission said
it had been noted that the business
there had recently changed from
a steak house to an ice cream
stand and that some changes in
the location had been made, yet
no building permit was ever taken
out with the city by the owner in
order to legally make any changes.
The commission recommended
that the council instigate legal
action against the owner for vi-
olation of the building permit
rule.
Prof. Allen C. Tester, chairman
of the planning and zoning com-
mission, said it appeared that
there had been a permanent al-
teration to the building as a con -
crate slab and canopy had been
added in front.
The commission also claimed
that any business operating on the
west side of South Riverside drive
is doing so illegally because the
area is zoned as a Class A rest-
dential area.
City Engineer Fred Gartzke
told the council that in his opinion
there had not been enough change
In the building to constitute an al-
teration to the premises and
therefore he did not think a per
mit was necessary.
He added he did not consider
the awning or concrete slab a
structural alteration.
Atty. William H. Bartley, speak-
ing for the Dairy Queen Ice cream
shop now doing business at the
location, said 1n regard to the al-
legation the business is operating
illegally that there is a flexible
clause in Iowa City zoning laws
which would permit such an op-
eration 1f it had been going on
for a number of years.
An argument then developed be-
tween Attorney Bartley and Coun-
cilman Walter L. Daykin over the
question of why had such zoning
vlolations been allowed to exist.
Mr. Daykin asked Attorney
Bartley why such violations had
not been enforced in the past, pan
ticularly at a time when he ,(Bart
ley) was a city official and the
attorney replied to Mr. Daykin.

being .enforced by the present
council."
City Manager Peter F. Roan
also entered the discussion, say-
ing the South Riverside drive area
is zoned "unrealiatically" as s
Class A residential area and that
"no one In their right mind would
build a home in such a location."
Attorney Bartley declared the
council could not take action re-
garding the legality of this par-
ticular instance of a zoning viola-
tion "unless it wants to start
cleaning up all the zoning viola-
tions in the city."
At times during the discussion
the issue became clouded as to
whether the illegality was over the
zoning violation or the building
permit violation.
Professor Tester said the Issue
was that the commission contends
the business had been enlarged for
business purposes without obtain-
ing a permit as required by law,
