S. Objections: None Motion: In a.ccordance with par. 322, Section E, of the Iowa City Municipal Code, authoriz- ing the issuance of such permits as requested by L. Hagerdon for permission to erect a garage, it was moved by Kasper, seconded by F.ves, that the Building Inspector be ,uthorized to issue a permit for the garsge in accordance with the plat filed with the City Inspector. Schmidt petitioned for permission to erect a residence on the following described property: South 40' of Lot 2 and the North 201 of Lot 3, Block 12, and the South 20' of the North 40' of the W� of Lot 2, Blk 12, Manville Addition with a side yard of six feet on the side of said property instead of eight feet as required by the Ordinance. Objections: None Motion: The question was discussed and the Board was of the opinion that this would indeed be a minor variation from the Code. It was moved by Kasper and seconded by Neavacil that the Building Inspector be authorized to issue Mr. Schmidt a permit to construct the residence according to his request. Ayes: Higbee; Kasper; Neavacil Nayes: None Absent: Anderson; Eves Motion carried. Question #2 James H. Schmidt asked permission to add an addition to his residence on the W601 of the S50' of Lot 4, Block 32, 0. T., which would exceed the 25% area limit according to the Zoning Ordinance. Objections: None Page 1 March 15, 1952 Page Two Motion: It was moved by Nesvacil and seconded by Kasper that the Building Inspector be authorized to issue a permit for said addition. Question #j Leslie Moore petitioned for approval to construct a residence on the E60' of Lot 5 and part of Lot 4, Block 51, East Iowa City, comprising an area of 4200 sq. ft.; including the adjoining alley on the East, tine area is 4900 sq. ft -which is short of the area re- quired. Objections: None Motion: It was moved by Kasper, seconded by Higbee, that the petition be granted with the stipulation that the minimum distance between the proposed house and the existing house on Lot 5 be 18 feet. Question:&,Z,, an Epps petitioned the Board o ustment to construct an attached garage to his residence at 320 W. Park Rd. on lot 3, Block G, Blacks Park Addition with a front yard set back of 13.3 ft. from the lot line which is non conforming to the zoning Ordinance which provides for a minimum set back of 25 feet. In this action the Board considered the north line of Park Rd. as being 50 feet north antiparallel to the established south line of Park Rd. Therefore, the petition falls in that classification of a minor variation. Objections: None Motion: It was moved by Kasper and seconded by Nesvacil that the petition be granted. Question #2: Uharles A. Currar petitioned for permission add an` addition to his existing residence located on the E. 4Q' of the N. 50' of lot 4 Block 16 or 6; Davenport which will cover 32.2 of the lot area instead of 25% according to the Boning Ordinance. T. into 3 separate parcels accordong to plats submitted. The Board recoomended the the devision as shown on submitted plat #1, on file, as the area on which future action for buildin permits will be considered, and instructed the Secy, to advise t_e Admin— istrator to that effect. MINUTES OF MEETING OF BOARD OF ADJUSTMENT SEPT 27, 1952 Question *1 B. J. Berry, operator of Bobs Grocery Store on the N. 4-01 of the S. 46, of Lot 12, Blk 17, dyots 2nd Add, otherwise known as 519 S. Dodge St., petitioned the Board of Adjustment to add a 129 X 8" addition to the existing store, which by ordinance requires the approval of the Board, in that the location is in the residential district. Objections: There was no public hearing held and no objection raised. Notion: It was moved by Higbee that the petition of Mr. Berry be granted, provided that the two adjacient property owners on each side, do not object, and further provided that the addition be added in conformity with the sketch attached to the petition and that the signed consent of the specified property owners be filed with the City Inspector. The particular cases relates to lot 7. block 9 Chautauqua Heights addition, this being o lot platted between River and Otto streets and east of Woolf Avenue. The plat shows a neer-rectmngular lot of approximately 50 feet vrldth and 203 feet average depth. A shall house now exists on the north end of this lot facing River Street. Now carol a proposal to divide the lot end sell the south portion for another residence which will face on Otto Street. Any possible division of this lot could`faot produce two lots with the minimum of 6000 square feet required In e "Residential tA" gone. If the south portion Is rade a minimun of 6000 square feet for a new residence that will leave approximately 4150 square feet area for the existing house which is sub standard for the zone. Motion: The Ordinance requires 2000 sq. ft. of lot area per family or a total of 8000 sq. ft. the lot in question has an area of 6400 sq. ft. Motion: It was moved by Kasper and 2nd by Eves that the petition of Mr Donohue be granted providing that the north side yard conforms to the exsisting house line. W Y Is li MINUTES OF MEETING OF BOARD OF ADJUSTMENT, DECEMBER 8, 1953 City Hall Members Present: Eves, Higbee, Xtller Members Absent: Anderson Question: The Board of Adjustment was called by the Bldg Inspector, for the purpose of gettin an interpation of the Ordinance in regard to the legality of constructing a brick gardon wall along a side yard property line, the -all to be from Oft to 6 ft in height. The wall to be located on what constitutes the front half of the neighbors side yard. The Board of Adjustment commends the Building Inspeotor for his caution with respect to the interptLtatiofio/ of the Zoning Ordinance in the matter of a gardon wall at 120 AI. Dodge Street. The front building line of the porch being 6.5+ from the property line in violation of the Zoning Ordinance. The petitioner states that all the houses in the block were built many years prior to the passage of the Zoning Ordinance at an average distance of 9' from the front lot line. Objections: The petitioners filed;a written statement by the neighbors on each side that they do not have any objection. Said Church tp be located with front line set -back of 11 feet from the Bloomington Street side, contrary to the ZOnirg Ordinance. Objections; None Motion It was moved by Schlaegel and second by Miller that the Board of Adjustment direct the Building inspector to issue a permit A, to the Zion Luthern Shurch for a building with a set -back of 11 feet as indicated on the plans as filed, subject to the filing of a statement of consent by adjoining owners. The Petitioner states that the house was constructed at 3 1 feet from the lot line instead of 6 feet by error, The cetitioner attached a letter by Llr. Gay owner of the property adjoining stating that he has no objections. Motion It was moved and 2nd that the request of Lir Ray Hutt be granted. College Street Three possible arrangements were submitted.
