Mr Clifford Berkey owner of the E 43 feet of
lot 1 and the . 26 feet of the E 43 feet of
lot 2 bjocJ: 9 County Seat addition petitioned
the Board to convert the Building located on said
property into a 6 unit appartment, The bulling
bein;T located in the business district without a
front line set -back on Linn Street, and without
a side yard set -back on Harrison St. which is not
incordance with the '_oning Ordinance.
Objections
There were no objections filed.

that the board reccomeds that the permit be
granted vrith the porviso the off street parking be
provided for each appartment unit.

feet a violation of the 10 side yard requirement.
The petition states that the adjoining neighbor has
no objection.

building , a violation of the zoning ordinance.

Moved by Mr. Sohlaegel and 2nd by Mr. Miller
that the petition be approved, provided that
off street parking can be provided.

The Standard Oil Company requests the approval
of a neer layoutpor their Oil Station in

approved.

requirement for said property, would require
a rear yard of 19. 8 ft. according to the
zoning Ordinance.

lint. The required side yard for a corner
lot is 15 feet.

Moved by Mr. Schlaegel and 2nd by Miller that
the etition be approved. with the understand-
ing that the drive,says be aved as shown on the
plat submitted and also providing 3 stalls for
cars as shown.

apartrients on said property with front line

Motion It was moved by Mr. Schlaegel and 2nd by Mr.
Fres that the petition of I.tr. Fairbanks be a-
pproved.

Question 7 It was moved by Mr. Schlaegel and 2nd by Mr.
Eves that 11c1r. Higbee be elected Chairman of
the Board of Adjustment for the year of 1956.

Question #1: Mr. Elmer Sammons, owner of Lot 12 in Blk. 20
Vast owa y, petitioned the Board of Adjust-
ment to be permitted to divide said lot in such
a manner as to allow him to construct a new house
on the front portion of said lot and allowing
the small house in the rear of said lot to remain
and to be continued to be occupied/as a residence.
The petitioner filed a statement with the
Board of Adjustment signed by the owner of the
property to the south that he had no objection
to the said division.
Motion It was moved by Schlaegel and seconded by Higbee /
that the petition of Mr. Sammons be denied ''and I/
that the building inspector be instructed to
itform the petitioner that if he records an agree-
ment that the use of the small building in the
rear of the said lot as a residence will be dis-
continued -within three years after the new house
is completed, the building inspector is instructed
40 to issue a permit.fsm.the new house.

Motion: It was moved by Miller and seconded by Schlaegel
that Mrs. Kondorats petition be granted.

Question ,',13: Mr. John B ushman petitioned the Board of Adjust-
ment for permission to add an addition to his
residence located on the north z of Lot 4 Blk. 12
in East Iowa City Addition. Said addition will
result in a front line set -back of 22 ft. instead
of the required 25 ft.

that Mr. Bushman's petition be approved.

Por permiss ion to extend his existing garage
located on the 'aest 75 feet of the North 150
feet of Block 8 Manville Addition otherwise
mown as 250 Lexington Ave, 8 feet South whcich
will put it within 8t 10inches from his neighbor
Lot line to the South, in violation of the
Zoning Ordinance which requires a set -rack of 10
feet. The pettioner filed aA affidavit signed
by the neighbor, Mr. Harry Dean stating that he
had no objection to the extention of said garage
to that location.

Isar. Richard Jones petit -coned the Board of
adjustment t to construct.' a Residence on
the following described lot; Commencing at a
point 60 feet North of the N. 'vV. corner of
Lot 10 in Block (E) in Black1s Park Addition,
Thence N 150 feet, Thence East 80 feet; Thence
South 150 feet and Thence Ylest 80 feet to point
of beginning,otherwise Imown as 180 Oak Ridge
Street. Said. Residence to have a front line
set -back of 21 feet instead of the required
25 feet. The petitioner states that this re-
quest is made because of the roc:; formation
and very steep slope of the Lot. He further
states that the Board of Adjustment has already
granted his neighimr, Mr. Davies a similar
request.

Miller that the petition of Mr. Jones be granted.

Lots having been duly approved as an Oil Station
site by the Board at their meeting of March 13,195u.
Motion. It Jas moved by Par. P;Iiller and seconded by Mr
Caldwell that the Layout and plat be approved.

Question. 3. Mr. C. L. Woodburn owner of the Porth 100
-reetf Lot 1 and the North 100 feet of the East
20 feet of Lot 2 Block 13, East Iowa City,
Addition. Petition the Board of Adjustment
to add an addition to the existing old house
for which he proposes to occupy , the East
4.0 x 80 of the above discribed property; The
area in question having an area of only L.000
square feet or 21000 square feet short of the
required area.
Motion. It was moved by Mr. Miller and seconded by Mr.
Caldwell that the petition be denied, and that
the building inspector be directed to inform
Mr. 'Woodburn that if he removes the old house,
The Board would give him permission to sub -divide
the property into 2- 50 foot Lots, otherwise he
would be limited to but one Residence on that
intire property.

Question I
Mr. Francis Frees owner of the follow-
ing descr ed Tact, commencing at the
S.W. Corner, SE 4 Sec. 4-79-6, thence
E 10.9;, thence N 25 feet to the point
of beginning; thence N 140 feet , E 701;
S 140 feet, thence W to the point of be-
ginning. The S line of the above desribed
tract is 25 feet N and parallel to the S
line of Sec 4 which is supposedly the
center line of Park Road; however, the
S line of Park Road or the N line of Man-
ville Addition is 55 feet south of said
Sec line making Park Road 80 feet at
this point against 50 feet wide at Zbm-
plin Road. The Center line of the pav-
ing on Park Road was placed on line 25Y
N and parallel to the S line of Park
Road putting the curb line 42 feet S of
the N property line.
For this reason the petitioner asks the
Board to approve a set -back of 31 instead
of the required 251 which will put his
house in line with the houses to the E
which were built prior to the time this
area was incorporated in the city.

be approved. Seconded by Caldwell.

He petitioned the Board for permis-

line set -back 25 feet. The average
set -back of the houses in the block
is 312 feet.
The Petitioner filed a petition
signed by the.adjoining owners stat-
ing that they had no objection.
Motion It was moved by Caldwell that the
petition of Mr. Franklin be approved.

Question I Mr. J. 4. Kuebrich petitioned the Board
of A ustments to enclose the front of
his residence with glass. Said residence
is located on the S 401 of the W 551 of
Lot 5, Block 36, Original Town; otherwise
known as 502 E Davenport Street.
The residence in question is located on
said lot with a front line set -back of
1021 with a porch 8+ within but 2P from
the front property line. The average
front line set -back of the rest of the
houses in the block is 1121. The peti-
tioner asks that the 221 set -back be
approved.
Mr. Kuebrich filed a petition signed by
all the property owners in the block on
both VanBuren and Davenport Street, that
they have no objections to the 221 set-
back. There were no objections.
Motion It was moved by Eves that the petition
of Mr. Keubrich be approved. Seconded
by Miller.

Eves.

Question II Gerhard & Judith 'Wolff, owners of Lot 7,
Block 3, East Iowa City Addition, other-

They petitioned the Board for permission
to enclose the front porch of the residence
located on the above described property.
Said front porch in location but 41 from
the front line of the lot. The house
located imediately N is 141 from the
front and the house to the S is 201 from
the front lot line. The petitioner filed
a petition signed by the neighbors to the
November 13, 1956
S stating that they have no objections.
The petitioners failed to get the signa-
tures of the owner immediately North.
Motion It was moved by Even that the petition of
Mr. Woolf be granted providing that a
petition approved by all the owners in
the block be filed with the building in-
spector. Seconded by Higbee.

Jones Harriett 011 Company petitioned the Board
of AdjustFent for approval of the following
described tract as a site for an oil station
with a layout as per Plat submitted.
Commencing at the intersection of the East
line of Riverside Drive and the South line of
Myrtle Avenue extended Easterly, thence Southerly
along the East line of Riverside Drive 157 feet,
thence East to the West bank of the Iowa River
thence Northerly along the West bank of the river
to a point due East of the point of beginning.
Said location being in the business district.
Motion:
It was moved by Stuck and seconded by Caldwell
that the petition be approved both as to location
of site and layout plans.

Mrs. Tom Bauer, owner of the West 50 feet of

Board for permission to enclose the front porch
of the residence location on said lot with glass.
The front porch extends within 2ifeet of the
front property lines. The average setback of the
houses in the block is 121' and the average set
back of the front porches is 10 feet.

on Lots 1 to 9 inclusive in Longfellow's Additicn with
a minimun setback of 10 feet from Maple Street.

to the Zoning Ordinance.

Original Town, otherwise known as 520
Brown Street, petitioned the Board for
permission to construct the second dwelling
in the rear of said property; said rear
portion having no frontage on a street
and beim; accessible by a 10' easement
to Johnson Street. The building inspect—
or regarded this as a violation of the
Zoning Ordinance.
Objections: Several adjoining owners voiced their
disapproval orally and by telephone.
Action: No specific action was taken. The
Board recommended that the owner submit
an orderly plan to the Zoning & Planning
Commission for the developement of this
property and this adjacent property for
approval.
Question #2 Mr. Clarence J. Diehl, owner of the West

East 20' of the North BO' of Lot 2,
Block 47, Original Town, otherwise
known as 419 East Bloomington Street,
petitioned for the approval of the
construction of an attached garage,
which would come within 21 feet of the
side property line and 2 feet from
the rear property line. Th e house with
the attached garage constituted a single
structure making the 2z' foot side yard
requirement and the 2 foot rear setback
a violation of the rear yard requirement.
Motion: It was moved by Miller and seconded by
Caldwell that if the applicant files a
written consent from the neighbor to the
West that he has no objection to placing
the garage at the above described location,
the building inspector be authorized
to issue a permit for same.

Question #3 The B'Nai B'rith Hillel Foundation of the
State University of Iowa, through their
Director, Fredrick P. Bargebuhr, petitioned
the Board of Adjustment for permission
to remodel the garage located in the rear
of the following: The East 65' of the South
100' of Lot E and the West 15 feet of Lot 8
and the East 17 feet of Lot 7, Block 77,
Original Town, otherwise known as 122 East
Market Street. Said garage to be remodeled,
occupied as a dwelling in violation of the
Zoning Ordinance.
Motion: It was moved by Higbee and seconded by Stuck
that a permit be issued to convert said
garage to residential providing that it is
not to be rented and the use of same to be
in conjunction with the chapter house of
BINAI BRITH HOLLEL FOUNDATION only.

Motion:
It was moved by Higbee and seconded by
Caldwell that the Board of Adjustment is
of the opinion teat under the current
Zoning Ordinance the Building Inspector
has no authority to grant or deny a permit
for
parking lots. Moreover, thee.rea proposed
by the
Benner Tea Company for a parking lot
is in District A where such a use is not
permitted in accordance with Section 108.5,
1951 Municipal Code.

an 6 un apartment building at 41 Valley Avenue,
being lot 19, Suburban Heights; being of noncon-
formity in area of lot required per apartment.
There being 1637 sq.ft, per apartment instead of
the 2000 sq.ft. lot per apartment, in Class "B"
Resident Districts.
Motion: It was moved and seconded that the petition be
granted with the agreement that at least six
parking spaces be provided on the lot for auto-
mobiles.

Question #2 Sinclair Refining Compar�y petitioned through their
represen atm arlesh. Steele of Iowa City that
permission be granted to remodel pumping and stor-
age facilities at their oil storage facilities of
four large tanks and shed located in an "A" resident-
ial district at lots 16 and 17 of Block 4, Pages
Addition, on the corner of Page and Webster Street.
No oil tanks are to be added, but new pumping facil-
ities (replacing gas driven pumps) are to be provid-
ed, and a new shed to be placed on the rear of the
existing oil storage tanks, replacing an old metal
shed now existing in front of the tanks at the N.
line of Page Street. This non -conformity has exist-
ed for approximately 30 years, and is on railroad
property; but has not been used much since World
War II.
Motion: Moved by Stuck, seconded by Miller that a permit
for remodeling this property and area as indicated
by the submitted plan, including arranging the
service driveway and landscaping and planting the
area to improve appearances on Page Street, be
granted, subject to approval in respect to fire
rggulations.

property. The proposed purchaser, Leo Meade,
states in a separate petition that he proposes
to construct a new dwelling on the said tract.
This sub -division would leave Mr. Gerber a
lot area of 2,000 square feet for his existing
house and would provide an area of only 3,000
square feet for the proposed new dwelling,
making both non -conforming with Chapter 108.9
of the 1951 Municipal Code of Iowa City.

the intention of the petitioner to use the
existing garage as a shop, and the carport
for his car. The addition of the carport makes
the total building area for this lot exceed
the allowable limit of 25% and therefor con-
stitutes a non -conformity under the zoning
ordinance. The house on this lot is a duplex
and in addition is occupied by 6 student
roomers.
