Notice is hereby given that a public hearing will
be held at which the Council will consider:
An appeal to the City Council of the
decision of the Historic Preservation
Commission denying a Certificate of

An ordinance conditionally rezoning
property located south of Kennedy

Family (RS -12), Low Density Multi -Family
(RM -12), and Medium Density Multi -
Family (RM -20) for approximately 27.19

public examination in the office of the City Clerk,
City Hall, Iowa City, Iowa, which is currently closed
to the public because of the coronavirus. Copies

The public hearing will be held at 7:00 p.m. on
February 2, 2021, in Emma J. Harvat Hall of the
Iowa City City Hall, 410 E. Washington Street,

using the Zoom Meetings Platform. For

Whereas, the owner, Crossing Land, LLC, has requested a rezoning of approximately 27.19
acres of property located west of Camp Cardinal Boulevard and south of Kennedy Parkway from
Interim Development — Research Park (ID -RP) to Rural Residential (RR -1), High Density Single -
Family (RS -12), Low Density Multi -Family (RM -12) and Medium Density Multi -Family (RM -20); and
Whereas, this property is located within the Clear Creek Master Plan subarea of the Iowa City
Comprehensive Plan; and
Whereas, there is a public need to provide pedestrian facilities along the western side of
Camp Cardinal Boulevard; and
Whereas, there is a public need to incorporate traffic calming devices to address concerns
related to speeding along Preston Lane; and
Whereas, there is a public need to ensure compatibility with the existing development pattern
of the neighborhood; and
Whereas, there is a public need to ensure long-term management of the preserved
woodlands; and
Whereas, the Planning and Zoning Commission has determined that, with reasonable
conditions regarding compliance with the concept plan for the townhome style, multi -family
buildings; landscaping and screening; traffic calming; installation of a sidewalk along Camp
Cardinal Boulevard, and a woodland management plan to address these public needs, the
requested zoning is consistent with the Comprehensive Plan.
Now, therefore, be it ordained by the City Council of the City of Iowa City, Iowa:

Section II. Zoning Mao. The Building Inspector is hereby authorized and directed to change
the zoning map of the City of Iowa City, Iowa, to conform to this amendment upon the final
passage, approval and publication of this ordinance by law.
Section III. Conditional Zoning Agreement. The mayor is hereby authorized and directed to
sign, and the City Clerk attest, the Conditional Zoning Agreement between the property owner(s)
and the City, following passage and approval of this Ordinance.
Section IV. Certification and Recording. Upon passage and approval of the Ordinance, the
City Clerk is hereby authorized and directed to certify a copy of this ordinance and to record the
same, at the office of the County Recorder of Johnson County, Iowa, at the owner's expense, all
as provided by law.
Section V. Repealer. All ordinances and parts of ordinances in conflict with the provisions of
this Ordinance are hereby repealed.
Section VI. Severability. If any section, provision or part of the Ordinance shall be adjudged to
be invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a
whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
Section VII. Effective Date. This Ordinance shall be in effect after its final passage, approval
and publication, as provided by law.

This agreement is made between the City of Iowa City, Iowa, a municipal corporation JAN 19 2021

Whereas, Owner is the legal title holder of approximately 27.19 acres of property jtwWXity, Iowa
west of Camp Cardinal Boulevard and south of Kennedy Parkway; and
Whereas, Owner has requested the rezoning of said property from Interim Development —
Research Park (ID -RP) to Rural Residential (RR -1), High Density Single -Family (RS -12), Low
Density Multi -Family (RM -12) and Medium Density Multi -Family (RM -20); and
Whereas, this rezoning creates public needs to provide pedestrian facilities along the
western side of Camp Cardinal Boulevard, to incorporate traffic calming devices to address
concerns related to speeding along Preston Lane, to ensure compatibility with the existing
development patterns, and to ensure long-term management of the preserved woodlands; and
Whereas, the Planning and Zoning Commission has determined that, with reasonable

Whereas, Iowa Code §414.5 (2021) provides that the City of Iowa City may impose
reasonable conditions on granting a rezoning request, over and above existing regulations, in
order to satisfy public needs caused by the requested change; and
Whereas, the Owner agrees to develop this property in accordance with the terms and
conditions of a Conditional Zoning Agreement.
Now, therefore, in consideration of the mutual promises contained herein, the parties agree as
follows:

2. Owner acknowledges that the City wishes to ensure conformance to the principles of the
Comprehensive Plan. Further, the parties acknowledge that Iowa Code §414.5 (2021)
provides that the City of Iowa City may impose reasonable conditions on granting a
rezoning request, over and above the existing regulations, in order to satisfy public needs
caused by the requested change.
3. In consideration of the City's rezoning the subject property, Owner agrees that
development of the subject property will conform to all other requirements of the Zoning
Code, as well as the following conditions:
a. Development shall substantially comply with the concept for the area shown as
"Lot 54" on the preliminary plat, attached hereto and incorporated herein by this
reference, which includes townhouse -style, multi -family dwellings with vehicular
access to garages from a rear lane with green space and landscaping between the
rear driveways to reduce impervious surface and improve stormwater drainage.
b. Prior to approval of any site plan for the RM -12 -zoned land, Owner shall obtain
staff approval of a landscaping plan for said property which shall include the plans
for useable outdoor space and screening of garages from adjacent public rights-
of-way.
c. The final plat for any of the above-described land shall incorporate traffic calming
devices in locations approved by and designed to the satisfaction of the City
Engineer.
d. Prior to the issuance of a certificate of occupancy for an of the above-described land,
construction of a 5' sidewalk on the west side of Camp Cardinal Boulevard between
Preston Lane and Kennedy Parkway.
e. Outlots I and J, as shown on the preliminary plat, shall be managed according to a
woodland management plan approved by staff prior to issuance of a building permit
for any of the above-described land.
4. The conditions contained herein are reasonable conditions to impose on the land under
Iowa Code §414.5 (2021), and that said conditions satisfy public needs that are caused
by the requested zoning change.
5. This Conditional Zoning Agreement shall be deemed to be a covenant running with the
land and with title to the land, and shall remain in full force and effect as a covenant with
title to the land, unless or until released of record by the City of Iowa City. The parties
further acknowledge that this agreement shall inure to the benefit of and bind all
successors, representatives, and assigns of the parties. In the event the subject property
is transferred, sold, redeveloped, or subdivided, all development will conform with the
terms of this Conditional Zoning Agreement.
6. Nothing in this agreement shall be construed to relieve the Owner from complying with all
other applicable local, state, and federal regulations.
7. This agreement shall be incorporated by reference into the ordinance rezoning the subject
property, and that upon adoption and publication of the ordinance, this agreement shall
be recorded in the Johnson County Recorder's Office at the Owner's expense.

The Planning & Zoning Commission recommends approval of REZ20-0013 the
rezoning of 27.19 Acres located South of Kennedy Parkway and West of
Camp Cardinal Boulevard from Interim Development— Research Park (ID -RP)
to Rural Residential (RR -1), Low Density Multi -family Residential (RM -12),
High Density Single -Family Residential (RS -12), and Medium Density Multi -
Family Residential (RM -20) zones subject to the following conditions:
Conditions
1. Development shall substantially comply with the concept plan for the area shown as "Lot 54"
on the preliminary plat, which includes townhouse -style, multi -family dwellings with vehicular
access to garages from a rear lane with green space and landscaping between the rear
driveways to reduce impervious surface and improve stormwater drainage.
2. Prior to approval of any required site plan, Owner shall obtain staff approval of a landscaping
plan which shall include the plans for useable outdoor space for "Lot 54" on the preliminary plat
and screening of garages along Declan Drive and Mason Drive.
3. At the time of final platting, incorporation of traffic calming devices in a location approved by
and designed to the satisfaction of the City Engineer.
4. Prior to the issuance of a certificate occupancy, construction of a 5' sidewalk on the west side
of Camp Cardinal Blvd between Preston Lane and Kennedy Parkway.
5. Outlots I & J as shown on the preliminary plat, shall be managed according to a woodland
management plan approved by staff prior to the issuance of any building permits.

"To insulate older homes, you must remove the cladding and weather barrier, drill the
sheathing and blow or inject loose fill or foam insulation, replace the windows, install

1403.2 Weather Protection
Exterior walls shall provide the building with a weather -resistant exterior
wall envelope. The exterior wall envelope shall include flashing, as
described in Section 1405.4. The exterior wall envelope shall be
designed and constructed in such a manner as to prevent the
accumulation of water within the wall assembly by providing a water
resistive barrier behind the exterior veneer, as described in Section
1404.2, and a means for draining water that enters the assembly to the
exterior. Protection against condensation in the exterior wall assembly
shall be provided in accordance with Section 1405.3.

• Our proposal is to remove the damaged siding, add a vapor barrier, seal areas
pests can enter, and replace the siding and trim with HPC recommended materials
such as fiber cement board with a smooth finish (4.11: Siding), that returns the
home to its original aesthetic.
• This conforms with ICHPP requirements, Iowa City building codes, and best
practices set forth by the climate action plan
HPC's Denial
By a vote of 1-5 (Boyd, DeGraw, Kuenzli, Sellergren and Wu voting no), the Commission failed to approve a Certificate of
Appropriateness for an alteration project at 1133 East Court Street, a contributing property in the Longfellow Historic District.
The proposal consists of the removal of the aluminum siding in its entirety and either the installation of new aluminum siding
or cement board siding over any existing historic siding or the removal of any existing siding in its entirety, regardless of
condition and replacement in cement board in a configuration to be determined by the applicant. The existing trim is also
proposed to be replaced regardless of condition, in a configuration to be determined by the applicant.
• Misleading statements:
o During the meeting Staff and HPC discussed and acknowledged the absence of wood siding and trim on
large portions of the home, and the damage present from the blown -in insulation , and the lack of a vapor
barrier
o At no point did we indicate we wanted to determine the final configuration without HPC input. We have
always, and continue to welcome and abide by HPC input.
o More than 2 years of emails with Staff discussing this project
o During the meeting, Mrs. Clore welcomed discussion from Keunzil who indicated she may have historic
information on the home from a personal contact
Reason #1
1) The proposal does not meet the standards set in section 3.2, 4.11 or 4.14 because it would remove historic wood
siding and trim that is not deteriorated and replace it with new material that does not match the existing (4.11), or it
would cover original wood siding with another material leading to the potential of increased further damage (4.14). In
addition, the Commission could not find an exception to the guidelines to approve the proposal since this
proposal does not meet the conditions of any documented exceptions, the situation is not uncommon, and the
guidelines are not silent or unclear on this topic
Our response:
We are not asking for an exception. Per the Historic Preservation handbook we are proposing recommended
material, previously approved by the HPC for other projects, to be used.
Section 3.2 states:
"The guidelines leave to the discretion of the Commission the particular calculus used to determine the appropriateness of various
projects. These considerations are largely determined by the historical integrity of the structure, the various elements which would
be impacted, the scope of work, the materials used, etc., which vary from project to project."
Section 4.11 and 4.14 both state:
Substituting wood siding is allowed "if the substitute material retains the appearance and function of the original wood. The
substitute material must be durable, accept paint and be approved by the Historic Preservation Commission. In many applications,
fiber cement board with a smooth finish is an approved wood substitute"
There are many examples of projects that were allowed the replacement of wood siding with cement board siding using the
discretion given in these sections

asbestos siding. No one knows what is underneath the existing synthetic siding and
insulation. If they find asbestos shingle siding in good condition, they may keep it. She said

or found to be in poor condition, staff recommends new cement board shingle siding
to capture the original intent.
Bristow reiterated that this project has a large scope: Removal of the garage, construction
of a new garage, a house addition, and window and siding replacement. Staff

Excerpt from minutes of December 10, 2020 HPC meeting
"Bristow said one project where all of the original siding was approved
to be removed was a house that was insulated without a vapor
barrier being able to be installed. She referred to the Bob Yapp article.
Bristow said moisture from the interior of the house migrates into the wall
and condensates in the wall cavity. The insulation holds that moisture
and does not dry out.
Bristow said that this issue was obvious on the house at 424 Clark Street
because it was possible to see that the siding was failing and could
no longer hold paint. Because of the deteriorated siding, the owner was
approved to replace it with cement board."
Reason #2 and #3
• Wood siding and trim details combine to make one of the most important defining characteristics of historic districts
and are therefore protected by the guidelines
• The proposal contradicts Standard 2 of the Secretary of the Interior's Standards, included in the historic preservation
guidelines which reads, "the historic character of a property shall be retained and preserved. The removal of
historic materials or alteration of features and spaces that characterize a property shall be avoided" (10.0.2).
Our response:
Reason #2 is not applicable given:
1. The lack of original trim due to the prior removal with the application of metal siding
2. The known absence of wooden siding on a large portion of the house
3. The unknown presence of wood siding on the original portion of the house
4. The presence of holes drilled into the house when the blown in insulation was installed
5. The lack of a vapor barrier that would allow any wood siding, if present, to remain intact and free from degradation
The same reasoning can be applied to #3.
• In addition, the cited Secretary of Interior's Standards for Preservation also states "If using the same kind of
material is not technically or economically feasible, then a compatible substitute material may be
considered."
• Staff has used consideration to recommended and HPC has approved changes that affect the character of
other houses within the historic district. We are proposing the opposite - to reinstall previously removed
features with HPC input.

"Bristow added that it is very, very dark on the porch. She said that part of the applicants' interest with the front
porch work is to increase the amount of light that comes in through the front. Bristow said that to do that, the
applicants would remove the astragal and put it up at the point where the beam rests or the columns and remove
one part of the arch, creating a flat beam on tapered columns. She showed an example of that. Bristow said staff
feels that if the balustrade could remain and the material was sound, the panelized balustrade is again another
aspect of the history of the house. She said that at the same time, the applicants would like to get more light in,
and that would help make the area darker. Bristow showed some photographs of the porch, which show that
it is fairly dark and that it seems to have a really low beam across the front."
"Agran said the phrase "false history" is used in terms of deciding which elements of the history of this house staff
is determining to be "false history" or real history. He said it strikes him as strange that staff would say that we
should hold on to certain elements from a certain era of this house but would allow the removal of other
things."
"Agran said he has no problem with spindles but was just curious about what it means if the Commission makes
this exception. He said that the exception is based not on the integrity of the material but the whim of the
owner. Agran said he wanted to understand the rationale."
Reason #4
While aluminum siding covers the existing original siding, impacting the historic character of the house, it is a reversible [sic] condition
since the removal of the aluminum siding would expose the historic siding and trim. Removal of the historic siding, however, would
permanently alter the historic character of the house, unless the material was deteriorated and the new material match the original
Our response:
A large amount of the historic character is known to be removed, damaged, and nonexistent.
Staff recommend first partial removal of the existing siding, and later insisted "seeing one area or side is not enough for staff
to approve wholesale removal'.
In Addition
• Staff and HPC has repeatedly refused to provide criteria that would be used to decide if the wooden siding must be kept, if
present
• Staff and HPC has repeatedly refused to provide an estimate of time
• Staff and HPC has indicated that they would not allow the reapply of the metal siding once removed
Doing so would be costly and it would make it impossible to purchase materials in advance, receive bids, or hire contractors to
start work while the house is exposed to the elements for time needed for HPC to reach decision. Most importantly it would not
address the underlying issue of a lack of a moisture barrier under the siding.
The decision is inconsistent with previous approvals such as 1117 Seymour Ave, where siding was approved for removal
without being seen and without knowledge of the state of degradation.
Summary
• Our project is an attempt to preserve the structure of the historic home, replace materials
known to be either damaged or absent on the home, to return it to the original character,
and to do so with HPC recommended materials commonly used on historic homes
• Staff and the HPC have denied our application without regard for the leeway afforded to and
used by this commission to approve similar projects and to approve greater changes based on
homeowners whims
• Staff and HPC made this denial without any evidence of any wood siding existing, and instead
insist that all current siding must be removed before any decision is given. This was done
without consideration of health, structural integrity, timing, and basic feasibility of construction;
and after examples of wooden siding failing under nearly identical circumstances
• We are asking for the same opportunity to maintain and improve our home as the owners of
Summit, Clark, and Seymour houses were given
• Based on the facts presented here, we respectfully request the City Council members
reconsider the HPC's decision and APPROVE our application.
