A resolution to annex approximately 3.61 acres of land located near the intersection of Finkbine Commuter Drive and Melrose Avenue conditioned upon a 28E Agreement between the City of Iowa City and the City of University Heights, approving the 28E Agreement and authorizing the Mayor to sign and the City Clerk to attest the 28E Agreement. Whereas, the Board of Regents, State of Iowa, for the Use and Benefit of the University of Iowa, is the owner and legal title holder of approximately 3.61 acres currently located in the City of University Heights near the intersection of Finkbine Commuter Drive and Melrose Avenue, as shown and legally described on the map attached hereto as Exhibit OK; and Whereas, Owner has requested annexation of the approximate 3.61 -ac p int of Iowa City, Iowa and has simultaneously requested a severance of the ro ity Heights; and Whereas, the aforementioned property is located adjacent to the core of th#9-4 Af We City; and City Clerk Whereas, control of the area proposed for annexation is in the City's bekNeQ,"Ose it will allow development in a manner consistent with the Comprehensive Plan; and Whereas, pursuant to Iowa Code 368.5 and 368.7 (2021), notice of the application for annexation was sent to the Johnson County Board of Supervisors, Johnson County departments of Attorney, Auditor, Engineer, Planning and Zoning, each affected public utility, the Metropolitan Planning Organization of Johnson County, and the East Central Iowa Council of Governments; and Whereas, none of these entities have objected to the proposed annexation; and Whereas, the Planning and Zoning Commission has reviewed the proposed annexation and rezoning and has recommended approval; and, Whereas the annexation will be conditioned on a 28E Agreement for revenue sharing and rezoning pursuant to Iowa Code Section 368.25A, a copy of which 28E Agreement is attached hereto and incorporated herein. Iowa City and University Heights may also be referred to individually as a "Party", and collectively as the "Parties". (hereinafter "Subject Tract") Whereas the University has filed a voluntary application with University Heights to sever the Subject Tract from University Heights and has filed a voluntary application with the City of Iowa City to annex the Subject Tract into the City of Iowa City in order to facilitate a long-term ground lease to a third party for development of an active adult multi -residential use on a 6.12 acre tract as shown on the attached Exhibit "B" (hereinafter referred to as "Finkbine Tract"); and, Whereas, the Fmkbme Tract currently includes property that is locatly within the jurisdictional boundaries of Iowa City and partially within the jurisdiction . da -1L. Li Man MAR 16 2021 City Clerk Iowa City, Iowa University Heights; said severance and annexation will shift the boundary between the two cities to the east and allow the development to occur entirely within one municipality; and, Whereas, simultaneously with the application for annexation the University has filed an application for rezoning of the Finkbine Tract with Iowa City to OPD/RM-20/P-2 which reflects a proposed planned development overlay zone (OPD), the proposed multi -residential base zone (RM -20), and the University's ownership of the land, which will be maintained (P-2); and, Whereas, the Finkbine Tract is currently vacant ground owned by the University and does not generate any property tax revenue; the long-term lease and development will generate property tax revenue; and, Whereas, University Heights has agreed in concept to said severance and the City of Iowa City has agreed in concept to said annexation conditioned upon certain agreements as set forth herein and as allowable by Section 368.25A of the Iowa Code. Now, therefore, in consideration of the mutual covenants and conditions contained herein, and for other good and valuable consideration the receipt and sufficiency of which is hereby acknowledged, Iowa City and University Heights agree as follows: 1. Incorporation of Recitals. The foregoing recitals are incorporated herein as if fully set forth in this paragraph. 2. Agreement in Concept. Whereas, University Heights has agreed in concept to said severance and Iowa City has agreed in concept to said annexation conditioned upon the agreements as set forth herein. 3. Rezoning. The Parties agree in concept that a rezoning of the Finkbine Tract to OPD/RM-20/P-2 under the City Code of the City of Iowa City to allow for development of an active adult multi -residential use is a desirable and appropriate use of the Finkbine Tract and that the severance and annexation are conditional on a rezoning to OPD/RM-20/P-2 by the City Council of the City of Iowa City. 4. Sharing of Property Tax Revenues. The parties agree that they will share the property tax revenue collected by Iowa City for the Finkbine Tract for a period of 40 years beginning with the year in which tax revenue is first collected by Iowa City for the Finkbine Tract. Iowa City will remit 53% of the tax revenue received by Iowa City each fiscal year to University Heights in two installments. The first installment will be paid by December 31 and the second installment by June 30 of that fiscal year. 53% of any delinquent taxes received after June 30 for a given fiscal year shall be paid to University Heights on or before September 30 of the subsequent fiscal year. So, for instance, if the initial property tax assessment is on January 1, 2021, taxes would accrue on that assessment from July 1, 2021 through June 30, 2022 and taxes would be paid on that assessment by property owners to the County Treasurer by September 30, 2022 and March 30, 2023 and thereafter paid to Iowa City by the County. Tax collections received by Iowa City would be remitted to U�iygrsl y - Heights by December 31, 2022 and June 30, 2023 during fiscal year 211-I MAR 16 2021 City Clerk Iowa City, Iowa final year of revenue sharing would be for the taxes received by Iowa City in fiscal year 2062-63 with the final payment of any delinquent taxes being made by Iowa City to University Heights on September 30, 2063. 5. Notice. Notice by Iowa City to University Heights must be in writing and addressed to: City Clerk, City of University Heights, IA 1302 Melrose Avenue, Iowa City, IA 52246. Notice by University Heights to Iowa City must be in writing and addressed to: City Clerk, City of Iowa City, IA, 410 E. Washington St., Iowa City, IA 52240. Notice shall be effective as follows: On the date of delivery if hand delivered or 3 days after the date of mailing if by U.S. mail. 6. Entire Agreement. This Agreement sets forth all the covenants, promises, agreements, and conditions between Iowa City and University Heights concerning said severance and annexation and there are no other covenants, promises, agreements, or conditions, either oral or written, between them. This Agreement may not be modified or amended in any manner except by an instrument in writing executed by the Parties. 7. No Separate Legal Entity. No separate legal entity is being created for purposes of this Agreement. 8. Purpose. The purpose of this Agreement is for the Parties to memorialize the terms on which said severance and annexation are conditioned in accordance Iowa Code Section 368.25A. 9. Administration. The Finance Director of Iowa City and Mayor of University Heights shall administer this Agreement on behalf of Iowa City and University Heights, respectively. 10. Duration/Termination. This Agreement will go into effect upon passage by the Parties' City Councils and the filing and recording of this Agreement as provided in Section 11 hereof. In the event said severance and annexation are approved by the parties' City Councils and the State City Development Board this Agreement shall remain in effect until the final tax payment is made by Iowa City to University Heights pursuant to paragraph 4 hereof unless otherwise terminated earlier by the written agreement of the parties. 11. Filine/Reeording. Upon approval and execution of this Agreement by Iowa City and University Heights, the City Clerk of Iowa City shall file this Agreement with the Office of the Iowa Secretary of State as required by law and record this Agreement with the Johnson County Recorder. An amendment to the National Historic Preservation Act in 1980 created the Certified Local Government program. The creation of this program established a formal partnership between federal, state, and local governments and encouraged local governments to undertake historic preservation efforts. The program has four primary purposes: 1. Encourage historic preservation at the local level. 2. Encourage local governments to follow the Secretary of the Interior's Standards & Guidelines for Archaeology and Historic Preservation in the administration of local historic preservation programs. 3. Provide technical assistance through the SHPO. 4. Provide funding opportunities for preservation activities. In order to maintain the City's certified local government status, an annual report must be submitted to the SHPO. The report summarizes the previous year's preservation activities, meetings, and trainings. The Historic Preservation Commission reviewed the annual report at its meeting on February 11. In addition to the review by the Commission, the SHPO requires that the report be presented to the City Council at a public meeting. The report also requires the Mayor's signature. Background /Analysis: At the City Council's meeting on April 6, staff will present a summary of the 2020 CLG Annual Report. The highlights of the report are as follows: • Staff processed 85 applications for historic review that resulted in an approval either via a Certificate of No Material Effect or a Certificate of Appropriateness. This was a slight decrease from the 98 applications processed in 2019. • Staff continues to implement the Historic Preservation Fund. In 2020, the City was able to fund 10 projects. • In February 2020, staff gave a lunch presentation as part of the city-wide celebration of Black History month that highlighted two properties recently listed in the National Register of Historic Places that provided housing for African American students during the early 20th century. Following the August 2020 derecho, staff responded to multiple inquires from surrounding jurisdictions about best practices for repair. Staff also sent out several letters to property owners with derecho damage outlining how we could be of assistance. • Graduate students from the University of Iowa School of Urban and Regional Planning completed a capstone project related to historic preservation in downtown Iowa City. Commission staff provides technical and design assistance to applicants for Historic Review. The applicants are encouraged to meet with the staff well ahead of time in the project planning process, prior to submitting applications, to discuss their projects. An annual letter to property owners suggests this and it is regularly communicated to the public when possible. In 2020, the amount of inquiries drastically increased from the 2019 total of 198 individual property inquiries to 248 individual properties inquiries, many properties with multiple inquiries. It is assumed that this year's increase was due to the impacts of Covid-19 and owners' increasing awareness of their historic buildings. Over a two-year period, inquiries about potential projects have increased 55%. From those initial inquiries, in 2020 staff processed 85 applications for review that resulted in either a Certificate of Appropriateness or a Certificate of No Material Effect. This was a slight decrease from the 98 applications processed in 2019, likely due to the impacts of Covid-19 on property -owner's budgets and their ability to proceed with projects. Following the August 2020 derecho, staff responded to multiple inquiries from surrounding communities about best -practices for repair and for contact information on contractors experienced in historic buildings. Staff was part of a team that reviewed some of the draft Master Planning documents for the Iowa City Senior Center which occupies the National Register and local landmark Old Post Office building. Staff and several others were interviewed for the project and the findings were presented to the Commission during the May 14, 2020 meeting. Staff works internally as a resource for other City departments on projects that would include historic resources. Like all communities the Covid-19 pandemic impacted our day-to-day function. Beginning with the April Commission meeting we transitioned to hold virtual meetings through Zoom. While it is nice to get together in person to have a formal meeting without children and pets involved, the virtual meetings likely led to increased Commissioner and public participation. Moving our Awards program from January to May improved our ability to acquire information from property owners because they were not away on holiday but it meant that the awards planning occurred during the busy time for historic reviews. Because of Covid, this program became a virtual one as well. Covid, hindered some of the notification of winners that normally occurs with the program and award certificates that are normally handed out at the ceremony were not sent until the end of the year. The Historic Preservation Fund (a grant and no -interest loan program) has allowed and will continued to allow property owners to take the extra steps they might not otherwise take when rehabilitating the exterior of their properties. It has been beneficial in the effort to prevent the loss of historic materials and reduce landfill waste. Staff and the Commission have been working on efforts to save the Sanxay-Gilmore House at 109 Market Street from demolition and completed a grant project in mid 2019, for the pre -planning of a possible relocation for the house. While consultant, AKAY Consulting submitted National Register Nomination for Iowa City's Central Business District to the State for review and the Commission completed its CLG review of the Nomination, the process was halted due to a clerical error on the State's part. The process will be repeated in 2021. There are concerns that the delay may impact the success of the Nomination. Graduate students from the University of Iowa School of Urban and Regional Planning completed a capstone project related to historic preservation in downtown Iowa City. The project was inspired by an article that Patrice Rey, President and CEO of the national Main Street Center, wrote in February 2019. She argues that historic preservation needs a new approach that considers dynamic social issues to protect historic resources without alienating the stewards of those resources. The project concluded with many of Iowa City's Historic Preservation process and Commission goals seen in a positive light. While the Commission has been ambitious is its work plan over recent years, shortages in Commissioners and staff time have both hampered the ability of the Commission to move forward with new projects and the ability to complete current projects. The Commission is currently short three Commissioners from small districts where recruitment of new Commissioners is difficult. Current term cycles will result in the need to recruit new Commissioners each year. This year's increase in inquiries in particular, led to a strain on staffs ability to make progress on any additional projects, especially in the second half of the year. The response time on inquiries and formal reviews has increased. Staff has had to reduce the types of assistance that can be provided. For instance, in the past staff has regularly worked with homeowners who cannot afford to hire someone to provide project drawings for historic approval and permits by creating those drawings for them. The ability to provide this service is listed in the staff job description. Staff is no longer able to provide this assistance which primarily impacts lower income homeowners in regulated properties. Staff has also had to reduce the amount of background research done on properties during the review process and the amount of time educating homeowners on their properties and historic preservation. Iowa Federation Home The Iowa Federation Home, located at 942 Iowa Avenue, wase dormitory for Black m feale studetrls. In 1919, a group of students sought help from the Iowa Federation of Colored Women's Clubs. The organization—caroded by con ducting en ambitious fundraising campaign that raised enough to Furth— a house. The Federat'on Home opened in 1920. Prior to its establishmcrd, these students struggled to find housing in Iowa City. Many property owners refused to rent or sell to persons of color and housing as hard tocome by for Black university students, Some served as IWe-In domestic workers astl pursuedtheireducit'on an dothersfoundh—r,gwithmembers of Iowa Citys small Black „,unity. At its peak, the Federad'an Nome provided housing tot 17 women and acted as a sccfal cerrter for Black students housed elsewhere. The dormitorywas home to many traiblasers; residents included some of the first slack en m graduate from the University d Iowa's College of law and College d pharmacy. The Federation Home dosed 3n 191 four years after campus do rmitorles Integrated. Tate Arms From 1940 through the mid -1960', many Black male students lived at the Tate Arms, located at 9145. Dubuque Street Tate Arms wasa private boarding houseawned and operated by Elizabeth "Bettye" Crawford Tate and 3unlous 'Bud' Tate. Bettye worked at the University, of Iowa's cardiovascular laboratory and Bud owned a janitorial service. The Tates Wereone of several Black famllieswho provided housing to students. Today, both the Federation Home and Tate Arms are privately owned apartment buildings. National Register of Historic Places ws City recently received a grant frem the National Park Service to help preserve these two homes and develop educational material about their history. The Iowa City Historic Preservation Commission is currently working tawnMs getting these properties listed on the National Register of Historic Places. This will solidlfy their importance ashistoric landmarks associated with the struggle for housing equality far Black students in Iowa City.
