February 2021 Disbursements Motion to approve disbursements in the amount of $9,488,786.44 for the period of February 1 through February 28, 2021, as recommended by the Finance Director subject to audit. Disbursements are published and permanently retained in the City Clerk's office in accordance with State Code. Ecological Restoration -Terry Trueblood and Whispering Meadows Resolution authorizing the procurement of The Terry Trueblood Recreation Area Ecological Enhancement & Restoration of Woodlands and Whispering Meadows Wetland Paris Ecological Restoration. Comment This resolution will authorize the ecological enhancement and woodland restoration at two locations within the Iowa City parks system. Restoration locations will include Terry Trueblood Recreation Area and Whispering Meadows Wetland Park. Combined area of both sites is approArnately 58.5 acres. Funding for this project has been obtained with two REAP grants. The REAP Grant for the Terry Trueblood restoration is $200,000.00 and the Whispering Meadows restoration is $90,500.00. Interim City Attorney zt S" Resolution approving the appointment of Sue Dulek as Interim City Attorney for the City of Iowa City. Comment: City Attorney Eleanor Dilkes announced her retirement effective April 16, 2021. It is anticipated there will be a gap between her retirement date and the effective date of a new hire for the City Attorney position. This resolution appoints First Assistant City Attorney, Sue Dulek, as Interim City Attorney effective April 17, 2021 until a permanent City Attorney is appointed by the City Council. 6.d. Battery Electric Bus Purchase Agreement Resolution authorizing the procurement of four (4) 40 Foot Battery Electric Buses and three (3)180 kW Dual Charging Stations for the City of Iowa City Transportation Services Division. Comment This Resolution will approve the procurement of four (4) 40 Foot Battery Electric Buses to replace four (4) diesel powered transit buses at the end of their useful life, and also the procurement of three (3) Associated Charging Stations for the City of Iowa City Transportation Services Division. This purchase will exceed the $150,000 spending authority of the City Manager, thereby requiring Council approval. The buses and 12 -Year Extended Battery Warranties will cost $4,358,156. The cost for the charging equipment is $284,000) for three (3) dual plug-in 180 kW Charging Stations, for a total of $4,642,156. The City has received $3,017,280 in Low or No Emission Grantfunding from the Federal Transit Administration and $398,820 in Iowa DOT Grant Funding to use towards this purchase, with $1,226,056 as the remaining local share. 6.e. FilmScene-Chauncey Swan Park Agreement 21 Resolution authorizing City Manager to sign an agreement with FilmScene to show films in Chauncey Swan Park. Comment This agreement provides $50,000 in funding to FilmScene to be used to purchase equipment for outdoor movies in Chauncey Swan Park. The movies will be presented in partnership with Summer of the Arts and Iowa City Parks and Recreation and will be free to the public beginning in the 2021 season. American Legion Road Utility Easements �- V7 Resolution authorizing the Mayor to sign and the City Clerk to attest to a non-exclusive and partial assignment of easements to MidAmerican Energy Company in connection with the American Legion Road Improvement Project. Comment MidAmencan Energy will be undergrounding overhead electicfacilbes in connection with the Citys American Legion Road Improvement Project - Scott Blvd. to Taft. The City acquired public utility easements from adjoining property owners hat will allow for the placement of public utilities, including MidAmerican's electric and gas facilities. This assignment will clarify that MidAmerican has such easement rights. 7. Setting Public Hearings 7.a. Sale of 2131 Taylor Dr. 21 "fig Resolution setting public hearing for April 20, 2021, on a proposal to convey a single-family home located at 2131 Taylor Drive. Comment The South District Home Investment Partnership Program is an effort by the City to encourage home ownership and reinvestment in designated neighborhoods. The City purchased a duplex at 2129-2131 Taylor Dr., rehabilitated it, converted it to a 2 -unit condominium, and has received an offer from an income -eligible family to buy the unit at 2131 Taylor Dr. for $133,500. 7.b. Transit Funding Application ZI " Resolution setting a public hearing for the May 4th, 2021 City Council meeting regarding the FY2O22 Iowa Department of Transportation Consolidated Transit Funding Application for Iowa City Transit. Comment The Metropolitan Planning Organization of Johnson County will be filing a consolidated transit funding application on behalf of Iowa City Transit with the Iowa Department of Transportation. This is an annual process that Iowa City undertakes, outlining federal funds requested for operating and capital expenses and ensures projects become eligible for potential use of federal funds. In accordance with statutory requirements, this resolution will set the public hearing for the May 4th, 2021 City Council meeting. A notice will be published announcing the date of the hearing. Planning and Zoning Matters If a majority of the Council is inclined not to concur with the Planning and Zoning Commission recommendation a consult with the Planning and Zoning Commission should be offered before the close of the public hearing. 9.a. Annexation - Finkbine 2-1- `� �' Resolution to annex approximately 3.61 acres of land located near the intersection of Finkbine Commuter Drive and Melrose Avenue conditioned upon a 28E Agreement between the City of Iowa City and the City of University Heights, approving the 28E Agreement and authorizing the Mayor to sign and the City Cleric to attest the 28E Agreement. (ANN20-0002) Comment At its February 18, 2021 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of this annexation. Approval will incorporate the subject property into the City limits, pending approval from the state's City Development Board. Rezoning - Finkbine Ordinance conditionally rezoning approximately 6.12 acres of land located near the intersection of Finkbine Commuter Drive and Melrose Avenue to Medium Density Mufti -Family Residential (RM - 20) and Institutional Public (P-2) with a Planned Development 2� Overlay (OPD/RM-20/P-2) (RE720-0012). Comment At its February 18, 2021 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the rezoning, subject to conditions related to delayed issuance of a building permit until the subject property has been final platted and delayed issuance of a certificate of occupancy until an eastbound left tum lane is installed on Melrose Avenue at the proposed access. (CSUB21-0001) Comment At its March 18th meeting, the Planning and Zoning Commission recommended approval of the preliminary plat by a vote of 7-0. Court Street Transportation Center Lease Extension 2-1-92— Resolution authorizing the Mayor to sign and the City Clerk to attest an Addendum to a Lease Agreement with Graze Iowa City, LLC for Sri— commercial space within the Court Street Transportation Center to extend said lease. Comment This resolution grants approval for the Addendum to Lease awarding Graze Iowa City, LLC four renewal option periods of five years each, adjusted for inflation, for commercial space within the Court Street Transportation Center. 1. Gilbert Court Sidewalk Infill 2 " q2) Resolution approving project manual and estimate of cost for the construction of the Gilbert Court Sidewalk Infill Project, establishing amount of bid security to accompany each bid, directing City Clerk to post notice to bidders, and fixing time and place for receipt of bids. 5a- Comment This project includes construction of 4 -foot wide sidewalk along the east and west sides of Gilbert Court between 1306 Gilbert Court and Highland Avenue. Alcohol in Park Shelters Ordinance amending Title 4, entitled "Alcoholic Beverages," and Title 10, entitled "Public Ways and Property," to allow alcohol in parts shelters. (First Consideration) Comment Currently persons may only possess and consume alcohol in a park with a permit or written agreement This ordinance loosens that restriction to allow beer and wine to be possessed and consumed in cenjunction with any shelter reservation except for the sheRers in Napoleon and Kickers parks. Parking -Curbside Pick Up & Delivery 24 -495Q Ordinance amending Title 9, entitled "Motor Vehicles and Traffic," Chapter 4, entitled 'Parking Regulations," Section 10, entitled "Parking for Loading and Unloading," to establish a curbside pick-up and delivery space. (Second Consideration) Comment: With the increase of pick-up and delivery since the beginning of the COVID-19 pandemic, staff recommends designating a space or spaces for short-term curbside pick-up and delivery in the downtown. To incentivize adequate turnover in the space, it should be a separate offense every 10 minutes the vehicle remains in violation, which is the same provision that applies to all passenger loading zones.
