HomeMy WebLinkAbout2021-05-04 Public hearingOFFICIAL PUBLICATION NOTICE OF PUBLIC HEARING TO ALL TAXPAYERS OF THE CITY OF IOWA CITY, IOWA, AND TO OTHER INTERESTED PERSONS: Public notice is hereby given that the City of Iowa City, Iowa will conduct a public hearing on the City's FY2022 Iowa DOT Consolidated Transit Funding grant application. The application will be for approximately $554,905 (3.41) in Iowa DOT State Transit Assistance formula funds to be used for operating and/or purchasing capital items for Iowa City Transit during FY2021. Said application will also include a listing of projects to be applied for in FY2022 from the Federal Transit Administration (FTA) Section 5307, Section 5310, and/or Section 5339 programs. The FTA Section 5307 program provides formula federal funds to be used for the operating and capital needs of Iowa City Transit. The Section 5310 program provides federal funds to be used for programs assisting persons with disabilities and Section 5339 is a discretionary capital funding program. Economic consequences Some historic buildings requiring extensive rehabilitation have remained vacant for years without other viable uses being identified Concern raised as part of the Tailwinds project at 109-121 E. College St. Amendment was developed to: Address some unintended impacts Support goals of the comprehensive plan, including historic preservation Existing Provisions: Drinking Establishments Defined at 14 -4A -4F as meeting 3 criteria: 1. The principal activity of the establishment is the preparation, dispensing and consumption of food and/or beverages The establishment is licensed by the state for the sale of alcoholic beverages for on-site consumption, as defined by Iowa Code chapter 123 The establishment is open for business on a regular basis any time between the hours of 12:00 midnight and 2:00 A.M. Otherwise generally defined as an Eating Establishment Existing Provisions: Nonconforming Uses Nonconforming uses are established legally, but when the zoning code changes, they no longer meet the new standards Provisions regarding nonconforming uses (14-4E-5) are meant to bring uses into compliance with City Code over time Generally subject to several provisions: Cannot enlarge a nonconforming use except as allowed by code Can be converted to another use, but must be less intense (may require special exception) Accessory uses may continue with a nonconforming principal use Can typically reestablish within 2 years if damaged or destroyed Where discontinued for one year, it must convert to a conforming use Existing Provisions: Nonconforming Uses •Drinking establishments not conforming to the separation distance requirement have special standards (14 -4E -5G) •Such uses are considered grandfathered unless the use changes or the license is discontinued or revoked for more than a year Some provisions that allow for expansion - Rooftop cafes are allowed • Sidewalk cafes are not considered an expansion Proposed Amendment Changes standards for nonconforming drinking establishments by allowing it to continue where: It is zoned with a Historic District Overlay (OHD) The building has remained vacant for 2 years Also allows expansion of those establishments into spaces that meets those same two requirements Goals *Encourages rezoning downtown properties as local historic landmarks - Historic District Overlay (OHD) designation provides local land use protections to the historic building *Facilitates economic development • Only available where buildings have remained vacant for 2+ years • First provides an opportunity for alternative businesses to establish • Where other uses are not established, allows a previous drinking establishment use to continue Designed to limit potential misuse of ordinance Ma 2 Analysis •100+ businesses can serve alcohol in the UTA and RFC 43 current drinking establishments 38 are nonconforming due to the 500' separation distance 9 former nonconforming drinking establishments lost their nonconforming status 2 vacant drinking establishments may lose their nonconforming status 5 n -,, , ig EA Butler Q uriversiy Impau Anal Q RiveWr t Crossings Dislrid Drinking Est. Load 350-447 4 Studio Apartments 111 Commercial Tenant Spaces Consistency with the Comprehensive Plan The proposed amendment supports several related goals from the City's comprehensive plan: Preserve the historic, main street character of the Downtown, while encouraging appropriate infill development to enhance the economic viability and residential diversity of the area. Increase and diversify the property tax base by encouraging the retention and expansion of existing businesses and attracting businesses that have growth potential and are compatible with Iowa City's economy. Encourage new business development in existing core or neighborhood commercial areas Planning &Zoning Commission Recommendation The Planning & Zoning Commission recommends approval of the proposed code amendments to: Allow the continuance and expansion of nonconforming drinking establishments where they are in buildings that are zoned historic (OHD) and where those spaces have remained vacant for at least two (2) years.
