August 2021 Disbursements Motion to approve disbursements in the amount of$12,156,807.63 for the period of August 1 through August 31, 2021, as recommended by the Finance Director subject to audit. Disbursements are published and permanently retained in the City Clerk's office in accordance with State Code. October 19, 2021 Iowa City City Council Agenda Page 3 7.b. SSMID Petition - South District Motion notifying the Iowa City Planning &Zoning Commission of the petition for the establishment of the South District Self- Supported Municipal Improvement District filed with the City Clerk on October 7, 2021 and referring said petition to the Planning and Zoning Commission for the preparation of an evaluative report for the Council on the merit and feasibility of the project, all in accordance with Chapter 386.3(3) of the Code of Iowa. Comment:On October 7,2021,a petition for the establishment of the South District Self-Supported Municipal Improvement District(SSMID)was filed with the City Clerk. The petition contains the signatures of at least 25%of the property owners representing at least 25%of the property valuation in the proposed district as required by state law. State law requires that upon receipt of a petition for establishment of a SSMID, the Council shall notify the City Planning Commission which is to make recommendations to the Council regarding the proposed district. Per Iowa Code,the council shall not hold its public hearing or take further action on the establishment of the district until it has received the report of the Planning and Zoning Commission. 7.c. Tobacco Enforcement Agreement 21 -24pc Resolution authorizing the City Manager to sign and City Clerk to attest a 28E Agreement with the Iowa Alcohol Beverages Division for Tobacco Enforcement. Comment This resolution approves a 1-year agreement with the State for financial assistance for tobacco compliance checks. In exchange for the City agreeing to check each tobacco,alternative nicotine and vapor product permit holder,the State will pay the City$75 per compliance check. If a permit holder is found to be non-compliant in the first check,the City agrees to conduct a second compliance check. 7.d. Amending budgeted positions - Finance Office 21 - ?Apt( Resolution amending budgeted positions in the Information Technology Services Division of the Finance Department and the Administrative and Confidential pay plan by adding one full-time Information Security Analyst position, grade 26. Comment Approval of this resolution will add an Information Security Analyst position, in the ITS division within the Finance Office,at grade 26 of the Administrative and Confidential pay plan.This position will be responsible for monitoring.tracking.and analyzing security systems at the City. PS1 Loan Agreement 2-1 - 1 Resolution authorizing the City Manager to sign an amendment to the loan agreement with Public Space One, Inc. for community programming at 538 S. Gilbert St. Comment The City and Public Space One, Inc.(''PS1")have an agreement whereby the City provided a ban for the acquisition of 730 S.Dubuque St in exchange for providing community programming at the site.PS1 is selling 730 S. Dubuque St and buying 538 S.Gilbert St The amendment requires PS1 to continue providing community programming at 538 S.Gilbert and also forgives the loan in 2026. 7.f. Community View Part Two - Final Rat 2 I - 2 [Q Resolution approving the final plat of Community View- Part Two, Iowa City, Iowa (SUB21-0007). Comment The City Council approved the preliminary plat of Community View on May 21,2020.Staff recommends approval of the final plat subject to approval of the legal papers by the City Attorney.Construction drawings for Community View—Part Two were approved with the final plat of Community View—Part One. It is anticipated that legal papers will be approved prior to the October 19 City Council meeting.Approval will result in the creation of 40 single-family lots west of Buckingham land and north of American Legion Road. 7.g. Asphalt Resurfacing- US Hwy 1 (Burlington Street and Governor Street) 2018 21 - Resolution accepting the work for the Asphalt Resurfacing - US Hwy 1 (Burlington Street and Governor Street)2018 Project. Comment The project has been completed by LL Pelling Company of North Liberty, Iowa, in substantial accordance with the plans and specifications.The Engineer's Report and Performance and Payment bonds are on file with the City Clerk. . Setting Public Hearings 8.a Comprehensive Plan Amendment- Fringe Area Agreement Motion setting a public hearing for November 16, 2021 on a resolution to amend the Comprehensive Plan to update the Fringe Area Policy Agreement between Johnson County and the City of Iowa City. (CPA21-0003) Comment At its October 7,2021 meeting,the Planning and Zoning Commission recommended approval of the Comprehensive Plan amendment by a vote of 5-0 (Hensch recused,Notte absent).Adoption of this resolution will update the land use policy direction that the City and County will use within the Citys extraterritorial fringe area. 8.b. Comprehensive Plan Amendment- Southwest District Motion setting a public hearing for November 16, 2021 on a resolution to amend the Southwest District Plan and Comprehensive Plan to allow intensive commercial and open space land uses for the property south of IWV Road SW and west of Slothower Road. (CPA21-0002) Comment At its October 21 meeting,the Planning and Zoning Commission will consider recommendation of this comprehensive plan amendment Adoption of this resolution will allow intensive commercial and open space land uses for approximately 79 acres of the property located south of IWV Road SW and west of Slothower Road.Specifically,the amendment will change the Comprehensive Plan future land use map to Intensive Commercial and Public/Private Open Space and will change the Southwest District Plan text and future land use map to Intensive Commercial and Vegetative Noise/Sight Buffer. Annexation - IWV Motion setting a public hearing for November 16, 2021 on a resolution to annex approximately 70.39 acres of land located west of the intersection of IWV Road and Slothower Road. (ANN21-0003) Comment At its September 16,2021 meeting,by a vote of 5-0(Martin and Nolte absent),the Planning and Zoning Commission recommended approval of this annexation.Approval will incorporate the subject property into the City limits, pending approval from the states City Development Board. 8.d. Motion setting a public hearing for November 16, 2021 on an ordinance conditionally rezoning approximately 53.36 acres from County Agricultural (A)to Intensive Commercial (CI-1), approximately 17.03 acres from County Agricultural (A)to Interim Development Commercial (ID-C), and approximately 9 acres from Rural Residential (RR-1 )to Intensive Commercial (CI-1) for land located west of the intersection of IWV Road and Slothower Road. Comment The Planning and Zoning Commission will be considering this matter at its October 21st meeting. 8.e. Influent Rake and Screen Replacement - Resolution setting a public hearing on November 16, 2021 on project manual and estimate of cost for the construction of the Influent Rake and Screen Replacement Project, directing City Clerk to publish notice of said hearing, and directing the City Engineer to place said project manual on file for public inspection. Comment This project involves replacing the influent rake and screen assemblies and constructing new associated operational improvements.The estimated cost of construction is$1,800,000 and will be funded by the Influent Rake and Screen Replacement account#V3153. 9.
